P.P. for the State.\n<\/p>\n<p>                               Thartharari P.S. Case no. 18\/2010 was initially, registered<\/p>\n<p>                    under sections 450, 307\/34 of the IPC and 27 of the Arms Act on<\/p>\n<p>                    26.4.2010 on the basis of fardbeyan of one Ranjay Kumar who<\/p>\n<p>                    happens to be nephew of the deceased. The aforesaid Ranjay Kumar<\/p>\n<p>                    specifically stated in his fardbeyan that FIR named accused namely<\/p>\n<p>                    Naresh Gope and Suresh Gope opened fire as a result of which his<\/p>\n<p>                    uncle sustained fire arms injuries. It further appears that a protest<\/p>\n<p>                    petition was also filed on behalf of the aforesaid Ranjay Kumar but he<\/p>\n<p>                    has stated nothing in the aforesaid protest petition against the<\/p>\n<p>                    petitioner. It further appears that on 4.5.2010 after death of the<\/p>\n<p>                    deceased, his wife, namely, Rita Devi gave her fardbeyan in which she<\/p>\n<p>                    stated that it was the petitioner who opened fire on the deceased on<\/p>\n<p>                    account of land dispute.\n<\/p>\n<p>                               Considering the aforesaid facts and circumstances as well<\/p>\n<p>                    as submissions of the parties, let the petitioner, Shyam Kishore Yadav,<\/p>\n<p>                    be released on bail on furnishing bail bonds of Rs 10,000\/- with two<\/p>\n<p>                    sureties of the like amount each to the satisfaction of the Addl. Chief<\/p>\n<p>                    Judicial Magistrate, Hilsa Nalanda,      in Tharthari P.S.
