Rajasubrahmanya Bhat, SPP]<\/p>\n<p>O  This Cr1.p filed U\/s.482 <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a> by the advocate\n<\/p>\n<p id=\"p_1\">&#8211;   for the petitioner praying that this Hon&#8217;b1e Court may<br \/>\nbe pleased to quash the proceedings in<\/p>\n<p>C.C.No.887\/2003 on the file of the C.J(JR.DN.] and<br \/>\nJ.M.F.C Sorab.\n<\/p>\n<p id=\"p_2\">\n<p>This Criminal Petition coming on for Hearing, this<br \/>\nday, the Court, made the following:<br \/>\n0 R I) E R<\/p>\n<p>Petitioner arrayed as accused No.2 in the<\/p>\n<p>as Manager of Karnataka Seed  &#8216;<\/p>\n<p>Shirnoga, has preferred this abovepetitiolni&#8221;se,e1\u00a7i1igj_fo&#8217;;: To<\/p>\n<p>quashing of proceedings in \/<\/p>\n<p>the \ufb01le of Civil Judge [Jr.Dn;):Vy:&#8217;al:Ld\n<\/p>\n<p id=\"p_3\">2. The learned Counsel for the petitioner<\/p>\n<p>submits, by the tirne received the<\/p>\n<p>surrirnons    the shelf life of the<\/p>\n<p>seeds  he could not challenge<\/p>\n<p>thepgreplort of the: Seed; Analyst and ask for retesting<\/p>\n<p>All:&#8217;tihrougli:Central Seed Laboratory as permissible under<\/p>\n<p>Se-of.31&#8217;G{l2).,l__oi:;&#8217;tlie <a href=\"\/doc\/1424192\/\" id=\"a_1\">Seeds Act<\/a>. Therefore, Continuation of<\/p>\n<p>cririzinal proceedings will not serve any purpose and he<\/p>\n<p>   prays  quashing of further proceedings.<\/p>\n<p> Learned High Court Government Pleader<\/p>\n<p>appearing for the respondent &#8212; State does not dispute<\/p>\n<p>the said fact.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">4. The seeds in question is paddy. The Seed Analyst<br \/>\nof Seed Testing Laboratory, Bangalore, functioning<\/p>\n<p>under Karnataka Seeds Certification  a<\/p>\n<p>Government of Karnataka undertaking,   &#8216;_<\/p>\n<p>14-2-98 has certified that their-as:1spvg11a,1a~,9temonths; C ; <\/p>\n<p>i.e. upto 13-11-98, during which re\u00abspS;{;in.S\u00a71e1&lt;1t<\/p>\n<p>\u00bb.r&#039; complainant collected thasampie  frorn<\/p>\n<p>the accused No.1    the Seed<br \/>\nLaboratory, Dharwaid,   Dharwad,<br \/>\nby report  the sample of<br \/>\nDaddy  No.1 is a sub-\n<\/p>\n<p id=\"p_6\"> said report, respondent<br \/>\n\ufb011edx&#8221;a.,V_ the accused before the trial<\/p>\n<p> unwdergsec.  of <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>. read with Rule 6(a) of<\/p>\n<p>  Ti\u00e9tules,  and requested the trial Court to<\/p>\n<p> ._ in accordance law.\n<\/p>\n<p id=\"p_7\"><span class=\"hidden_text\" id=\"span_1\">1<\/span><\/p>\n<p id=\"p_8\">5. &#8221; _ _A7I&#8217;he trial Court after registering the complaint as<\/p>\n<p>it &#8216;V_,_C:&#8217;;.C.No.887\/O3 issued summons to the petitioner on<\/p>\n<p> 27-2-99, by which time, the shelf life of the paddy had<\/p>\n<p>expired as per Analysts report dt. I4-2&#8211;98. As a result,<\/p>\n<p>accused could not have availed the opportunity of<\/p>\n<p>Challenging the report of the Seed Laboratory, Dharwad,<br \/>\nand ask for retesting of the seeds through&#8217;-Central<\/p>\n<p>Seeed Laboratory, as permitted under Seo,.&#8217;_&#8221;i  the<\/p>\n<p>Seed Act, 1966. Therefore, continuatiof; <\/p>\n<p>proceedings will be of no use&#8221;ar&#8221;1&#8217;d to <\/p>\n<p>abuse of process of law. V<\/p>\n<p id=\"p_9\">6.
