PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t      J U D G M E N T<br \/>\nPATTANAIK, J.\n<\/p>\n<p id=\"p_1\">     Leave granted.\n<\/p>\n<p id=\"p_2\">     This appeal  by special  leave is\tdirected against the<br \/>\njudgment of the Andhra Pradesh High Court dated 27.8.1993 in<br \/>\nwrit petition  No.3734 of  1993. The  present appellant\t was<br \/>\nrespondent No.6\t before the  High Court.  SAKTI, a voluntary<br \/>\nsocial organisation  for the  upliftment of  tribals in east<br \/>\nGodavari District  find the  writ  petition  in\t the  Andhra<br \/>\nPradesh\t High\tCourt  praying\t therein  that\t the  mining<br \/>\nactivities which  are carried  on by the respondents 6 to 10<br \/>\nin the\tsaid writ  petition should be immediately stopped as<br \/>\nthe  grant   of\t mining\t  leases  in   their  favour  is  in<br \/>\ncontravention of  Section 3  of the Andhra Pradesh Scheduled<br \/>\nAreas Land,  Transfer Regulation, 1959 (hereinafter referred<br \/>\nto as  the `Regulation&#8217;)  as well as <a href=\"\/doc\/1642441\/\" id=\"a_1\">section 2<\/a> of the Forest<br \/>\n(Conservation) Act,  1980 (hereinafter\treferred to  as\t the<br \/>\n&#8216;<a href=\"\/doc\/755257\/\" id=\"a_1\">Conservation Act<\/a>&#8216;).  It was  averred in  the writ  petition<br \/>\nthat the  villages where  the mining  activities  are  being<br \/>\ncarried on  were notified as protected forests under Section<br \/>\n24 of  the Andhra  Pradesh Forest Act, 1967 with effect from<br \/>\n8.9.1975  and\twithin\tthe  said  forest  area\t it  is\t not<br \/>\npermissible to\tcontinue any  mining activity in view of the<br \/>\nprovisions of  the conservation\t Act which prohibits user of<br \/>\nforest land for non-forest purpose.\n<\/p>\n<p id=\"p_3\">     Respondents 1  to 4 before the High Court, who were the<br \/>\npublic officers\t of the\t State Government supported the case<br \/>\nof the petitioner and took the stand that a joint inspection<br \/>\nreport had  been conducted  after surveying  the  area\tover<br \/>\nwhich the  mining activities  are being\t carried   on by the<br \/>\nrespondents 6  to 10 and the said report reveals that mining<br \/>\nleases have granted over the forest area which is prohibited<br \/>\nunder the  conservation Act  without prior  approval of\t the<br \/>\nCentral Government.\n<\/p>\n<p id=\"p_4\">     Respondent No.6  the present  appellant took  the stand<br \/>\nthat the lease having been granted much prior to the area in<br \/>\nquestion was  included as  a protected\tforest, the  embargo<br \/>\ncontained in the provisions of the <a href=\"\/doc\/755257\/\" id=\"a_2\">Conservation Act<\/a> will not<br \/>\napply and  in this  connection reliance\t was placed  on\t the<br \/>\ndecision of  this Court\t in the\t case of  STATE OF BIHAR Vs.<br \/>\nBANSHI RAM,  (199) 3  SCC 643.\tIt was\talso contended\tthat<br \/>\n<a href=\"\/doc\/960986\/\" id=\"a_3\">Section 3<\/a> of the regulation has no application to a transfer<br \/>\nby the Government in respect of its land in favour of a non-<br \/>\ntribal and  the word  `person&#8217; in  <a href=\"\/doc\/960986\/\" id=\"a_4\">Section  3<\/a>  of  the\tsaid<br \/>\nregulation will\t not  include  the  Government.\t It  is\t not<br \/>\nnecessary for us to examine the stand taken by other private<br \/>\nrespondents, namely respondents 7 to 10.\n<\/p>\n<p id=\"p_5\">     The High  Court by\t the impugned  judgment came  to the<br \/>\nconclusion that\t the transfer  of any land in scheduled area<br \/>\nto a  non-tribal is  void under <a href=\"\/doc\/379553\/\" id=\"a_5\">Section 3<\/a> of the Regulation,<br \/>\nand therefore, the lease in favour of respondent no 6 within<br \/>\nthe scheduled  area is\tvoid. The  High Court  came  to\t the<br \/>\nconclusion that\t the word  `person&#8217;  in\t <a href=\"\/doc\/379553\/\" id=\"a_6\">section  3<\/a>  of\t the<br \/>\nRegulation includes  the Government,  and therefore,  leases<br \/>\ngranted by  the State Government in scheduled area to a non-<br \/>\ntribal is  void .  On the  question of\tapplicability of the<br \/>\nconservation  Act  the\thigh  Court  also  relied  upon\t the<br \/>\ndecision of  this court in the Banshi Ram&#8217;s case (supra) and<br \/>\ncame to\t the conclusion\t that for grant of mining lease in a<br \/>\nprotected forest  area\tfor  non-tribal\t purpose  the  prior<br \/>\napproval of  the Central  Government is\t mandatory and since<br \/>\nthe Government\tdid not\t obtain the  approval of the Central<br \/>\nGovernment, leases  are in contravention of <a href=\"\/doc\/1642441\/\" id=\"a_7\">section 2<\/a> of the<br \/>\nForest\tConservation   act,  1980.   Having  considered\t the<br \/>\njudgment of  this Court\t in AMBIKA QUARRY WORKS Vs. STATE OF<br \/>\nGUJARAT (1987)\t1 SCC  213 and\ttaking into account the fact<br \/>\nthat respondent\t no. 6\thad completed  the mining  operation<br \/>\nover 42\t acres the  High Court permitted the said respondent<br \/>\nno. 6  to remove the dug up mineral in the presence of joint<br \/>\nCollector of  the District,  Assistant Director of Mines and<br \/>\nGeology\t and  the  District  of\t Surveyor  of  the  Forests.<br \/>\nRespondent No.6,  the present  appellant was prohibited from<br \/>\nmining operation  in the  area with the aforesaid conclusion<br \/>\nand thus the appeal by special leave.\n<\/p>\n<p id=\"p_6\">     Learned counsel for the appellant argued with vehemence<br \/>\nthat the conclusion of the High Court that the word &#8216;Person&#8221;<br \/>\nin Regulation  3 (1)  (a) includes  the State Government and<br \/>\nthe transfer of any land within the scheduled area in favour<br \/>\nof a  non-tribal is null and void is wholly erroneous as the<br \/>\nembargo in  question is applicable in respect of transfer of<br \/>\nland belonging\tto the scheduled Castes and scheduled Tribes<br \/>\nand not\t to land  belonging to\tthe  State  Government.\t The<br \/>\nlearned\t counsel   also\t urged\tthat  the  restrictions\t and<br \/>\nprohibitions  in   the\t<a href=\"\/doc\/755257\/\" id=\"a_8\">Conservation   Act<\/a>  will   have\t  no<br \/>\napplication to\tan existing lease and the lease in favour of<br \/>\nthe appellant  having been  granted much prior to the coming<br \/>\ninto force of the <a href=\"\/doc\/755257\/\" id=\"a_9\">Conservation Act<\/a>, the High Court committed<br \/>\nerror in  holding that\tthe leases  are in  violation of the<br \/>\n<a href=\"\/doc\/755257\/\" id=\"a_10\">Conservation Act<\/a>.  Both these questions have been considered<br \/>\nin detail  by us in Civil Appeal Nos. arising out of S.L.P @<br \/>\nNos.17080-81 of\t 1995 and  for the reasons given therein and<br \/>\nin view of the conclusions in the said appeals to the effect<br \/>\nthat the word `person&#8217; used in <a href=\"\/doc\/1137825\/\" id=\"a_11\">Section 3(1)(a)<\/a> of regulation<br \/>\ndoes not  include the  State Government,  and therefore, the<br \/>\nprohibitions contained in the said Regulation with regard to<br \/>\ntransfer of land in favour of a non-tribal will not apply to<br \/>\nthe transfer  of land made by the Government for the purpose<br \/>\nof mining  lease, the  conclusion of  the High Court on this<br \/>\nscore  is   erroneous.\tBut   so  far  as  the\tquestion  of<br \/>\napplicability of  the conservation Act is concerned, in view<br \/>\nof our\tconclusion on  the  said  question  in\tthe  appeals<br \/>\narising out  of SLPs  referred to earlier (Samatha Vs. State<br \/>\nof A.P.\t &amp; Ors.) the conclusion of the Court in the impugned<br \/>\njudgment has  to be sustained. In view of the inquiry report<br \/>\nand the\t stand taken  by the  state Officials  the land over<br \/>\nwhich  the  appellant  was  permitted  to  carry  on  mining<br \/>\nactivities is  a forest\t land and  before grant\t of lease in<br \/>\nfavour\tof   the  appellant   no  approval  of\tthe  Central<br \/>\nGovernment  has\t been  taken.  It  is  no  doubt  true\tthat<br \/>\n<a href=\"\/doc\/755257\/\" id=\"a_12\">Conservation Act<\/a>  came into  force much later than the grant<br \/>\nof mining  lease in  favour of the appellant, but in view of<br \/>\nthe  general   directions  issued  by  this  court  in\tT.N.<br \/>\nGODAVARMAN THIRUMULKPAD\t Vs. UNION  OF INDIA  &amp; ORS. in Writ<br \/>\nPetition No. 202 of 1995, the mining activities being a user<br \/>\nof the\tforest land for non-forest purpose has to be stopped<br \/>\nand in case it is intended to continue the mining activities<br \/>\nthe same  can be done only after referring the matter to the<br \/>\nappropriate authority  of the Central Government and getting<br \/>\nthe permission\tof the\tsame. In this View of the matter the<br \/>\nconclusion of the high Court in the impugned judgment so far<br \/>\nas  violation\tof  conservation   Act\t is   concerned\t  is<br \/>\nunexceptionable,  and  therefore,  the\tsaid  conclusion  is<br \/>\nupheld. Necessarily, therefore, the ultimate direction given<br \/>\nby  the\t  High\tCourt\tremains\t unaffected  notwithstanding<br \/>\nconclusion of  the High\t Court on  the first  question\twith<br \/>\nregard\tto  the\t applicability\tof  the\t provisions  of\t the<br \/>\nregulation having  been reversed  by us.
