4\/   11\/7\/2008.                  Heard learned counsel for the petitioner and learned<\/p>\n
                  counsel for the State and for the interveners.\n<\/p>\n
                                 In so far as the intervener is concerned, any grievance<\/p>\n
                  with regard to the termination of the services of the intervener has to<\/p>\n
                  be the subject matter of a separate writ application and cannot be<\/p>\n
                  considered presently.\n<\/p>\n
                                 These three matters relate to the appointment on the<\/p>\n
                  post of Block Teacher. The petitioners were not selected. On a<\/p>\n
                  representation by them, the statutory authority, the Deputy<\/p>\n
                  Development Commissioner, Katihar, under Rule-19 of the Bihar<\/p>\n
                  Panchayat Primary Teachers (Appointment and Service Conditions)<\/p>\n
                  Rules, 2006 has passed orders which are presently the subject matter<\/p>\n
                  for consideration.\n<\/p>\n
                                 In so far as the petitioner in C.W.J.C. No.6075\/08 is<\/p>\n
                  concerned, the order of the statutory authority states that she had been<\/p>\n
                  appointed as a Panchayat Teacher in the Naya Tola, Bara<\/p>\n
                  Raghunathpur and that she had not participated for counseling for<\/p>\n
                  appointment on the post of Block Teahcer which is the cause of action<\/p>\n
                  in the present writ application. In the writ application this factual
\n                       -2-<\/span><\/p>\n
aspect   has   not   been   controverted.   There   is   no   merit   in<\/p>\n
C.W.J.C.No.6075\/08 which is accordingly rejected.<\/p>\n
               The order of the statutory authority with regard to the<\/p>\n
petitioner in C.W.J.C. No.5927\/08 states that public notice was<\/p>\n
published for counseling. The statutory authority then arrived at its<\/p>\n
conclusion that there was no occasion for the petitioner not to<\/p>\n
participate in the counseling.\n<\/p>\n
               There appears no logic to conclude that there was no<\/p>\n
reason why the petitioner would not have participated in the<\/p>\n
counseling to presume his not having been informed of the date when<\/p>\n
the petitioner has vaguely asserted that he was prevented from<\/p>\n
attending the counseling. His representation in that regard, annexure-<\/p>\n
1, has been perused by the Court which is vague and leaves the court<\/p>\n
thoroughly dissatisfied on the controversy whether the petitioner had<\/p>\n
participated in the counseling or not and therefore no relief can be<\/p>\n
granted to the petitioner in C.W.J.C. No.5927\/08. It is accordingly<\/p>\n
dismissed.\n<\/p>\n
               In C.W.J.C. No.5921\/08 the order of the statutory<\/p>\n
authority states that the petitioner participated in the counseling when<\/p>\n
it was found that she had higher marks than the person appointed and,<\/p>\n
thus, the order of termination of the illegal appointee, but denying<\/p>\n
appointment to the petitioner in view of a fresh Government ban on<\/p>\n
appointments under the second phase.\n<\/p>\n
               A counter affidavit has been filed today affirmed by the<\/p>\n
Deputy Superintendent of Education, Katihar. Paragraph-7 of the
\n                       -3-<\/span><\/p>\n
same emphatically states that the petitioner did not participate in the<\/p>\n
counseling which has been reiterated in paragraph-8. The statement<\/p>\n
made in the counter affidavit is in direct conflict with the finding<\/p>\n
recorded in the order of the statutory authority. Quite obviously, either<\/p>\n
the recital in the impugned order is incorrect or that on oath in the<\/p>\n
counter affidavit is incorrect. Either ways, it is a very serious matter<\/p>\n
going beyond a simple issue of administration.<\/p>\n
                 This Court requires the Secretary-Commissioner,<\/p>\n
Human Resources Development Department, Government of Bihar, to<\/p>\n
examine the matter himself after calling for the original records. This<\/p>\n
Court   next     directs the Secretary-cum-Commissioner         to    take<\/p>\n
appropriate departmental action as also prosecution under the criminal<\/p>\n
law with regard to the falsity of statements by either one of them.<\/p>\n
                 Let the same be done by the Secretary-cum-\n<\/p>\n
Commissioner within a maximum period of eight weeks from the date<\/p>\n
of receipt\/production of a copy of this order before him and<\/p>\n
consequential action against the concerned delinquent be initiated<\/p>\n
within four weeks thereafter.\n<\/p>\n
                 Let an affidavit of compliance be filed by the<\/p>\n
Secretary-cum-Commissioner after 12 weeks when the matter shall be<\/p>\n
listed for perusal by the Court.\n<\/p>\n
                 In view of the finding of illegalities in the<\/p>\n
appointments, by the statutory authority, quite naturally consequential<\/p>\n
action to give effect to the same has to be taken forthwith, if not<\/p>\n
already taken.\n<\/p>\n

                    Before parting with the matter, this Court considers it<\/p>\n
     appropriate to observe that in the event that the Secretary-cum-<\/p>\n
     Commissioner arrives at a finding of the petitioner in C.W.J.C.<\/p>\n
     No.5921 of 2008 having participated in the counseling, then, in view<\/p>\n
     of the finding that she was wrongly denied appointment, the petitioner<\/p>\n
     shall be entitled to be considered for appointment on the post to which<\/p>\n
     she was entitled at the original date when the same was denied to her<\/p>\n
     and any subsequent decision of the Government cannot come in the<\/p>\n
     way in view of the available vacancy because of the removal of the<\/p>\n
     person wrongly appointed.\n<\/p>\n
                    C.W.J.C. No.5921\/08 stands disposed.\n<\/p>\n
