Justice R.BASANT\n\n Dated :13\/04\/2007\n\n O R D E R\n                                R.BASANT, J.\n\n                             ----------------------\n\n                           Crl.M.C.No.1201 of 2007\n\n                         ----------------------------------------\n\n                  Dated this the 13th day of April  2007\n\n\n                                    O R D E R\n<\/pre>\n<p id=\"p_1\">       The petitioner  is the owner of a vehicle which is allegedly<\/p>\n<p>involved   in   the   offence   of   illicit   transportation   of   sand.     The<\/p>\n<p>vehicle   was   seized.     The   learned   Magistrate,   by   the   impugned<\/p>\n<p>order,   directed   interim   release   of   the   vehicle   to   the   petitioner<\/p>\n<p>subject   to   conditions.     The   petitioner   is   aggrieved   by   only   one<\/p>\n<p>condition.     That  is  the   direction   to produce   bank  guarantee   for<\/p>\n<p>an   amount   of   Rs.3,50,000\/-       The   learned   counsel   for   the<\/p>\n<p>petitioner   submits   that   the   imposition   of   the   said   condition   is<\/p>\n<p>working out great prejudice, hardship and loss to the petitioner.<\/p>\n<p>The   petitioner   has   not   been   able   to   avail   of   the   benefit   of   the<\/p>\n<p>order   of   release.     The   vehicle   is   exposed   to   sun   and   rain.<\/p>\n<p>Appropriate   modification   of   the   condition   may   be   directed.<\/p>\n<p>Subject   to   any   reasonable   conditions   within   the   reach   of   the<\/p>\n<p>petitioner,   the   vehicle   may   be   directed   to   be   released   to   the<\/p>\n<p>petitioner, it is prayed.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     Notice   was   given   to   the   learned   Public   Prosecutor.<\/p>\n<p>The   learned   Public   Prosecutor   points   out   that   the   learned<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.1201\/07                      2<\/span><\/p>\n<p>Magistrate   has   referred  to   the   circumstances   &#8211;   that   the  vehicle<\/p>\n<p>was   earlier   involved   in   an   identical   offence.              In   these<\/p>\n<p>circumstances,   appropriate   safeguards   may   be   made,   submits<\/p>\n<p>the learned Public Prosecutor.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       3.    I   am   satisfied   that   in   the   facts   and   circumstances   of<\/p>\n<p>this   case,   there   can   be   a   direction   to   modify   condition   No.1<\/p>\n<p>imposed   on   the   petitioner   that   he   must   produce   a   bank<\/p>\n<p>guarantee to the tune of Rs.3,50,000\/-.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">       4.    This   Criminal   Miscellaneous   Case   is,   in   these<\/p>\n<p>circumstances,   allowed.     The   said   condition   is   modified.     The<\/p>\n<p>petitioner shall execute a bond for Rs.3,50,000\/- with two solvent<\/p>\n<p>sureties  each  for  the  like  sum to the satisfaction  of the learned<\/p>\n<p>Magistrate.
