On the basis of the registration of these cases, the<br \/>\ndetaining authority after recording the subjective satisfaction, has<br \/>\ncome to the conclusion that the  present detenue&#8217;s aforesaid<br \/>\nactivities are prejudicial to maintenance of &#8216;public order&#8217; and<br \/>\nultimately passed the impugned order of detention against him<br \/>\nbranding him as a ?SDangerous Person??.\n<\/p>\n<p id=\"p_3\">4.\tExcept<br \/>\nfew statements of anonymous witnesses, there is no material on record<br \/>\nwhich shows that the petitioner-detenue is carrying on illegal<br \/>\nactivities of theft of iron bar pieces which is harmful to the health<br \/>\nof the public.  In the case of  <a href=\"\/doc\/687998\/\" id=\"a_2\">Ashokbhai Jivraj @ Jivabhai Solanki<br \/>\nv. Police Commissioner, Surat<\/a> [(2001 (1) GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of  <a href=\"\/doc\/1733535\/\" id=\"a_3\">Ram<br \/>\nManohar Lohia v. State of Bihar<\/a> (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention orders are passed on the<br \/>\nbasis of the statements of such witnesses fall under the maintenance<br \/>\nof &#8216;Law and Order&#8217; and not &#8216;Public Order&#8217;.\n<\/p>\n<p id=\"p_4\">5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention of a detenue, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;Public Order&#8217; and it<br \/>\nis very clear that the present case would not fall within the<br \/>\ncategory of threat to &#8216;public order&#8217;. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds, for passing the said<br \/>\norder, cannot be sustained and, therefore, it deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p id=\"p_5\">6.\tIn<br \/>\nthe result, this Special Civil Application is allowed. The impugned<br \/>\norder of detention dated 14.3.2008 passed by the detaining authority<br \/>\nis hereby quashed and set aside. The detenue is ordered to be set at<br \/>\nliberty forthwith, if not required in any other case. Rule is made<br \/>\nabsolute accordingly.
