Puri, J.\n<\/pre>\n<p id=\"p_1\">            This is a revision petition against judgment dated 23.4.2009<\/p>\n<p>    passed by Sh. Dinesh Kumar Mittal, Additional Sessions Judge,<\/p>\n<p>    Yamuna Nagar, vide which the appeal of the revisionist has been<\/p>\n<p>    partly accepted and the revisionist has been acquitted under <a href=\"\/doc\/1540253\/\" id=\"a_1\">Section<\/p>\n<p>    326<\/a> IPC, but convicted under <a href=\"\/doc\/1133601\/\" id=\"a_1\">Section 325<\/a> IPC and his conviction<\/p>\n<p>    under <a href=\"\/doc\/1011035\/\" id=\"a_2\">Section 323<\/a> IPC recorded by Ms. Kumud Gugnani, Judicial<\/p>\n<p>    Magistrate Ist Class, Yamuna Nagar, vide judgment dated 3\/4.8.2007,<\/p>\n<p>    was upheld.\n<\/p>\n<p id=\"p_1\">            The case of the prosecution is that on 15.11.1999, Rajbir s\/o<\/p>\n<p>    Naroti Ram      made a statement to the police that he alongwith<\/p>\n<p>    Dharampal and Satpal, shared 7 acres of agricultural land, out of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">             Crl.R. No. 1090 of 2009               -2-<\/span><\/p>\n<p>which 3-1\/2 acres is in cultivating possession of Dharampal and<\/p>\n<p>Satpal and the remaining 3-1\/2 acres of land is in his cultivating<\/p>\n<p>possession. The land is still joint. The suit for partition is pending<\/p>\n<p>before Niab Tehsildar and was fixed for 25.11.1999. 1 acre of land<\/p>\n<p>has been given on lease by Dharampal and Satpal to one Ram Kumar<\/p>\n<p>s\/o Soran Lal. Both the complainant and his cousin brothers have a<\/p>\n<p>common passage to approach their fields measuring 2 gathas, from<\/p>\n<p>the time of their forefathers.   The lessee Ram Kumar, on being<\/p>\n<p>instigated by his brother Dharampal drove tractor from the common<\/p>\n<p>passage. The complainant tried to stop him, on which Dharampal<\/p>\n<p>caught hold of him and Ram Kumar hit him with the stick on his right<\/p>\n<p>eye. He fell down and thereafter, Ram Kumar hit him with the sticks<\/p>\n<p>on his neck, cheeks and other body parts. Raj Kumar and Shiv Dayal,<\/p>\n<p>who were working in the near by fields have witnessed the<\/p>\n<p>occurrence. They tried to rescue him but the accused fled away from<\/p>\n<p>the scene of occurrence.\n<\/p>\n<p id=\"p_2\">        Charge under <a href=\"\/doc\/1011035\/\" id=\"a_3\">Section 323<\/a>, <a href=\"\/doc\/1540253\/\" id=\"a_4\">326<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_5\">Section 34<\/a> IPC<\/p>\n<p>was framed against both the accused, Ram Kumar and Dharampal.<\/p>\n<p id=\"p_3\">        The prosecution, in order to bring home the guilt of the<\/p>\n<p>accused, examined PW-1 Rajbir &#8211; complainant, PW-2 ASI Arvind<\/p>\n<p>Kumar, PW-3 SHO Dharamvir Singh, PW-4 Doctor Hukam Chand,<\/p>\n<p>PW-5 Doctor Dinesh Goyal and PW-6 Doctor Sushmita Kaushik and<\/p>\n<p>closed the evidence.\n<\/p>\n<p id=\"p_4\">        The accused were examined under <a href=\"\/doc\/767287\/\" id=\"a_6\">Section 313<\/a> Cr.P.C. and<\/p>\n<p>they denied the allegations.\n<\/p>\n<p id=\"p_5\">        The learned Judicial Magistrate Ist Class (trial Court),<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                Crl.R. No. 1090 of 2009               -3-<\/span><\/p>\n<p>acquitted Dharampal accused, but convicted Ram Kumar under<\/p>\n<p><a href=\"\/doc\/1011035\/\" id=\"a_7\">Sections 323<\/a> and <a href=\"\/doc\/1540253\/\" id=\"a_8\">326<\/a> IPC. Ram Kumar was ordered to undergo<\/p>\n<p>rigorous imprisonment for a period of 6 months under <a href=\"\/doc\/1011035\/\" id=\"a_9\">Section 323<\/a><\/p>\n<p>IPC and to undergo rigorous imprisonment for a period of 3 years<\/p>\n<p>under <a href=\"\/doc\/1540253\/\" id=\"a_10\">Section 326<\/a> IPC and a fine of Rs.5,000\/-.<\/p>\n<p id=\"p_6\">            Ram Kumar preferred an appeal against the judgment dated<\/p>\n<p>3\/4.8.2007 passed by Ms. Kumud Gugnani, Judicial Magistrate Ist<\/p>\n<p>Class, Yamuna Nagar. The Ist Appellate Court, however, acquitted<\/p>\n<p>the accused under <a href=\"\/doc\/1540253\/\" id=\"a_11\">Section 326<\/a> IPC, but convicted him under <a href=\"\/doc\/1133601\/\" id=\"a_12\">Section<\/p>\n<p>325<\/a> IPC and sentenced him to undergo rigorous imprisonment for a<\/p>\n<p>period of 6 months. The sentence under <a href=\"\/doc\/1011035\/\" id=\"a_13\">Section 323<\/a> IPC was<\/p>\n<p>maintained. Both the sentences were ordered to run concurrently.<\/p>\n<p id=\"p_7\">            Feeling dissatisfied, with the abovesaid judgments    dated<\/p>\n<p>3\/4.8.2007 passed by Judicial Magistrate Ist Class, Yamuna Nagar<\/p>\n<p>and judgment dated 23.4.2009 passed by Additional Sessions Judge,<\/p>\n<p>Yamuna Nagar, the petitioner has preferred the present revision<\/p>\n<p>petition.\n<\/p>\n<p id=\"p_8\">            Counsel for the petitioner has not challenged the conviction<\/p>\n<p>recorded by the Ist Appellate Court, but has submitted that out of the<\/p>\n<p>substantive sentence of 6 months, the petitioner has already<\/p>\n<p>undergone incarnation for a period of 5 months and prayer has been<\/p>\n<p>made for reduction of sentence to the period already undergone.<\/p>\n<p id=\"p_9\">            The prayer has been opposed by the State counsel.<\/p>\n<p>            I have considered the submissions made by both the sides<\/p>\n<p>and have also gone through the record of the case.<\/p>\n<p id=\"p_10\">            So, far as conviction recorded by both the Courts below is<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                Crl.R. No. 1090 of 2009            -4-<\/span><\/p>\n<p>concerned, there is a concurrent finding. That finding is based upon<\/p>\n<p>ocular, as well as, medical evidence, which corroborates each other.<\/p>\n<p>So, the conviction under <a href=\"\/doc\/1011035\/\" id=\"a_14\">Section 323<\/a> IPC recorded by the trial Court<\/p>\n<p>and affirmed by the Ist Appellate Court and conviction under <a href=\"\/doc\/1133601\/\" id=\"a_15\">Section<\/p>\n<p>325<\/a> IPC recorded by the Ist Appellate Court, stands affirmed.<\/p>\n<p id=\"p_11\">         Now, reverting to the quantum of sentence, the petitioner has<\/p>\n<p>been ordered to undergo rigorous imprisonment for a period of 6<\/p>\n<p>months. He has already undergone imprisonment for a period of 5<\/p>\n<p>months. The occurrence relates to the year 1999. So, the sentence<\/p>\n<p>stands reduced to the period already undergone. But the petitioner is<\/p>\n<p>directed to make the payment of Rs.10,000\/- as compensation to the<\/p>\n<p>complainant-Rajbir. That amount is ordered to be deposited before<\/p>\n<p>the trial Court before his release. On realisation of that amount, the<\/p>\n<p>said amount of Rs.10,000\/- shall be paid to the complainant under<\/p>\n<p>proper receipt and identification.\n<\/p>\n<p id=\"p_12\">         With the abovesaid observations, the petition stands<\/p>\n<p>disposed of.\n<\/p>\n<p id=\"p_13\">                                         ( K.C.
