By the said order,<br \/>\nthe petitioner is directed to pay Rs.3,500\/- per month to his<br \/>\ndaughter and Rs.2,500\/- per month to his minor son by way of<br \/>\nmaintenance.\n<\/p>\n<p id=\"p_1\">\tThe<br \/>\nmaintenance application was filed by the wife of the petitioner for<br \/>\nherself and for two children. Learned Judge of the Family Court found<br \/>\nthat the wife is earning sufficient income. Her prayer was rejected.<br \/>\nFor the children, however, above mentioned order was passed.\n<\/p>\n<p id=\"p_2\">\tHaving<br \/>\nheard learned counsel for the parties and having perused the material<br \/>\non record, I find that admittedly, the petitioner is not unemployed<br \/>\nand has other income by running Maruti Van to pick and drop the<br \/>\nchildren from home to school. It was also not in dispute that the<br \/>\nwife is engaged as a Teacher and is drawing regular pay scale. She is<br \/>\ntherefore earning sufficiently to support herself. It is also not in<br \/>\ndispute that by now, the daughter of the petitioner has crossed 18<br \/>\nyears of age. Admittedly, she was below 18 years of age on the date<br \/>\nof application, which was 19.04.2008. She attained the majority about<br \/>\nan year later. Learned counsel is therefore justified in pointing out<br \/>\nthat after attaining the age of 18 years, she is not entitled to<br \/>\nmaintenance under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> of the Code<br \/>\nof Criminal Procedure. In so far as the minor son is<br \/>\nconcerned, he is undisputably entitled to maintenance.\n<\/p>\n<p id=\"p_3\">\tConsidering<br \/>\nthe above aspects of the matter, taking into totality of the facts<br \/>\nand circumstances, the order of the Family Court is modified in<br \/>\nfollowing terms :-\n<\/p>\n<p id=\"p_4\">(1)\tThe<br \/>\ndaughter of the petitioner shall receive maintainable at the rate of<br \/>\nRs.2,500\/- per month from the date of application only till she<br \/>\ncrossed 18 years of age. For the same period, the son of the<br \/>\npetitioner shall also receive maintenance at the rate of Rs.2,500\/-;\n<\/p>\n<p id=\"p_5\">(2)\tAfter<br \/>\nthe said date i.e. the date from which the petitioner shall not pay<br \/>\nmaintainable to his daughter, his son shall receive maintainable at<br \/>\nthe rate of Rs.3,000\/- per month.\n<\/p>\n<p id=\"p_6\">(3)\tArrears<br \/>\nas per this order shall be cleared latest by 31st March,<br \/>\n2010 and on that condition, there shall be no cursive recovery.\n<\/p>\n<p id=\"p_7\">\tIn<br \/>\nthe result, the petition is disposed of accordingly.\n<\/p>\n<p id=\"p_8\">(AKIL<br \/>\nKURESHI,J.)<\/p>\n<p>\/patil<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Nitinbhai vs Alkaben on 17 February, 2010 Author: Akil Kureshi,&amp;Nbsp;
