      The counter petitioner in M.C. 96\/2004 on the file<\/p>\n
of the Sub Divisional Magistrate’s court, Palakkad is the<\/p>\n
petitioner herein. In this petition filed under        Section<\/p>\n
482<\/a> of Cr.P.C. he seeks an order quashing Annexure A7<\/p>\n
proceedings in M.C.96\/2004 pending before the above<\/p>\n
court.\n<\/p>\n
      2. Petitioner is the Headmaster of S.N.U.P School,<\/p>\n
Nallamadanchalla in Palakkad District. According to the<\/p>\n
petitioner, the Manager who is the 3rd respondent in this<\/p>\n
Crl.M.C.    and the petitioner are not in good terms.<\/p>\n
Counsel for the petitioner submitted that he was forced<\/p>\n
to initiate several proceedings against the Manager, the<\/p>\n
3rd respondent, due to his nefarious activities. It is the<\/p>\n
case of the petitioner that the petitioner         was placed<\/p>\n
under suspension by the 3rd respondent and at the<\/p>\n
interference of the departmental         authorities, he was<\/p>\n

ordered to reinstate in service, but the 3rd respondent<\/p>\n
did not     comply with the direction.        Finally,    the<\/p>\n
departmental authorities took steps against          the 3rd<\/p>\n
respondent and he had approached this Court against the<\/p>\n
proceedings of the departmental authorities. It is the<\/p>\n
case of the petitioner that     since   the 3rd respondent<\/p>\n
continued his attack against the petitioner, he          was<\/p>\n
constrained to approach this Court by filing petition for<\/p>\n
police protection. It is also the case of the petitioner that<\/p>\n
since  the police     has registered case against    the 3rd<\/p>\n
respondent at the instance of the petitioner, the 3rd<\/p>\n
respondent was very much infuriated and hence, at the<\/p>\n
instance of the 3rd respondent, certain criminal cases<\/p>\n
have been registered against the petitioner and on the<\/p>\n
basis of the above criminal case registered by the police,<\/p>\n
the Ist respondent by invoking Section 111<\/a> of Cr.P.C.<\/p>\n
issued show cause notice against the petitioner as to why<\/p>\n
an order under section 107<\/a> shall not be issued against<\/p>\n
the petitioner. Annexure A7(1) is the notice dated 4-12-<\/p>\n

2004 issued under section 113<\/a> of Cr.P.C.    Annexure A7<\/p>\n
(2) is the order passed by the Ist respondent under<\/p>\n
section 111<\/a> of Cr.P.C. by which the petitioner was asked<\/p>\n
to execute a bond under section 107<\/a> of Cr.P.C. for a<\/p>\n
period of one year so as to prevent him from involving<\/p>\n
in law and order problem. It is the above order sought to<\/p>\n
be quashed in this proceedings.\n<\/p>\n
      3. I have heard the counsel for the petitioner as<\/p>\n
well as the learned Public Prosecutor.<\/p>\n
      4. The learned Public Prosecutor submitted     that<\/p>\n
after the issuance of Annexure A7(2) order, no law and<\/p>\n
order situation has been created at the instance of the<\/p>\n
petitioner and      he had not involved in any crime<\/p>\n
subsequently.\n<\/p>\n
      In  view of Section 111<\/a> of Cr.P.C., it is for the<\/p>\n
authority to issue orders under sections 107<\/a>, 108<\/a>, 109<\/a> or<\/p>\n
110 to fix the terms of the bond to be      in force. As<\/p>\n
evidenced by Annexure A7(2) order, the period is fixed<\/p>\n
as one year as per Section 111<\/a> of Cr.P.C. That one year<\/p>\n

\n                                -:4:-<\/span><\/p>\n
period is already expired by 22nd November, 2005. Now<\/p>\n
we are in 2008. Nothing brought to my notice by the<\/p>\n
Public Prosecutor to show whether the period fixed by<\/p>\n
Annexure A7(2) is extended further or not.         In the<\/p>\n
absence of any order extending the period already fixed<\/p>\n
as per Annexure A7(2), this Crl.M.C. has become<\/p>\n
infructuous as the period fixed under section 111<\/a> of<\/p>\n
Cr.P.C. is over by 22nd November, 2005.    In the absence<\/p>\n
of any order extending the period fixed by Annexure A7<\/p>\n
(2), virtually this Crl.M.C. has become infructuous as the<\/p>\n
petitioner has no cause of action.\n<\/p>\n
      In the result, the above Crl.M.C. is dismissed as<\/p>\n
infructuous.\n<\/p>\n
