Tripathi, J) on 14th November 2003, this<br \/>\n\tCourt passed the following order :\n<\/p>\n<p id=\"p_2\"> Mr.J.S.\n<\/p>\n<p id=\"p_3\">Brahmbhatt, learned advocate appearing on caveat on behalf of<br \/>\nrespondent is not present when the matter is called out in the first<br \/>\nhalf. Hence, the matter was kept in the second half also. Mr.J.S.<br \/>\nBrahmbhatt is not present.\n<\/p>\n<p id=\"p_4\"> \tRule.\n<\/p>\n<p id=\"p_5\">Ad-interim relief in terms of para 8(C).\n<\/p>\n<p id=\"p_6\">It<br \/>\n\tis pertinent to note that by way of aforesaid order, the petitioner<br \/>\n\thas been enjoying the ad-interim relief in terms of paragraph 8(C)<br \/>\n\tof the petition. Further, it is required to be noted that as per the<br \/>\n\tstatement made by the learned advocate for the petitioner, the<br \/>\n\tpetitioner has already attained the age of superannuation on 30th<br \/>\n\tMay 2006 and he has retired.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tview of aforesaid facts and circumstances of the case, I am of the<br \/>\n\topinion that as the interlocutory order passed by this Court earlier<br \/>\n\thas not been disturbed till date, the parties are required to abide<br \/>\n\tby the said interlocutory order. Further, it is required to be noted<br \/>\n\tthat no person who has superannuated from service is entitled to any<br \/>\n\tbenefit under <a href=\"\/doc\/770112\/\" id=\"a_1\">Section 17-B<\/a> of the Industrial Disputes Act, 1947.\n<\/p>\n<p id=\"p_8\">For<br \/>\n\tthe foregoing reasons, the present petition is hereby partly<br \/>\n\tallowed. The parties are directed to abide by the aforesaid<br \/>\n\tinterlocutory order. Rule is made absolute accordingly.
