ADVOCATE with MR AS ASTHAVADI\nfor\nPetitioner(s) : 1 - 2. \nNone for Respondent(s) : 1 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\tThe petitioners have<br \/>\nprayed for a direction to the respondents to restore the position of<br \/>\nthe graveyard, as it was  before the construction of public road<br \/>\nthrough such graveyard. In short, the petitioners are opposing<br \/>\nconstruction and maintenance of a public road by Bhavnagar<br \/>\nMunicipality through the said graveyard.\n<\/p>\n<p id=\"p_1\">2.\t\tThe petitioners<br \/>\nclaim to be belonging to the Memon Community, who has been using the<br \/>\nsaid land as graveyard, since years. It is the case of the<br \/>\npetitioners that, though, the State Government had passed an order<br \/>\nholding and declaring that such land shall be used, only as a<br \/>\ngraveyard land, Bhavnagar Municipal Corporation has constructed a<br \/>\nroad through such graveyard, wholly illegally.  It is, further, the<br \/>\ncase of the petitioners that the procedure under the Town Planning<br \/>\nAct was not followed, before constructing such road.\n<\/p>\n<p id=\"p_2\">3.\t\tThis Court in<br \/>\nSp.C.A. No.12594 of 2002 had granted stay against vacation of the<br \/>\nsaid petitioners, who are claiming to be occupying shops and other<br \/>\npremises.  However, in Civil Application No.10735 of 2008, filed by<br \/>\nthe State Government, the learned Single Judge on 23.10.2008, passed<br \/>\nan order and permitted Bhavnagar Municipal Corporation to complete<br \/>\nthe construction of the road, passing through the said area. It also<br \/>\nemerges that the Sunni Muslim Samaj, Bhavnagar, who is administering<br \/>\nthe said kabrastan land had filed a Civil Application No.1606 of<br \/>\n2003, seeking permission to be joined as a respondent in the said<br \/>\npetition, which application came to be allowed by the learned Single<br \/>\nJudge of this Court, by an order dated 30.04.2003.\n<\/p>\n<p id=\"p_3\">4.\t\tIt may also be noted<br \/>\nthat the Public Interest Litigation bearing Special Civil Application<br \/>\nNo. 13799 of 2008 was also filed objecting to the construction of the<br \/>\nroad through Kabrastan, which petition came to be disposed of by this<br \/>\nCourt, by an order dated 30.12.2008, in the following manner:\n<\/p>\n<p id=\"p_4\">&#8220;1.\tThis<br \/>\nPIL is filed seeking direction to respondent Nos.2 and 3 restraining<br \/>\nthem from further construction\/development in Survey No.3A, City<br \/>\nSurvey Nos.7617 to 7622 and 7360 at Bhavnagar and other consequential<br \/>\nreliefs.\n<\/p>\n<p id=\"p_5\">2.\tThe<br \/>\ncontention of the petitioners is that the road has been built by the<br \/>\nrespondent authorities  illegally which is against public interest.<br \/>\nAccording to the petitioners, the land in question was under the<br \/>\ncontrol of respondent No.6. Respondent No.6 has not raised any<br \/>\ngrievance against the action taken by the respondent authorities.<br \/>\nAccording to the petitioners, litigations are pending before  Civil<br \/>\nCourts as well as before Single Judge of this Court on the same<br \/>\nissue. Therefore, this Court does not want to interfere with this PIL<br \/>\nwhich has been filed by two individuals and dispose it of without<br \/>\nexpressing any opinion.&#8221;\n<\/p>\n<p id=\"p_6\">5.\t\tIt is also not in<br \/>\ndispute that the road has already been constructed and is existing<br \/>\nfor more than two years now. Under the circumstances, the situation<br \/>\nwhich emerges is that a Public Interest Litigation, opposing<br \/>\nconstruction of the road came to be disposed of by the Division Bench<br \/>\nof this Court, road is constructed in the year  2008. Sunni Muslim<br \/>\nSamaj, who claims to be  administering the kabrastan land, had<br \/>\nalready sought permission to be joined as party-respondent in a<br \/>\npetition. However, the said Samaj did not institute a petition on its<br \/>\nown, opposing construction of the road.\n<\/p>\n<p id=\"p_7\">6.\t\tThis petition is<br \/>\nreplica of the Public Interest Litigation which was not entertained<br \/>\nby the Division Bench of this Court. Therefore, entertaining this<br \/>\npetition would amount to reopening the issues by the Single Judge,<br \/>\nwhich were not entertained by the Division Bench of this Court.
