Extension,<br \/>\n                                           Patparganj, Delhi-110092.\n<\/p>\n<pre id=\"pre_2\">RTI application filed on            :      02\/07\/2008\nPIO replied                         :      23\/07\/2008\nFirst appeal filed on               :      08\/08\/2008\nFirst Appellate Authority order     :      26\/08\/2008\nSecond Appeal received on           :      14\/05\/2009\n\nInformation sought:\n<\/pre>\n<p id=\"p_2\">Verification of marks of subject- Biology theory, Code 044, Roll No. 6260342, All India Senior<br \/>\nSchool Certificate Exam-2008, Kendriya Vidyalaya Sadiq Nagar, Centre No. 2162, Birla Vidya<br \/>\nNiketan Pushp Vihar.\n<\/p>\n<p id=\"p_3\">    a) Marks awarded by each answer as transferred to title page from (i) main answer book and\n<\/p>\n<p id=\"p_4\">        (ii) supplementary answer books.\n<\/p>\n<p id=\"p_5\">    b) Number of answers still remained unevaluated.\n<\/p>\n<p id=\"p_6\">    c) Errors of transferring marks from answer book to the title page.\n<\/p>\n<p id=\"p_7\">    d) Remedial action contemplated, if required.<br \/>\nNote: The information sought does not reveal the criterion of evaluation or the extent of<br \/>\nanswering the question attempted by the student. Also, it does not amount to disclosure to or<br \/>\ninspection of the answer-book personally by the candidate\/student.\n<\/p>\n<p id=\"p_8\">Reply of PIO:\n<\/p>\n<p id=\"p_9\">&#8220;Appellant&#8217;s rechecking case in the subject Biology on the Roll No. 6260342 for the AISSC<br \/>\nExamination, 2008 has been checked thoroughly as per norms of the marking scheme of the<br \/>\nBoard and found that there is no mistake. A letter in this regard has already been sent to the<br \/>\nAppellant by the concerned Branch which might have been received by now.<br \/>\nAs regards information asked under Point A,B,C,D the answer-book have been checked and all<br \/>\nthe marks of main answer-book and supplementary answer-book has been transferred on title<br \/>\npage and no question is remain unevaluated.&#8221;\n<\/p>\n<p id=\"p_10\">Grounds for First Appeal:\n<\/p>\n<p id=\"p_11\">Provide the information on marks awarded to each answer as transferred to title page, with<br \/>\ntotal\/sub total of each of four sections if feasible.<br \/>\n Order of the First Appellate Authority:\n<\/p>\n<p id=\"p_12\">&#8220;The reply of APIO is correct, the information asked by the Appellant is exempted under section<br \/>\n8(1) (e). Since, it is not a case of one individual or personal as stated in Appellant&#8217;s letter.<br \/>\nCBSE take whole examination of all candidates.&#8221;\n<\/p>\n<p id=\"p_13\">Grounds for Second Appeal:\n<\/p>\n<p id=\"p_14\">The Appellate Authority has misquoted the judgment which seems to be in respect of prohibition<br \/>\nof disclosure of answer sheets of certain examinations conducted by CBSE as per rules of CBSE<br \/>\nitself.\n<\/p>\n<p id=\"p_15\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_16\">The following were present:\n<\/p>\n<p id=\"p_17\">Appellant: Mr.Rahul Katna<br \/>\nRespondent: Mr.K.K.Jain, APIO<br \/>\nThe issue revolves around actually giving details from the title page of the answer sheets to the<br \/>\ncandidate. A full bench decision of the Commission number CIC\/WB\/A\/2006\/00469; &amp; 00394<br \/>\nhas decided that copies of answer sheets may not be given by bodies like CBSE, Universities etc.<br \/>\non the basis that it is impractical. Asking for details from the title page of the answer sheet would<br \/>\nget covered by the same decision. Since the impugned decision lays a principle that it would be<br \/>\nunworkable these bodies to refer to each answer sheet.
