(J)\n\nCITATION<\/a>:\n 1981 AIR 1921\t\t  1982 SCR  (1) 551\n 1981 SCC  (4)\t 1\t  1981 SCALE  (3)1793\n\n\nACT:\n     Civil Procedure  Code, order XXII read with Article 121\nof the\tLimitation Art,\t 1963-Survival of right to sue-Legal\nrepresentatives of deceased respondent not brought on record\nby  appellant-State   within  prescribed  time\tlimit-Appeal\nabates.\n\n\n\nHEADNOTE:\n     Dismissing the appeal by special leave, the Court\n^\n     HELD: The\tabatement stands  in the  way of  the appeal\nbeing heard on merits. In the instant case, (a) on the death\nof the\tsole respondent\t to the\t appeal\t the  right  to\t sue\nsurvived to  his Legal\trepresentatives; (b)  no application\nhaving been  made within  90 days  of the  death. the appeal\nabated on  the 11th  of March,\t1979 and  an application for\nhaving the  abatement set  aside could have been made within\nthe period of 60 days following that date, under Article 121\nof the Limitation Act; and (c) the application actually made\nto set\taside the  abatement was  time barred  by more\tthan\nthree months  and a  half. The\tclerk of the learned counsel\nfor the\t appellant was served with a copy of the application\ndated 23rd February, 1979 on that date itself and no reason,\ngood, bad or indifferent is assigned for the failure of that\ncounsel right  from the\t 20th February,\t 1979  to  the\t29th\nAugust, 1979  either for having the legal representatives of\nthe deceased  brought  on  the\trecord\tor  for\t having\t the\nabatement set  aside after it had taken place. His knowledge\nof the\tdeath of  the respondent  must be  attributed to the\nappellant State\t also and  his negligence  in not moving the\nCourt in  time must  be deemed\tto be that of the appellant.\n[652 E-H, 653 A, B]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE JURISDICTION: Civil Appeal No. 353 of 1\n<\/p>\n<p>969.<br \/>\n     From the  judgment and decree dated the 19th\/20th July,<br \/>\n1965 of\t the High  Court of  Gujarat at\t Ahmedabad in  First<br \/>\nAppeal No. 584 of 1960.\n<\/p>\n<p>     M.N. phadke,  S. C.  Patel\t and  R.N.  Poddar  for\t the<br \/>\nappellant.\n<\/p>\n<p><span class=\"hidden_text\">552<\/span><\/p>\n<p>     D.V. Patel,  R.A. Shraff,\tGopal Subramaniam  and\tD.P.<br \/>\nMohanty for the respondent.\n<\/p>\n<p>     The order of the Court was delivered by<br \/>\n     KOSHAL, J.\t The sole  respondent in this appeal died on<br \/>\nthe 10th  December,  1978.  He\twas  also  arraigned  as  an<br \/>\nappellant in  the connected appeal (Civil Appeal No. 2132 of<br \/>\n1977) in  which an application was made on the 20th February<br \/>\n1979 stating  the factum  and the date of the demise. A copy<br \/>\nof that application was delivered on the date last mentioned<br \/>\nto the\tclerk of  learned counsel  for the  appellant State,<br \/>\nwho, however,  took no step to move the Court for having the<br \/>\nlegal representatives  of the deceased respondent brought on<br \/>\nthe record  in the present appeal till the 29th August, ]979<br \/>\nwhen an\t application was  made for that purpose, but without<br \/>\nbeing accompanied  by any  affidavit containing averments as<br \/>\nto why the inordinate delay in filing the application should<br \/>\nbe condoned.  An affidavit  of the  type just  mentioned was<br \/>\nfiled in Court on 4th March, 198().\n<\/p>\n<p>     It is  common ground  between the\tparties that  on the<br \/>\ndeath of  the sole respondent to the appeal the right to sue<br \/>\nsurvived to his legal representatives. No application having<br \/>\nbeen made  within 90 days of the death, the appeal abated on<br \/>\nthe 11th  March. 1979  and an  application  for\t having\t the<br \/>\nabatement set  aside could  have been made within the period<br \/>\nof  60\tdays  following\t that  date.  (Article\t121  of\t the<br \/>\nLimitation Act).  The  application  actually  made  in\tthat<br \/>\nbehalf was  thus time-barred  by more  than 3  months and  a<br \/>\nhalf. Mr. Phadke, learned counsel for the appellant does not<br \/>\ndispute this  proposition. He urges. however, that the delay<br \/>\nin making  the application last mentioned should be condoned<br \/>\nand the\t abatement of  the appeal  set aside.  No sufficient<br \/>\ncause, however, for the condonation of the delay is made out<br \/>\nfrom any material on the record. As pointed out earlier, the<br \/>\nclerk of  the learned  counsel for  the appellant was served<br \/>\nwith a\tcopy of the application dated 23rd February, 1979 on<br \/>\nthat date  itself and no reason, good, bad or indifferent is<br \/>\nassigned for the failure of that counsel right from the 20th<br \/>\nFebruary, 1979\tto the\t29th August,  1979 to move the Court<br \/>\ntill the  29th August,\t1979 either  for  having  the  legal<br \/>\nrepresentatives of the deceased brought on the record or for<br \/>\nhaving the abatement set aside after it had taken place. His<br \/>\nknowledge of  the death of the respondent must be attributed<br \/>\nto the appellant State<br \/>\n<span class=\"hidden_text\">553<\/span><br \/>\nalso and his negligence in not moving the Court in time must<br \/>\nbe deemed to be that of the appellant.\n<\/p>\n<p>     Mr. Phadke also contended that he had a strong case for<br \/>\nthe acceptance\tof the\tappeal on  merits and  that the same<br \/>\nshould be regarded as a very good reason for the condonation<br \/>\nof the\tdelay. The  contention is  wholly without substance.<br \/>\nThe abatement stands in the way of the appeal being heard on<br \/>\nmerits which cannot, therefore, be looked into.\n<\/p>\n<p>     No grounds for the condonation of the delay having been<br \/>\nmade out we refuse to set aside the abatement.
