(C) No. 7032 of 2002)<\/p>\n<p>[With CA No.6846\/2003 (Arising out of SLP (C) No. 7994\/2002, CA <\/p>\n<p>No.6848\/2003 (Arising out of SLP (C) No. 9699\/2002, CA No.6847\/2003 <\/p>\n<p>(Arising out of SLP (C) No. 20165\/2002, CA No.6845\/2003 (Arising out of <\/p>\n<p>SLP (C) No. 19708\/2002 <\/p>\n<p>ARIJIT PASAYAT,J.\n<\/p>\n<p id=\"p_1\">\n<p>\tLeave granted.\n<\/p>\n<p id=\"p_2\">\n<p>\tAs in all these appeals basic factual matrix is the same, except <\/p>\n<p>that the dates are different, and the points of law involved belong to <\/p>\n<p>the same spectrum; they are disposed of by this common judgment.<\/p>\n<p>\tThe factual background can be adumbrated concisely as follows:<\/p>\n<p>\tThe responded no.1 in each case filed a writ application before <\/p>\n<p>the Orissa High Court claiming that he was appointed as &#8220;fourth peon&#8221; <\/p>\n<p>by the management of the concerned institution, which is an &#8220;aided <\/p>\n<p>educational institution&#8221; as defined under the Orissa Education Act, <\/p>\n<p>1969 (in short the &#8216;Act&#8217;) and Orissa Education (Recruitment and <\/p>\n<p>Conditions of Service of Teachers and Members of the Staff of Aided <\/p>\n<p>Educational Institutions) Rules, 1974 (in short &#8216;Recruitment Rules&#8217;).  <\/p>\n<p>It is not in dispute that if an institution is an aided educational <\/p>\n<p>institution, same is governed by the Act and rules framed thereunder. <\/p>\n<p>The Recruitment Rules are framed under the Act. As the functionaries of <\/p>\n<p>the State did not approve the appointment holding the same to be beyond <\/p>\n<p>the prescribed yardstick, writ applications were filed for direction to <\/p>\n<p>the concerned authorities to accord approval to the appointment. <\/p>\n<p>\tThe High Court by the impugned judgments in separate writ <\/p>\n<p>applications came to hold that the functionaries of the State were not <\/p>\n<p>justified in refusing to accord approval. Stand of the State Government <\/p>\n<p>was that circular dated 8.7.1981 contained yardstick for fixation of <\/p>\n<p>standard staff for the Non-Government Secondary Schools in supersession <\/p>\n<p>of earlier circulars. Under the &#8220;category of staff&#8221; the number of peons <\/p>\n<p>which can be appointed was clearly spelt out. Only if the roll strength <\/p>\n<p>of the institution exceeded a particular number, one post of &#8220;Daftary&#8221; <\/p>\n<p>was admissible.  According to the State Government the post of <\/p>\n<p>&#8220;Daftary&#8221; is a promotional post and, therefore, the concept of a <\/p>\n<p>&#8220;fourth peon&#8221; as sought to be canvassed by the writ petitioners is <\/p>\n<p>without any legal foundation. The position was further clarified by <\/p>\n<p>Circular dated 27.3.1992. The High Court on consideration of the rival <\/p>\n<p>stands came to equate the &#8220;fourth peon&#8221; with &#8220;Daftary&#8221; and held the <\/p>\n<p>claim of the writ petitioners warranted acceptance.  <\/p>\n<p>\tIn support of the appeals learned counsel for the State of Orissa <\/p>\n<p>submitted that the High Court missed to consider several vital aspects.  <\/p>\n<p>Firstly, there is no prescription of a &#8220;fourth peon&#8221; in the yardstick <\/p>\n<p>prescribed.  The post of &#8220;Dafrty&#8221; is a promotional post and it carries <\/p>\n<p>higher scale of pay.  That being the position, the last entrant cannot <\/p>\n<p>claim the post of the &#8220;Daftary&#8221;.\n<\/p>\n<p id=\"p_3\">\n<p>\tPer contra, learned counsel for the concerned writ petitioners <\/p>\n<p>submitted that the High Court has considered the circulars and come to <\/p>\n<p>the right conclusion that the claim for appointment as the &#8220;fourth <\/p>\n<p>peon&#8221; is legally enforceable.\n<\/p>\n<p id=\"p_4\">\n<p>At this juncture it is to be noted that at different points of <\/p>\n<p>time yardsticks were formulated. Government of Orissa, Education &amp; Y.S. <\/p>\n<p>Department, issued Circular No. 28365-EYS dated 8.7.81 fixing standard <\/p>\n<p>staff for the non-government secondary schools. So far as peons are <\/p>\n<p>concerned, the relevant portions of the circular read as follows:<\/p>\n<p>&#8220;Category of staff\t\t3 class\t5class\t7 class<\/p>\n<p>&#8230;&#8230;&#8230;..\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">9.Peons (I) Office Peon\t1\t\t1\t\t1<\/p>\n<p id=\"p_7\">(ii) Office Attendant\t1\t\t1\t\t1<\/p>\n<p id=\"p_8\">(iii) Night watcher cum<\/p>\n<p>\tsweeper\t\t\t1\t\t1\t\t1<\/p>\n<p>Notes<\/p>\n<p>&#8230;&#8230;&#8230;&#8230;\n<\/p>\n<p id=\"p_9\">C)(ii)\tWhere the roll strength of the school exceeds 100 one <\/p>\n<p>post of Daftary is admissible.\n<\/p>\n<p id=\"p_10\">\n<p>&#8230;&#8230;.&#8221;\n<\/p>\n<p id=\"p_11\">\n<p>\tSubsequently by another circular No.155000-XVIIEP-50\/91-E, dated <\/p>\n<p>27th March, 1992 the position was further clarified as under:-<\/p>\n<p>&#8220;I am directed to say that the question of fixation of <\/p>\n<p>revised yardstick for appointment of class IV employees in Non-<\/p>\n<p>government Secondary Schools was under consideration of <\/p>\n<p>Government for some time past.  After careful consideration <\/p>\n<p>Government have been pleased to decide that the yardstick for <\/p>\n<p>class IV employees of Non-Government Secondary Schools shall be <\/p>\n<p>as follows:\n<\/p>\n<p id=\"p_12\">\n<p>Category of staff\t\t3 class\t5class\t7 class<\/p>\n<p id=\"p_13\">(i) Office Peon\t\t1\t\t1\t\t1<\/p>\n<p id=\"p_14\">(ii)Science Attendant\t1\t\t1\t\t1<\/p>\n<p id=\"p_15\">(iii)Night Watcher cum\t1\t\t1\t\t1<\/p>\n<p>\tSweeper<\/p>\n<p>Where the roll strength of 10 Class High School is 500 (five <\/p>\n<p>hundred) or more, one post of Daftary admissible.<\/p>\n<p>\tFor the schools running shift system for shortage of <\/p>\n<p>accommodation one additional post of peon is admissible.<\/p>\n<p>The yardstick will come into force with effect from the Ist <\/p>\n<p>January 1992 and Government order referred to above stands <\/p>\n<p>modified to the extent indicated above.&#8221;\n<\/p>\n<p id=\"p_16\">\n<p>\tA comparison of the two circulars shows that under 1981 Circular <\/p>\n<p>the requisite roll strength was 100, which was changed to 500 <\/p>\n<p>subsequently in the 1992 Circular.\n<\/p>\n<p id=\"p_17\">\n<p>\tIt is fairly accepted by learned counsel for the writ petitioners <\/p>\n<p>that the expression used in the two circulars is &#8220;Daftary&#8221; and not <\/p>\n<p>&#8220;fourth peon&#8221;. The High Court seems to have fallen in error by <\/p>\n<p>proceeding on the basis as if the circulars referred to &#8220;fourth peon&#8221;. <\/p>\n<p>This is clear from the reading of the various judgments impugned in <\/p>\n<p>these appeals.\n<\/p>\n<p id=\"p_18\">\n<p>\tIt is to be noted that post of &#8220;Daftary&#8221; carries higher scale of <\/p>\n<p>pay and is a promotional post for class IV employees. That being the <\/p>\n<p>position, the High Court was not justified in directing approval of the <\/p>\n<p>writ petitioners&#8217; services as &#8220;fourth peon&#8221;. But one significant aspect <\/p>\n<p>cannot be lost sight of.  If a school was entitled to have a &#8220;Daftary&#8221;, <\/p>\n<p>certainly the appointment was to be made by promoting one of the three <\/p>\n<p>persons i.e. Office Peon, Office Attendant and Night Watcher-cum-<\/p>\n<p>Sweeper, there being no other class IV post in the institution. It is <\/p>\n<p>for the Managing Committee of the institution to decide who is to be <\/p>\n<p>promoted and thereafter seek approval of the concerned authorities. <\/p>\n<p>That way the claims of the writ petitioners could have been considered <\/p>\n<p>by the authorities, on being appropriately moved by the management. It <\/p>\n<p>is undisputed that the writ petitioners were appointed by the managing <\/p>\n<p>committees&#8217;, may be under a misreading of the relevant government <\/p>\n<p>orders.\n<\/p>\n<p id=\"p_19\">\n<p>We, therefore, while allowing these appeals direct that the <\/p>\n<p>management of the concerned institution shall move the concerned <\/p>\n<p>authorities for approval to the promotional appointment of a class IV <\/p>\n<p>employee, as &#8220;Daftary&#8221;. Simultaneously, it can also recommend for <\/p>\n<p>appointment to the class IV post, in case approval is accorded to the <\/p>\n<p>recommendation for appointment of &#8220;Daftary&#8221; on promotion. The decision <\/p>\n<p>on both motions shall be taken within three months from the date of <\/p>\n<p>submission of the recommendation in accordance with law keeping in view <\/p>\n<p>the operative yardsticks in force at the time of appointments were <\/p>\n<p>made. Even if there has been refusal earlier, the matter shall be <\/p>\n<p>reconsidered in the light of what has been stated above.<\/p>\n<p>Before we part with this case we must indicate that undisputedly <\/p>\n<p>there were several decision of the Division Bench rendered at earlier <\/p>\n<p>points of time, taking a view contrary to the one taken in the impugned <\/p>\n<p>judgments.  Learned counsel for the respondents (writ petitioners) <\/p>\n<p>fairly accepted that it is so.  In fact, copy of one such decision <\/p>\n<p>dated 3.12.1998 in O.J.C. 14004\/97 was placed on record. The decisions <\/p>\n<p>do not appear to have been brought to the notice of the learned Judges <\/p>\n<p>hearing the writ petitions.  This speaks volumes about the seriousness <\/p>\n<p>exhibited by learned counsel appearing for the parties, &#8211; particularly <\/p>\n<p>the State Government, before the High Court.\n<\/p>\n<p id=\"p_20\">\n<p>The appeals are allowed in the aforesaid terms, leaving the <\/p>\n<p>parties to bear their respective costs.\n<\/p>\n<p id=\"p_21\">\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Orissa And Ors vs Rajendra Kumar Das And Anr on 29 August, 2003 Author: A Pasayat Bench: Doraiswamy Raju, Arijit Pasayat.
