The petitioners have also prayed for the<br \/>\ndirection to respondent No.2 to remove the President and Vice<br \/>\nPresident of the Municipal Borough from their posts under Section 37<br \/>\nof the Gujarat Municipalities Act and to take action against the<br \/>\nPresident and Vice President for making wrong compromises.\n<\/p>\n<p id=\"p_1\">2.\tThis<br \/>\nCourt has passed an order on 5.7.2001, wherein it is observed that<br \/>\nthe term of the Municipality has already come to an end by efflux of<br \/>\ntime on 24.1.2001 and hence prayer (C) has become infructuous. So far<br \/>\nas prayer (B) is concerned, the Municipality has also challenged the<br \/>\nimpugned award before this Court and this Court vide its order dated<br \/>\n13.12.2005 passed in Special Civil Application No.1049 of 2002 and<br \/>\nother cognate matters quashed and set aside the impugned award.\n<\/p>\n<p id=\"p_2\">3.\tMr.\n<\/p>\n<p id=\"p_3\">Murli N. Devnani, learned advocate appearing for the respondent<br \/>\nNo.3-Bantwa Nagar Palika,  has submitted that in view of the said<br \/>\ndecision, the present petition no longer survives and it has become<br \/>\ninfructuous.\n<\/p>\n<p id=\"p_4\">4.\tIn the<br \/>\nabove view of the matter, prayer (B), which only survives, has become<br \/>\ninfructuous as the impugned award has already been quashed and set<br \/>\naside. The petition is accordingly disposed of.
