Justice K.P.BALACHANDRAN\n\n Dated :19\/07\/2007\n\n O R D E R\n               J.B.KOSHY &amp; K.P.BALACHANDRAN, JJ.\n            -------------------------------------\n                      M.F.A.175 OF 2001\n            -------------------------------------\n                    Dated 19th July, 2007\n\n                           JUDGMENT\n<\/pre>\n<p id=\"p_1\">Koshy,J.\n<\/p>\n<p id=\"p_1\">              Appellant\/petitioner met with a motor accident<\/p>\n<p>while travelling as a passenger in a bus bearing registration<\/p>\n<p>No.KL-8C\/4334 driven by the fourth respondent when the bus was<\/p>\n<p>hit by another bus bearing registration No.KER781 driven by<\/p>\n<p>the first respondent.     As a result of the accident, he<\/p>\n<p>sustained serious injuries which resulted in amputation of the<\/p>\n<p>right arm.   The arm was dismembered and fell on the road.<\/p>\n<p>The Tribunal found that the accident occurred due to the<\/p>\n<p>negligence of the first respondent driver of the bus insured<\/p>\n<p>by the third respondent insurance company.  However, against a<\/p>\n<p>claim of Rs.28,00,000\/=, only Rs.2,96,830\/= was awarded by the<\/p>\n<p>Tribunal.   Only quantum of compensation is disputed in this<\/p>\n<p>appeal.   Finding of negligence on the part of the first<\/p>\n<p>respondent driver, coverage of insurance of the bus by the<\/p>\n<p>third respondent etc. have become final.   Hence, we are only<\/p>\n<p>considering the question of quantum of compensation.<\/p>\n<p id=\"p_2\">         2. First question is regarding the income of the<\/p>\n<p>appellant. Admittedly, appellant was an income tax payee.   He<\/p>\n<p>was employed as a Designer in a Textile Mill.      He was the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MFA.175\/2001                 2<\/span><\/p>\n<p>Executive Director and Chief Designer of a Textile Company<\/p>\n<p>at Madras.    Exts.A12 to A14 are the salary certificates<\/p>\n<p>issued to the appellant.   The above certificates show that<\/p>\n<p>yearly income    of the appellant was Rs.1,00,000\/=.   That<\/p>\n<p>will show that his monthly income was more than Rs.8,000\/=.<\/p>\n<p>He produced Ext.A10 to A10(d) income tax returns from the<\/p>\n<p>year 1994-95 onwards which show that the declared income<\/p>\n<p>was  Rs.80,000\/=   per  year,  Rs.90,000\/=  per  year  and<\/p>\n<p>subsequently Rs.1,00,000\/= per year.  The Tribunal assumed<\/p>\n<p>that after deducting personal expenses Rs.4,000\/= will be<\/p>\n<p>his income and then for the purpose of calculation of<\/p>\n<p>compensation only Rs.2,250\/= was taken.     We are of the<\/p>\n<p>opinion that the method adopted by the Tribunal is wholly<\/p>\n<p>baseless.    When a person was getting monthly income of<\/p>\n<p>Rs.8,000\/= and when he cannot do the work of a designer in<\/p>\n<p>the textile mill and proved the income, the Tribunal ought<\/p>\n<p>to have fixed a reasonable sum as monthly income.    In any<\/p>\n<p>event, after fixing Rs.4,000\/= as monthly income after<\/p>\n<p>deducting   personal expenses,  there  is  no   reason  for<\/p>\n<p>reducing it further to Rs.2,250\/=.  The amount for personal<\/p>\n<p>expenses is to be deducted only when compensation for death<\/p>\n<p>is calculated.     We are of the opinion that at least<\/p>\n<p>Rs.4,000\/= ought to have been taken for the purpose of<\/p>\n<p>calculation of compensation.\n<\/p>\n<p id=\"p_3\"><span class=\"hidden_text\" id=\"span_1\">MFA.175\/2001                   3<\/span><\/p>\n<p id=\"p_4\">           3. The second question is regarding the percentage<\/p>\n<p>of disability.    We have already seen that, at the time of<\/p>\n<p>accident, his right hand was dismembered and fell on the<\/p>\n<p>road.   He was treated in Ganga Hospital, Coimbatore.     The<\/p>\n<p>discharge   summary  shows   that  there  is total  avulsion<\/p>\n<p>amputation (R) upper limb at the level of shaft of humerus.<\/p>\n<p>A contention was raised by the insurance company that<\/p>\n<p>disability is only to the upper limb.          But what the<\/p>\n<p>certificate shows is that there was a permanent partial<\/p>\n<p>disability to that limb and percentage of disability is 85.<\/p>\n<p>However, because of that contention, he was referred to the<\/p>\n<p>Medical Board for examination and the Medical Board of<\/p>\n<p>District Hospital, Palakkad issued Ext.X1 certificate.   The<\/p>\n<p>above   certificate   shows   the  following  percentage   of<\/p>\n<p>disability:\n<\/p>\n<p id=\"p_5\">\n<blockquote id=\"blockquote_1\"><p>                &#8220;He is orthopaedically handicapped<br \/>\n            due to Above Elbow Amputation . and<br \/>\n            his permanent disability is assessed<br \/>\n            as 85% (Eighty five percent).&#8221;\n<\/p><\/blockquote>\n<p id=\"p_6\">It is the contention of the appellant that as a result of<\/p>\n<p>the accident he lost his job and he cannot do any more work<\/p>\n<p>as a designer.     Because of the complete loss of limb, he<\/p>\n<p>cannot even walk properly and in effect, as far as he is<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">MFA.175\/2001                  4<\/span><\/p>\n<p>concerned, there is 100% disability.    In this connection,<\/p>\n<p>we also refer to Schedule-I to the Workmen&#8217;s <a href=\"\/doc\/1113485\/\" id=\"a_1\">Compensation<\/p>\n<p>Act<\/a> wherein for amputation through shoulder joint, loss of<\/p>\n<p>earning capacity was fixed as 90%, for amputation below<\/p>\n<p>shoulder   with  stump  less  than  20.32Cms.  from  tip  of<\/p>\n<p>acromion 80% and amputation form 20.32 Cms. from tip of<\/p>\n<p>acromion to less than 11.43 Cms. below tip of olecranon<\/p>\n<p>70%.    We take 70% as the permanent disability of the<\/p>\n<p>appellant,    even though the amputation is from the upper<\/p>\n<p>humerus.    Appellant was aged 41.  Tribunal has taken 15 as<\/p>\n<p>the multiplier.    A three member bench of the Supreme Court<\/p>\n<p>in  Smt.Supe   Dei   and others  v.  M\/s.National  Insurance<\/p>\n<p>Comapnay Ltd. and another (JT 2002 (Sippl.1) SC 451) held<\/p>\n<p>that compensation has to be calculated taking guidance from<\/p>\n<p>the second schedule of the <a href=\"\/doc\/785258\/\" id=\"a_1\">Motor Vehicles Act<\/a> even in<\/p>\n<p>claims under <a href=\"\/doc\/136948773\/\" id=\"a_2\">Section 166<\/a> of the M.V.Act.   Even though it is<\/p>\n<p>contended that since the life expectancy of Indians has<\/p>\n<p>increased, a higher multiplier should have been taken,    we<\/p>\n<p>see no ground to enhance the multiplier taken by the<\/p>\n<p>Tribunal taking guidance      from  the   second   schedule.<\/p>\n<p>If  that be so, compensation payable will be Rs.4,000<\/p>\n<p>x 12  x 15 x      70  =  5,04,000\/=. Tribunal has granted<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                 100<\/span><\/p>\n<p>Rs.20,000\/=for head injury, Rs.1,75,000\/= for disability<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">MFA.175\/2001                  5<\/span><\/p>\n<p>and loss of earning capacity and Rs.15,000\/= for physical<\/p>\n<p>disability.     Thus,  the  total  compensation  granted for<\/p>\n<p>disability,   loss  of  earning  capacity,  injury  etc. was<\/p>\n<p>Rs.2,10,000\/=.    If that is deducted, balance compensation<\/p>\n<p>payable will be Rs.2,94,000\/=.     It is contended that the<\/p>\n<p>compensation   granted  for  pain  and  suffering,  loss  of<\/p>\n<p>amenities and   treatment etc are very low,  considering the<\/p>\n<p>total   compensation  granted,  we  are  not  enhancing  the<\/p>\n<p>compensation   granted   under  other  heads.     Thus,  the<\/p>\n<p>additional amount of Rs.2,94,000\/= now awarded should be<\/p>\n<p>deposited by the third respondent insurance company with 7%<\/p>\n<p>interest from the date of application till its deposit.
