Justice V.GIRI\n\n Dated :03\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">12\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                   W.P.(C<\/a>).35626\/2008\n                      --------------------\n       Dated this the 3rd day of December, 2008\n\n                       JUDGMENT\n<\/pre>\n<p id=\"p_1\">      Petitioner is the son of one Babu Vijayanath now<\/p>\n<p>deceased.     It seems that marriage between the<\/p>\n<p>petitioner&#8217;s   father and his mother, Ajitha Kumari,<\/p>\n<p>ended in divorce granted in that behalf by the Sub<\/p>\n<p>Court, Kollam,     in O.P.(HMA).No.46\/1987.     It seems<\/p>\n<p>that the fifth respondent then started living with the<\/p>\n<p>petitioner&#8217;s father. Though there is a dispute as to<\/p>\n<p>religion and caste of the fifth respondent, same is not<\/p>\n<p>strictly relevant in the instant case. Be that as it may,<\/p>\n<p>it is admitted that two children were born to the fifth<\/p>\n<p>respondent. Petitioner submits that his father and the<\/p>\n<p>fifth respondent started living together without<\/p>\n<p>marrying.     Petitioner is aggrieved that extensive<\/p>\n<p>properties which were held by his father are now seen<\/p>\n<p>to have been transferred in favour of the fifth<\/p>\n<p>respondent by some fabricated documents. Petitioner<\/p>\n<p>submits that he has decided to approach         the Civil<\/p>\n<p>Court to avoid the same. But, in the meanwhile, on<\/p>\n<p>W.P.(C).35626\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>application made by the fifth respondent, Tahsildar has<\/p>\n<p>purported to issue Ext.P5 which is styled as a certificate<\/p>\n<p>showing fifth respondent and two minor children born<\/p>\n<p>to the fifth respondent as legal heirs of late Babu<\/p>\n<p>Vijayanath. Petitioner submits that he approached the<\/p>\n<p>District Collector challenging Ext.P5 and this has been<\/p>\n<p>met with Ext.P10 stating that the District Collector has<\/p>\n<p>no power to interfere in the matter and that the parties<\/p>\n<p>shall establish their status before the Civil Court.<\/p>\n<p>Ext.P10 is under challenge in the writ petition.<\/p>\n<p id=\"p_1\">2.    I heard learned counsel for the petitioner and<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">3.    The dispute as to whether the fifth respondent or<\/p>\n<p>any other person or the children are the legal heirs of<\/p>\n<p>late Babu Vijayanath are matters which have to be<\/p>\n<p>appropriately decided by the Civil Court.           If the<\/p>\n<p>petitioner challenges the same,       it is open to the<\/p>\n<p>petitioner to approach the Civil Court for a declaration as<\/p>\n<p>W.P.(C).35626\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             3<\/span><\/p>\n<p>to the marital status (or absence of the same) vis-`-vis<\/p>\n<p>the fifth respondent. These matters require elaborate<\/p>\n<p>evidence and naturally this process can be undertaken<\/p>\n<p>only by the Civil Court.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">4.   Certificate in the nature of Ext.P5 does not have<\/p>\n<p>any statutory backing.
