M. SAHAI)<\/p>\n<p>1.\t\tWe<br \/>\nhave heard Ms.Vasavdatta Bhatt, learned counsel appearing for the<br \/>\nappellants and Mr.Y.V.Shah, learned counsel appearing for the<br \/>\nrespondent. Today, only Civil Application has been listed. Learned<br \/>\ncounsel for the parties stated that Civil Application as well as<br \/>\nLetters Patent Appeal both should be decided together today itself.<br \/>\nWith the consent of the learned counsel for the parties, we have<br \/>\ntaken this Appeal for final disposal. Learned counsel for the<br \/>\nappellants Ms. Vasavdatta Bhatt has urged that the learned Single<br \/>\nJudge while adjourning the matter to 21st July, 2011, has directed<br \/>\nthe appellants to deposit the amount of provident fund, gratuity,<br \/>\nleave encashment and family pension which is payable to the widow of<br \/>\nMansukhbhai, Ex-Trolleyman. She has urged that without assigning<br \/>\nreasons, such an order cannot be passed, that too, by interim order<br \/>\nwithout deciding the writ petition finally. We find force in the<br \/>\nsubmission of the learned counsel for the appellants that by way of<br \/>\ninterim relief, final relief cannot be granted.\n<\/p>\n<p>2.\t\tThe<br \/>\nApex Court in State of U.P. &amp; Others V\/s. Ram Sukhi Devi,<br \/>\n(2005) 9 SCC 733 wherein in paragraph 8, has clearly held that<br \/>\nfinal relief cannot be granted by way of interim relief.  Paragraph 8<br \/>\nof the aforesaid decision is extracted below :-\n<\/p>\n<p>&#8220;To say<br \/>\nthe least, approach of the learned Single Judge and the Division<br \/>\nBench is judicially unsustainable and indefensible. The final relief<br \/>\nsought for in the writ petition has been granted as an interim<br \/>\nmeasure. There was no reason indicated by learned Single Judge as to<br \/>\nwhy the Government Order dated 26.10.1998 was to be ignored. Whether<br \/>\nthe writ petitioner was entitled to any relief in the writ petition<br \/>\nhas to be adjudicated at the time of final disposal of the writ<br \/>\npetition. This Court has on numerous occasions observed that the<br \/>\nfinal relief sought for should not be granted at an interim stage.<br \/>\nThe position is worsened if the interim direction has been passed<br \/>\nwith stipulation that the applicable Government Order has to be<br \/>\nignored.  Time and again this Court has deprecated the practice of<br \/>\ngranting interim orders which practically give the principal relief<br \/>\nsought in the petition for no better reason than that of a prima<br \/>\nfacie case has been made out, without being concerned about the<br \/>\nbalance of convenience, the public interest and a host of other<br \/>\nconsiderations. [<a href=\"\/doc\/96932\/\">See Assistant Collector of Central Excise, West<br \/>\nBengal v. Dunlop India Ltd.<\/a> (1985 (1) SCC 260 at p. 265), <a href=\"\/doc\/721664\/\">State of<br \/>\nRajasthan v. M\/s Swaika Properties<\/a> (1985 (3) SCC 217 at p.224), State<br \/>\nof U.P. and Ors. v. Visheshwar (1995) Supp (3) SCC 590, Bharatbhushan<br \/>\nSonaji Kshirsagar (Dr.) v. Abdul Khalik Mohd. Musa and Ors. (1995<br \/>\nSupp (2) SCC 593), <a href=\"\/doc\/1800604\/\">Shiv Shankar and Ors. v. Board of Directors,<br \/>\nU.P.S.R.T.C. and Anr.<\/a> (1995 Supp (2) SCC 726) and<br \/>\nCommissioner\/Secretary to <a href=\"\/doc\/1762869\/\">Govt. Health and Medical Education<br \/>\nDepartment Civil Sectt., Jammu v. Dr. Ashok Kumar Kohli<\/a> (1995 Supp<br \/>\n(4) SCC 214).]  No basis has been indicated as to why learned Single<br \/>\nJudge thought the course as directed was necessary to be adopted.<br \/>\nEven it was not indicated that a prima facie case was made out<br \/>\nthough as noted above that itself is not sufficient. We, therefore,<br \/>\nset aside the order passed by learned Single Judge as affirmed by the<br \/>\nDivision Bench without expressing any opinion on the merits of the<br \/>\ncase we have interfered primarily on the ground that the final relief<br \/>\nhas been granted at an interim stage without justifiable reasons.<br \/>\nSince the controversy lies within a very narrow compass, we request<br \/>\nthe High Court to dispose of the matter as early as practicable<br \/>\npreferably within six months from the date of receipt of this<br \/>\njudgment.&#8221;\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the aforesaid decision, we are of the considered opinion that<br \/>\nthe order of the learned Single Judge dated 30.6.2011 by which final<br \/>\nrelief has been granted by way of interim relief cannot be<br \/>\nmaintained.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe result, this Appeal succeeds and is allowed. The order passed by<br \/>\nthe learned Single Judge dated 30.6.2011 in Special Civil Application<br \/>\nNo. 7941 of 2011 is set aside. The matter is remanded back to the<br \/>\nlearned Single Judge with a request to decide the matter afresh<br \/>\nsubject to His Lordship&#8217;s convenience. In view of the order passed in<br \/>\nLetters Patent Appeal, Civil Application does not survive. Rule is<br \/>\ndischarged in Civil Application.
