No.13071 of 2010\n                      NAND BIHARI YADAV SON OF YOGESHWAR YADAV\n                                             Versus\n                                      STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p id=\"p_1\">3.   29.6.2010                Supplementary affidavit filed today be kept on the<\/p>\n<p>                 record.\n<\/p>\n<p id=\"p_1\">                              Heard learned Counsel for the petitioner and the State.<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under <a href=\"\/doc\/1258372\/\" id=\"a_1\">Sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_1\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_2\">149<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_3\">302<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_4\">504<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_5\">34<\/a> of the Indian<\/p>\n<p>                 Penal Code and 27 of the <a href=\"\/doc\/1934415\/\" id=\"a_6\">Arms Act<\/a>.\n<\/p>\n<p id=\"p_2\">                              In the first information report the allegation against the<\/p>\n<p>                 petitioner is that he caught hold the deceased, whereas co-<\/p>\n<p>                 accused Chandeshwar Yadav fired at him.\n<\/p>\n<p id=\"p_3\">                              Considering the same and also the fact that the<\/p>\n<p>                 petitioner is in custody since 2.12.2009 and his wife undertakes<\/p>\n<p>                 responsibility of the petitioner&#8217;s conduct after his release from jail<\/p>\n<p>                 custody, let the petitioner above named be released on bail on<\/p>\n<p>                 furnishing bail bond of Rs.5,000\/- (Five thousand) with two sureties<\/p>\n<p>                 of the like amount each to the satisfaction of Chief Judicial<\/p>\n<p>                 Magistrate, Bhojpur at Arrah in Imadpur P.S.case No.21 of 2006,<\/p>\n<p>                 subject to the conditions (i) That one of the bailors shall be the wife<\/p>\n<p>                 of the petitioner and the other bailor will be a close relative of the<\/p>\n<p>                 petitioner who will give an affidavit giving genealogy as to how he<\/p>\n<p>                 is related with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                 information to the court about any change in the address of the<\/p>\n<p>                 petitioner, (ii) that the bailor shall also state on affidavit that he will<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   -2-<\/span><\/p>\n<p>            inform the court concerned if the petitioner is implicated in any<\/p>\n<p>            other case of similar nature after his release in the present case<\/p>\n<p>            and thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on the ground of misuse, (iii) that<\/p>\n<p>            the petitioner will give an undertaking that he will receive the police<\/p>\n<p>            papers on the given date and be present on date fixed for charge<\/p>\n<p>            and if he fails to do so on two given dates and delays the trial in<\/p>\n<p>            any manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>            misuse and (iv) that the petitioner will be well represented on each<\/p>\n<p>            date and if he fails to do so on two consecutive dates, his bail will<\/p>\n<p>            be liable to be cancelled.\n<\/p>\n<p id=\"p_4\">                        In view of nature of allegations against the petitioner,<\/p>\n<p>            the petitioner is directed to appear before the Superintendent of<\/p>\n<p>            Police, Bhojpur at Arrah within fifteen days of his release with a<\/p>\n<p>            copy of this order and thereafter every two weeks for the next nine<\/p>\n<p>            months. The conduct of the petitioner will be kept under watch in<\/p>\n<p>            this period by the S.P. concerned and if it is found wanting in any<\/p>\n<p>            manner a report shall be made to the court concerned by him to<\/p>\n<p>            initiate a proceeding for cancellation of bail for reasons of misuse<\/p>\n<p>            of bail.
