No. 8570-C of 2008<\/p>\n<p>           This is an application under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of the Limitation Act for<\/p>\n<p>condoning the delay of 8 days in filing the appeal.<\/p>\n<p id=\"p_1\">           It has been averred in the application that the appellants after<\/p>\n<p>the decision of the case, received the certified copy of the judgment and<\/p>\n<p>decree.     The matter was sent for necessary deliberations in the<\/p>\n<p>department and due to the administrative procedure, the delay of 8 days<\/p>\n<p>has occurred in filing the present appeal.<\/p>\n<p id=\"p_2\">           The notice of the application was issued.<\/p>\n<p>           The learned counsel appearing on behalf of the non-<\/p>\n<p>applicant\/respondents has not opposed the application for condoning<\/p>\n<p>the delay of 8 days in filing the appeal.\n<\/p>\n<p id=\"p_3\">           Consequently, this application is allowed and the delay of 8<\/p>\n<p>days in filing the appeal is condoned.\n<\/p>\n<p id=\"p_4\"> R.S.A. No. 2896 of 2008 (O&amp;M)<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                       -2-<\/span><\/p>\n<p>R.S.A. No. 2896 of 2008<\/p>\n<p>            This order shall dispose of R.S.A. No. 2896 of 2008 titled<\/p>\n<p>State of Haryana and others Vs. Dharampal and others, R.S.A. No.<\/p>\n<p>1516 of 2008 titled State of Haryana and others Vs. Devender Kumar<\/p>\n<p>and R.S.A. No. 1977 of 2008 titled State of Haryana and others Vs.<\/p>\n<p>Sant Lal and another, as common questions of law and fact are<\/p>\n<p>involved.\n<\/p>\n<p id=\"p_5\">            For brevity sake, facts are being taken from R.S.A. No. 2896<\/p>\n<p>of 2008.\n<\/p>\n<p id=\"p_6\">            This regular second appeal by the State of Haryana is<\/p>\n<p>directed against the judgments and decrees dated 26.7.2006 and<\/p>\n<p>2.6.2008 passed by the learned Courts below vide which the suit filed<\/p>\n<p>by the plaintiff\/respondents for declaration that they are entitled to<\/p>\n<p>regularisation of their services from due date, has been ordered to be<\/p>\n<p>decreed.\n<\/p>\n<p id=\"p_7\">            The case set up by the plaintiffs was that their services have<\/p>\n<p>been regularised by the department but not from the date to which they<\/p>\n<p>were entitled. It has been claimed by the plaintiff\/respondents that they<\/p>\n<p>were entitled to regularisation, on compleation of 240 days as was done<\/p>\n<p>in the case of other employees of the department. In support, they had<\/p>\n<p>placed on record copy of regularisation order of the other employees<\/p>\n<p>wherein instruction No. 1682-92\/A-3 HAR dated 19.2.1979 was relied<\/p>\n<p>upon and were ordered to be regularised on completion of 240 days<\/p>\n<p>service.\n<\/p>\n<p id=\"p_8\">            The plea of the appellant\/defendants that the suit was time<\/p>\n<p>barred was rejected by the learned Courts below by holding that the<\/p>\n<p>regularisation from the later date affected their right of salary every<\/p>\n<p>month and thus, they had a recurring cause of action to maintain the<br \/>\n R.S.A. No. 2896 of 2008 (O&amp;M)<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                          -3-<\/span><\/p>\n<p>suit   as   every   month   new    cause     of   action   accrued   to   the<\/p>\n<p>plaintiff\/respondents.\n<\/p>\n<p id=\"p_9\">            The learned Courts below have, however, restricted the relief<\/p>\n<p>of arrear to three years and two months prior the date of filing of the suit<\/p>\n<p>along with interest @ 9% per annum.\n<\/p>\n<p id=\"p_10\">            The plea of the appellants that the suit was time barred<\/p>\n<p>cannot be accepted in view of finding recorded by learned Courts<\/p>\n<p>below.\n<\/p>\n<p id=\"p_11\">            The other contention of the learned Sr. D.A.G., Haryana, that<\/p>\n<p>there were no instructions qua regularisation on completion of 240 days<\/p>\n<p>also cannot be accepted as the instructions dated 19.2.1979 were<\/p>\n<p>produced in this Court in C.W.P. No. 1437 of 1988 Ishwar Singh Vs.<\/p>\n<p>The State of Haryana and others decided on 13.7.2005, in which<\/p>\n<p>directions were issued by this Court for regularisation of services of the<\/p>\n<p>petitioner therein on completion of 240 days of service by relying on<\/p>\n<p>instruction referred to above.\n<\/p>\n<p id=\"p_12\">            The judgment\/decree passed by the learned Courts below,<\/p>\n<p>therefore, is squarely covered by the decision of this Court in Ishwar<\/p>\n<p>Singh Vs. The State of Haryana and others C.W.P. No. 1437 of 1988<\/p>\n<p>decided on 13.7.2005.\n<\/p>\n<p id=\"p_13\">            As the question of law as raised already stands adjudicated<\/p>\n<p>by this Court, thus, no substantial question of law arises for<\/p>\n<p>consideration by this Court in the appeal.<\/p>\n<p id=\"p_14\">            Dismissed.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">                                                     (Vinod K.
