Justice S.S.SATHEESACHANDRAN\n\n Dated :18\/06\/2009\n\n O R D E R\n               S.S.SATHEESACHANDRAN, J.\n\n               -----------------------------------------\n                   W.P(C).No.13397 of 2009\n               -----------------------------------------\n\n               Dated this the 18th June, 2009\n\n                           JUDGMENT\n<\/pre>\n<p id=\"p_1\">     The Writ Petition is filed under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<\/p>\n<p>Constitution of India seeking the following reliefs:<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;(a)   to issue a writ of certiorari or other<br \/>\n             appropriate order or direction to quash<br \/>\n             Exhibit P12.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      (b)    to grant such other reliefs as are just and<br \/>\n             proper in the nature of this case.&#8221;<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">     2. An ex parte order of injunction, Exhibit P12, passed by<\/p>\n<p>the Vacation District Judge is challenged in the Writ Petition<\/p>\n<p>as one without jurisdiction and abuse of process of the court.<\/p>\n<p>In Exhibit P12 order, the nominated District Judge, during the<\/p>\n<p>vacation, has ordered that the interim order passed shall<\/p>\n<p>continue to be in force till the disposal of the suit. Such an<\/p>\n<p>order could not have been passed under the provisions of<\/p>\n<p>Order XXXIX of the Code of Civil Procedure and the Rules<\/p>\n<p>thereunder and it cannot have sanction of law, is the case of<\/p>\n<p>the petitioner.\n<\/p>\n<p id=\"p_3\"><span class=\"hidden_text\" id=\"span_1\">  WP(C).13397\/09                  2<\/span><\/p>\n<p id=\"p_4\">      3. Having regard to the submissions made and also the<\/p>\n<p>facts and circumstances presented, I find, a narration of the<\/p>\n<p>disputes involved between the parties which is said to be<\/p>\n<p>between the Provincial Superior       and the Nuns under her<\/p>\n<p>control emanating from rival claims over the management and<\/p>\n<p>administration of a School need not be adverted to for disposal<\/p>\n<p>of this petition. The learned counsel on both sides fairly<\/p>\n<p>submitted that since no final orders have been passed on the<\/p>\n<p>application for injunction, its merit can be considered by the<\/p>\n<p>trial court within a time limit fixed by this Court. The learned<\/p>\n<p>counsel for the petitioner also urged that whatever contentions<\/p>\n<p>raised impeaching the jurisdiction may also be reserved for<\/p>\n<p>being raised on the hearing of the application on merits. The<\/p>\n<p>Writ Petition is not disposed on merits and as such it is open to<\/p>\n<p>the petitioner to urge his contentions, whatever that be,<\/p>\n<p>against Exhibit P11 application on its hearing. In the Writ<\/p>\n<p>Petition, an interim order had been passed directing for<\/p>\n<p>keeping in abeyance Exhibit P12 order till the disposal of the<\/p>\n<p>Petition. That order shall continue to be in force till the<\/p>\n<p>injunction application moved by the respondent is disposed of<\/p>\n<p>on merits. The learned Munsiff is directed to hear and dispose<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">  WP(C).13397\/09                  3<\/span><\/p>\n<p>P11 injunction application within a period of three weeks from<\/p>\n<p>the date of receipt of a copy of this judgment. The petitioner<\/p>\n<p>(respondent in the injunction application) who has not filed the<\/p>\n<p>counter shall file counter, if any, within ten days.<\/p>\n<p id=\"p_5\">      4. The learned counsel for the respondent raised an<\/p>\n<p>apprehension that the order passed by this Court in the writ<\/p>\n<p>petition for keeping in abeyance the operation of P12 order as<\/p>\n<p>well as the direction issued now for its continued operation till<\/p>\n<p>the disposal of that application on merits may influence the<\/p>\n<p>learned Munsiff in disposing the application on merits. I direct<\/p>\n<p>the learned Munsiff to dispose of the interlocutory application<\/p>\n<p>untrammelled by any of the observations made by this Court in<\/p>\n<p>the present judgment or on the basis of the orders\/directions<\/p>\n<p>given for keeping in abeyance the operation of P12 till the<\/p>\n<p>disposal of the application.\n<\/p>\n<p id=\"p_6\">      The Writ Petition is disposed of as above.\n<\/p>\n<p id=\"p_7\">      Communicate a copy of this judgment to the Munsiff<\/p>\n<p>concerned and also hand over a copy to the counsel on both<\/p>\n<p>sides on usual terms.\n<\/p>\n<p id=\"p_8\">                       S.S.SATHEESACHANDRAN, JUDGE<br \/>\nvgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sr. Vincent Mary vs Sr. Jessy on 18 June, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 13397 of 2009(O) 1.
