Justice ANTONY DOMINIC\n\n Dated :26\/08\/2009\n\n O R D E R\n                   ANTONY DOMINIC,J.\n               ---------------------\n               W.P.(C).No.24630 OF 2009\n             ------------------------\n           Dated this the 26th day of August, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>     Petitioner submits that     he is running a Home Stay<\/p>\n<p>Unit. in respect of which energy charges were being levied<\/p>\n<p>applying LT-IA tariff. It is stated that on 18th August, 2009,<\/p>\n<p>his premises were inspected by the Anti Theft Squad which<\/p>\n<p>prepared Ext.P11 mahazar, based on which Ext.P12<\/p>\n<p>provisional demand was issued. On its receipt petitioner<\/p>\n<p>filed Ext.P13 objection    to the Senior Superintendent. It is<\/p>\n<p>stated that in the meanwhile, the date specified for<\/p>\n<p>payment is fast approaching and this writ petition is filed<\/p>\n<p>mainly to avert disconnection for non-payment of the<\/p>\n<p>amount demanded in Ext.P12,          pending decision in the<\/p>\n<p>matter.\n<\/p>\n<p>     2.   I heard the Standing Counsel appearing for the<\/p>\n<p>respondent also.\n<\/p>\n<p><span class=\"hidden_text\">WP(c).No.24630\/09                2<\/span><\/p>\n<p>      3. Evidently, Ext.P12 demand is a provisional one issued<\/p>\n<p>in terms of the provisions contained in Section 126 of the<\/p>\n<p>Indian Electricity Act, 2003. On its receipt the consumer is<\/p>\n<p>entitled to raise his objection in which event Assessing Officer<\/p>\n<p>is bound to consider the matter in the light of the objections<\/p>\n<p>filed. According to the petitioner, such a decision is yet to be<\/p>\n<p>taken by the Assessing Officer and if that be so, it is<\/p>\n<p>premature to enforce Ext.P12 provisional demand by resorting<\/p>\n<p>to coercive action.\n<\/p>\n<p>      4.   Having regard to the above, I dispose of this writ<\/p>\n<p>petition with the following directions.<\/p>\n<p>      5.   The Assessing Officer      concerned shall consider<\/p>\n<p>Ext.P12 provisional demand in the light of Ext.P13 objections<\/p>\n<p>filed by the petitioner with notice to the petitioner and shall<\/p>\n<p>pass orders thereon after affording the petitioner            an<\/p>\n<p>opportunity of hearing. It is directed that in the meanwhile,<\/p>\n<p>coercive action pursuant to Ext.P12 shall not be enforced. \\<\/p>\n<p><span class=\"hidden_text\">WP(c).No.24630\/09                  3<\/span><\/p>\n<p>      6.
