Misc.<\/p>\n<p>                               No. 37365 of 2008 is restored to its original<\/p>\n<p>                               file.\n<\/p>\n<p>                                             Now the matter is being heard on merit.<\/p>\n<p>                                             The quashing application has been filed<\/p>\n<p>                               for quashing the order dated 13.6.2008, passed<\/p>\n<p>                               by     the      Sub-divisional               Judicial          Magistrate,<\/p>\n<p>                               Munger in Complaint Case No. 371C of 2008 by<\/p>\n<p>                               which       the     Court       below       has     taken       cognizance<\/p>\n<p>                               under Sections 498A, 323, 504 of the Indian<\/p>\n<p>                               Penal Code and \u00be of the Dowry Prohibition Act.<\/p>\n<p>                                             The petitioners are the father-in-law,<\/p>\n<p>                               mother-in-law            and     the      husband        of    the     victim<\/p>\n<p>                               girl.       The allegation in the complaint petition<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>is that there was demand of Maruti Zen (Car)<\/p>\n<p>and on non-fulfillment of demand, the in-laws<\/p>\n<p>along     with    the    husband         used    to       abuse    the<\/p>\n<p>complainant Deep Shikha.                   Not only that the<\/p>\n<p>accused    abused       the    complainant,           it    is     also<\/p>\n<p>alleged that they assaulted her.                      On the basis<\/p>\n<p>of the aforesaid allegations, cognizance was<\/p>\n<p>taken.\n<\/p>\n<p>          Learned       counsel          for    the    petitioners<\/p>\n<p>submits    that    the    petitioner           no.    1    i.e.    the<\/p>\n<p>father-in-law has instituted a complaint case<\/p>\n<p>being     613C of 2008 in which he has alleged<\/p>\n<p>that Deep Shikha&#8217;s father had taken loan from<\/p>\n<p>him and in order to honour the loan had issued<\/p>\n<p>three cheques.          Out of the three cheques, only<\/p>\n<p>one cheque of Rs. 2,00,000\/- could be encashed.<\/p>\n<p>The other two cheques bounced.                  Thus a case has<\/p>\n<p>been instituted under Section 420 of the Indian<\/p>\n<p>Penal Code and 138 of the Negotiable Instrument<\/p>\n<p>Act.     Strangely enough the reason for taking<\/p>\n<p>loan, has not been mentioned in the complaint<\/p>\n<p>petition.        It is submitted that the Court has<\/p>\n<p>taken     cognizance          in     the       aforesaid          case.<\/p>\n<p>Learned    counsel       for       the    petitioners        further<\/p>\n<p>submits     that        the    husband          has        filed    an<\/p>\n<p>application for restitution of conjugal rights<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>         which is pending in the Court below.                              It is<\/p>\n<p>         submitted that the opposite party no. 2 namely<\/p>\n<p>         Deep Shikha           does not      wish to live with her<\/p>\n<p>         husband.         The reasons for taking such a stand<\/p>\n<p>         are not mentioned by the petitioners, so this<\/p>\n<p>         cannot      be     circumstance            in     favour       of     the<\/p>\n<p>         petitioners.\n<\/p>\n<p>                     It would not be proper for this Court<\/p>\n<p>         to   comment      upon        the   case    instituted           by   the<\/p>\n<p>         petitioner no. 1 against Jawahar Prasad, father<\/p>\n<p>         of   Indu       Devi,     (opposite        party    no.     2)      being<\/p>\n<p>         Complaint Case No. 613C of 2008,                          as it may<\/p>\n<p>         cause    prejudice         to    the    petitioners&#8217;         case      in<\/p>\n<p>         future.         However, the facts indicate that the<\/p>\n<p>         allegations        are     prima       facie       true,    and       the<\/p>\n<p>         petitioner no. 1 has raised counter version,<\/p>\n<p>         which is highly suspicious.\n<\/p>\n<p>                     I    do     not     think      that     in     the      facts<\/p>\n<p>         aforesaid, this Court can hold that no offence<\/p>\n<p>         would be made out under Section 498A of the<\/p>\n<p>         Indian      Penal         Code      and     \u00be      of    the        Dowry<\/p>\n<p>         Prohibition Act.\n<\/p>\n<p>                     This application is dismissed.\n<\/p>\n<\/p>\n<pre>Sanjay                                             (Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Priya Ranjan Singh &amp; Ors. vs The State Of Bihar &amp; Anr. on 24 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
