Mr.G.Prabhu Rajadurai\n\n\n:JUDGMENT\n<\/pre>\n<p id=\"p_1\">\tThis appeal is focussed as against the judgment and decree dated<br \/>\n19.01.2007, passed in M.C.O.P.No.461 of 2003, on the file of the Motor Accidents<br \/>\nClaims Tribunal (III Additional Sub Court), Tiruchirapalli.\n<\/p>\n<p id=\"p_1\">\t2.Heard both sides.\n<\/p>\n<p id=\"p_2\">\t3. The challenge in this Civil Miscellaneous Appeal is relating to the<br \/>\nquantum of compensation awarded by the Tribunal, vide judgment dated 19.01.2007,<br \/>\nto a tune of Rs.64,500\/-(Rupees Sixty Four Thousand and Five Hundred only) on<br \/>\nthe following sub-heads:\n<\/p>\n<pre id=\"pre_1\">\t(i)For Permanent disability\t   - Rs.  49,500.00\t\t\n\t(ii)For Pain and Suffering and\n\t\tMental Agony\t\t   - Rs.  10,000.00\t\n<\/pre>\n<p id=\"p_3\">\t(iii)For Transportation Expenses   &#8211; Rs.   3,000.00\n<\/p>\n<p id=\"p_4\">\t(iv) For Nutritious Food\t   &#8211; Rs.   2,000.00\n<\/p>\n<p id=\"p_5\">\t\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<pre id=\"pre_2\">\t\t \t         Total     - Rs.  64,500.00\t\t\t\t\n\t\t\t\t\t\t--------------\n\n<\/pre>\n<p id=\"p_6\">\t4. Animadverting upon the quantum of compensation awarded by the Tribunal,<br \/>\nthe Transport Corporation preferred this appeal on various grounds, the gist and<br \/>\nkernel of them would run thus:\n<\/p>\n<p id=\"p_7\">\tThe Tribunal awarded a huge compensation of Rs.64,500\/- without adhering<br \/>\nto any norms. For the fracture of the left leg, the permanent disability was<br \/>\nassessed at 33%.  Accordingly, the appellant prays for modification of<br \/>\ncompensation awarded by the Tribunal.\n<\/p>\n<p id=\"p_8\">\t5.The point for consideration is as to whether the Tribunal awarded &#8216;just<br \/>\ncompensation&#8217;?\n<\/p>\n<p id=\"p_9\">\t6. During enquiry in this case along with the other connected cases, on<br \/>\nthe side of the claimants P.W.1 to P.W.8 were examined and Exs.P.1 to P.17  were<br \/>\nmarked and R.W.1 was examined on the side of the respondent. No documentary<br \/>\nevidence was adduced on the side of the respondent.\n<\/p>\n<p id=\"p_10\">\t7. Point: The learned counsel for the appellant\/Transport Corporation<br \/>\nwould submit that the Tribunal simply awarded a sum of Rs.49,500\/- for  33%<br \/>\npermanent disability at the rate of Rs.1,500\/- for each percentage of permanent<br \/>\ndisability sustained by the petitioner.  Whereas the learned counsel for the<br \/>\nclaimant would echo the cri de coeur of the claimant to the effect that because<br \/>\nof the injury sustained by him he could not continue his work as a labourer and<br \/>\nhence the compensation awarded by the Tribunal warrants no interference.\n<\/p>\n<p id=\"p_11\">\t8. No doubt assessment of 33% permanent disability for the fracture of the<br \/>\nleft hand is on the higher side.  At this juncture, I would like to refer to<br \/>\nSchedule I, Part II, Serial No.20 of the Workmen Compensation Act, which is<br \/>\nreproduced hereunder for ready reference:\n<\/p>\n<p id=\"p_12\">&#8220;20.Amputation below with stump exceeding (8.89 cms.) but not exceeding (12.70<br \/>\ncms.) &#8211; 50%&#8221;\n<\/p>\n<p id=\"p_13\">As such even for amputation below knee with stump exceeding 8.89 cms. the<br \/>\npermanent disability is assessed at 50%.  But here for the fracture of left leg<br \/>\nthe permanent disability was assessed at 34%, which is obviously on the higher<br \/>\nside. However, it could taken that he sustained permanent disability to a tune<br \/>\nof 24%.  Taking into consideration the fact that the claimant sustained injury<br \/>\nat the age of 18, awarding compensation at the rate of Rs.2,000\/- for each<br \/>\npercent of permanent disability would meet the ends of justice. If accordingly<br \/>\nworked out for  24%  permanent disability the compensation comes to Rs.48,000\/-<br \/>\n(Rupees Forty Eight Thousand only), which is almost the same as the Tribunal<br \/>\nawarded, even though the criterion is different.\n<\/p>\n<p id=\"p_14\">\t9. The compensation amounts awarded under other sub-heads also are found<br \/>\nto be reasonable, in such a case, I am of the considered opinion that this is<br \/>\nnot a fit case for interference.\n<\/p>\n<p id=\"p_15\">\t10. In the result, this appeal is dismissed. Consequently, connected<br \/>\nM.P.(MD) No.1 of 2007 is closed.
