The transfer aforesaid was said to be\n\nmade    at     the     request        of   the      petitioner      himself.\nHowever, the petitioner denied that and claimed for\n\ntravelling allowance and joining time as a consequent\n\nto his transfer under the order dated 31.7.2007. By an\n\nanother order dated 28.6.2008 the petitioner is again\n\nsubjected to transfer from Chhoti Khatu to Veterinary\n\nHospital, Karnu in District Nagaur and again he is\n\nsaid to be transferred at his own request.\n\n\n\n               While    challenging          the    order    of     transfer\n\ndated 28.6.2008,         the     contention of         counsel      for   the\n\npetitioner is that the petitioner has been transferred\n\nunder    the    orders        dated    31.7.2007      and    28.6.2008     by\n                                       2\n\nshowing the same made under his own request though no\n\nsuch request was ever made.\n\n\n\n            This    court      on    14.8.2008          issued     notice     to\n\nshow cause to the respondents and after service of the\n\nsame matter was listed before the Court on 23.10.2008.\n\nOn 23.10.2008 counsel for the respondents sought time\n\nto file reply to the writ petition and the matter was\n\nadjourned    for     3.11.2008.           After       getting    the     matter\n\nadjourned, the Director, Animal Husbandry, passed an\n\norder dated 3.11.2008 making a correction in the order\n\ndated 28.6.2008 to treat transfer of the petitioner in\n\nadministrative exigency instead of at his own request.\n\nNothing is said in reply to the writ petition relating\n\nto the order dated 31.7.2007. No reason is given by\n\nthe respondents as to why the petitioner was shown to\n\nbe    transferred    at    his      own    request       under     the   order\n\ndated    31.7.2007        as   well        as     in    the     order    dated\n\n28.6.2008. In very casual manner it is stated that the\n\ntransfer    of     the    petitioner            was     actually    made      in\n\nadministrative exigency but by mistake it was shown as\n\neffected at his own request. On asking, counsel for\n\nthe    respondents       utterly     failed        to    satisfy       how   the\n\nerror occurred relating to the petitioner twice and\n\nwhy no joining time and travelling allowance is yet\n\nallowed to the petitioner for the transfer made under\n\norder dated 31.7.2007.\n                                          3\n\n\n\n                 Though    in       normal   course     the    Court     is   not\n\nrequired         to     ask     for    the      administrative          exigency\n\nwarranting transfer of the petitioner, however, in the\n\ninstant matter, looking to the dubious circumstances,\n\nthe Court asked counsel for the respondents to give\n\nreason or to satisfy the administrative exigency for\n\neffecting transfer of the petitioner within a period\n\nof 11 months and that too by showing his transfer at\n\nhis own request. The respondents patently failed to\n\nsatisfy court's query. The respondents also failed to\n\nsatisfy as to how the error relating to the petitioner\n\noccurred twice and why no joining time and travelling\n\nallowance is yet given to him as a consequent to the\n\norder       of     transfer         dated     31.7.2007.        It     is     also\n\npertinent to note that corrigendum to the order dated\n\n28.6.2008          was        not     issued      by     the         respondents\n\nimmediately           after     receiving        notices       of     the     writ\n\npetition but was made after seeking time to file reply\n\nto    the        writ     petition       i.e.     on         3.11.2008.       The\n\ncircumstances of the case left me with no option but\n\nto infer that the transfer of the petitioner was not\n\nin    administrative            exigency      but      was    for     extraneous\n\nconsideration.\n\n\n\n                 For the reasons whatever stated above, this\n\npetition for writ deserves acceptance and, therefore,\n\nthe     same      is     allowed.
