 Z “lAs.’these two appeals are arising out of a common<\/p>\n
2  judgment and award of the Tribunal, they are heard<\/p>\n
  disposed of by this common judgment, with the<\/p>\n
consent of learned Counsel appearing for the parties.<\/p>\n

3. For the sake of convenience parties are referred to
\nas they are referred to in the claim petition before the<\/p>\n
Tribunal.\n<\/p>\n
4. Brief facts of the case are:  9<\/p>\n
That on 15-2-06, when the <\/p>\n

\nnear  bus bearing
\nregistration in a rash and
\nnegligent   their vehicle. As a
\nresuIt’,_phe_  and later succumbed to<\/p>\n
the injuries. inother and sister filed a claim petition<\/p>\n
   MACT;—Si*irangapatna, seeking compensation<\/p>\n
   \/–. The Tribunal by impugned judgment<\/p>\n
  has awarded compensation of Rs.5,00,000\/–<\/p>\n
 with”,i;fi1terest at)_ 6% p.a. Aggrieved by the quantum of<\/p>\n
 ‘coniipensation awarded by the Tribunal the claimant is<\/p>\n
___?in appeal seeking enhancement of compensation.<\/p>\n

5. As there is no dispute regarding the death of the
\ndeceased Vishwas in a motor road accident,..___and
\niiabiiity of the insurer of the bus, only point”

6. After hearing the”p\u00abiearned forithe parties
\nand perusing the award_   I am of the
\nView that    the Tribunal is
\nnot just and   iourer side and therefore
\nit is deserxpred <\/p>\n
7. The rdeceased;Vish}vas was aged about 22 years at<\/p>\n
the\u00ab\u00a7ti’rn’e of  in the accident, as evident from<\/p>\n
\u00bb the_Vpo.st\u00ab.n*iortem report ~– Ex.P.4 and SSLC marks card —<\/p>\n
 ‘  who are his mother and sister in<\/p>\n
support.’  their contention that the deceased was<\/p>\n
  studying in fine} J.O.C. at C.P.C. Polytechnic College,<\/p>\n
Charmapatna and aiso working as a part time<\/p>\n
Computer operator in Guru Wine stores, Mandya and<\/p>\n

earning Rs.5,000\/– per month, have examined the first
\nclaimant as P.W.i. They also produced ‘Prashasti’<\/p>\n
certi\ufb01cate -~\u00ab Ex.P.7 issued by Navodaya <\/p>\n
school, Srirangapatna, deceased secured award = in <\/p>\n

\ncerti\ufb01cate Guru Enterprises, Mandya,<\/p>\n
disgcioses  was yvorking as a part time computer<\/p>\n
  drawing salary of Rs.5,000\/– per month.<\/p>\n
   of Sri. Guru Enterprises was examined<\/p>\n
as  Considering he is a bright student and also<\/p>\n
 having. talent in sports and studying in final year<\/p>\n
‘”‘~:f)ip1oma and working as part time Computer Operator<\/p>\n
H in Guru Enterprises, his income could be easily<\/p>\n

assessed at Rs.4,500\/~ per month. Claimants are his<\/p>\n
mother and married sister.\n<\/p>\n
8. Subsequent to the tiling of the claim<\/p>\n
father of the deceased who was arrayed as <\/p>\n
to the claim petition. passed away; ‘-Tthe’._on_VV1# if <\/p>\n
is his mother. 50% of his incoine’-has <\/p>\n
towards his personal expenses. Mother ‘wast aged’<\/p>\n
between 37 to 40 years. Multiplierljapplicabie ‘to her age
\ngroup is ’15’ as per  Court in the<\/p>\n

14. The claimants are entitled to a total compensation
\nof Rs.4,45,000\/– as against Rs.5,00,000\/– awarded by
\nthe Tribunal, and compensation awarded  the<\/p>\n
Tribunal is reduced by a sum of Rs.55,000\/  <\/p>\n
15. Out of the compensation arriount’;<\/p>\n
a sum of Rs.3,00,000\/–\n<\/p>\n
amount is ordered to be inve’sted iii  in “name of ‘ i<\/p>\n
the first claimant, who is the’  of the-‘deceased, in
