Respondents\n\n\n        PRAYER:  Writ petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution  of\nIndia  for  the  issue  of  a writ of Mandamus forbearing the respondents from\ninterfering with the day to day affairs of the  petitioner's  Muthamzil  Youth\nWelfare  Sangam without any reasonable loss including that of the petitioner's\nlawful, cultural  and  recreational  activities  in  its  premises  at  No.24,\nNatarajapuram 4th Street, Namakkal. \n\n!For petitioner         :       Mr.M.V.Muralidaran\n\nFor respondents                :       Mr.S.Venkatesh\n                                Special Govt.  Pleader\n\n:ORDER  \n<\/pre>\n<p id=\"p_1\">        Heard both sides.\n<\/p>\n<p id=\"p_1\">        2.    Learned   Special   Government  Pleader  takes  notice  for  the<br \/>\nrespondent.\n<\/p>\n<p id=\"p_2\">        3.  The petitioner prays for the issuance of a  writ  of  Mandamus  to<br \/>\nforbear the respondents from interfering with the day-to-day activities of the<br \/>\npetitioner&#8217;s  Muthamzil  Youth  Welfare  Sangam  without any reasonable cause,<br \/>\nincluding  that  of  the  petitioner&#8217;s  lawful,  cultural   and   recreational<br \/>\nactivities in its premises, as mentioned in the writ petition.\n<\/p>\n<p id=\"p_3\">        4.   According  to  the  petitioner,  the  affairs of the petitioner&#8217;s<br \/>\nclub\/Sangam is  being  conducted  in  a  lawful  manner.    They   are   being<br \/>\nunnecessarily harassed  by  the  police.   They do not conduct any activity in<br \/>\nviolation of any of the statutory provisions or of the Gaming Act.\n<\/p>\n<p id=\"p_4\">        5.  Learned counsel also referred to the interim orders passed by this<br \/>\nCourt in W.P.Nos.5223 and 8121 of 2004 which visualises the appointment of  an<br \/>\nAdvocate  Commissioner  to inspect the property as to whether the petitioner&#8217;s<br \/>\nclub was indulging in any unlawful activity.  Learned counsel also  relies  on<br \/>\nthe  judgment  of  the  Division Bench of this Court in MANAKADU ELAINGER NALA    <\/p>\n<p>SPORTS NARPANI MANDRAM Vs.  STATE OF TAMIL NADU &amp; ANOTHER (2005-1-L.W.-82)  in<br \/>\nsupport  of  his contention that the police have no powers to intrude into the<br \/>\npersonal and recreational activities.\n<\/p>\n<p id=\"p_5\">        6.  It is needless to mention that the  police,  as  a  law  enforcing<br \/>\nauthority,  are  entitled  to  take appropriate action within the framework of<br \/>\nlaw, against any individual or association or a club, if they indulge  in  any<br \/>\nunlawful activity.    To fetter the hands of the police officials by issuing a<br \/>\nblanket order not to take any action against the activities of such clubs will<br \/>\nnot be desirable.  Every day in newspapers, there are  reports  regarding  the<br \/>\nmanner  in  which  such clubs and associations have come up in a mushroom like<br \/>\nmanner under the guise of recreational activities and how many  of  them  turn<br \/>\nout  to  be gambling houses and indulging in several other illegal activities.<br \/>\nThere have been many complaints to the police from  the  public  or  from  the<br \/>\nneighbours.   Many  shops  professing  to conduct video games were found to be<br \/>\nindulging in betting, resulting in incidents of violence.  The  recent  growth<br \/>\nof another type of video centres are stated to be the centres for the young to<br \/>\nindulge  in  improper and perverted use of the internet and e-mail facilities,<br \/>\nspecialising in obscenity and demoralising the youth.  Newspapers are full  of<br \/>\ncriticism  of the police for their alleged inaction and the issue causes grave<br \/>\nconcern to the parents.  Such demoralising and illegal  activities  in  public<br \/>\nplaces  are  certainly  actionable and there is no point in blaming the police<br \/>\nfor the resulting crimes, frequent law and order  situation  created  by  such<br \/>\nclubs and mandrams.\n<\/p>\n<p id=\"p_6\">        7.  As regards the request for appointment of Advocate Commissioner to<br \/>\naccompany  the  police  officers,  I am inclined to hold that it will not be a<br \/>\nworkable solution.  Learned Special Government Pleader rightly  expresses  the<br \/>\ndifficulty that when once the Advocate Commissioner is programmed to visit the<br \/>\npremises,  most of the clubs receive information before hand and manage to put<br \/>\nup a show of a lawful  functioning.    When  once  the  Advocate  Commissioner<br \/>\nleaves, they would start their illegal activities again.  It is therefore very<br \/>\ndifficult  to  monitor the situation on every occasion the poli ce receives an<br \/>\ninformation or a complaint and have  reason  to  believe  that  the  club  was<br \/>\nindulging in illegal activities.\n<\/p>\n<p id=\"p_7\">        8.   The  reference  made  to  the  judgment of the Division Bench, as<br \/>\nreferred to above, cannot be applied to all cases and  result  in  granting  a<br \/>\nblanket order  as  sought  for  by the petitioner.  In that case, the Division<br \/>\nBench dealt with a club affiliated to Nehru Yuva  Kendra,  Ministry  of  Yourh<br \/>\nAffairs and  Sports, Government of India.  It was an Institution answerable to<br \/>\nthe Government of India.  It is also seen that the said  club  was  conducting<br \/>\ngames only  in  Carrom  and  Chess.   After referring to the provisions of the<br \/>\nPublic Gaming Act, 1867,  the  Division  Bench  held  that  Carrom  and  Chess<br \/>\ncertainly  require  skill and hence, in view of Section 12 of the Act, the Act<br \/>\nwill have no application.  The Division Bench  further  observed  that  merely<br \/>\nmaking  general  allegations  that the activity was illegal without specifying<br \/>\nwhich law was violated, cannot be permitted.  Therefore, the observations came<br \/>\nto be made only in the background of the facts pertaining to  that  particular<br \/>\ncase.   The  effect  of  the  said  judgment  cannot  mean  that every club or<br \/>\nassociation is entitled to a prohibitory order totally tying the hands of  the<br \/>\npolice to take appropriate action whenever warranted.\n<\/p>\n<p id=\"p_8\">        9.   At  the  same  time, it requires to be emphasized that as long as<br \/>\nsuch clubs or institutions conduct  themselves  in  a  proper  manner  without<br \/>\nindulging  in any illegality, there will be no justification for the police to<br \/>\nindulge in  any  harassment.    There  is  nothing  wrong  in  the   residents<br \/>\nestablishing a  recreational  centre for themselves.  They cannot be subjected<br \/>\nto unnecessary police surveillance except in clubs which  indulge  in  illegal<br \/>\nactivities.\n<\/p>\n<p id=\"p_9\">        10.   However,  the  prayer  in  the  writ  petition cannot be granted<br \/>\nwithout making it clear that the police is certainly entitled to  take  action<br \/>\nwhenever  and  wherever  there  is  any  violation of the statutory provisions<br \/>\nincluding the Gaming Act.\n<\/p>\n<p id=\"p_10\">        With  the  above  observation,  the  writ  petition  is  disposed  of.<br \/>\nConnected W.P.M.P.No.6760 of 2005 is closed.\n<\/p>\n<p id=\"p_11\">Index:  Yes<br \/>\nInternet:  Yes<\/p>\n<p>ksv<\/p>\n<p>To:\n<\/p>\n<p id=\"p_12\">1.
