BASANT, J.\n\n              -------------------------------------------------\n\n                         B.A. No. 1070 of   2008\n\n              -------------------------------------------------\n\n          Dated this the  26th  day of  February, 2008\n\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">      Application   for   anticipatory   bail.       The   petitioner   &#8211;   a<\/p>\n<p>woman,   faces   allegations   under   the   Kerala   Abkari   Act.       She<\/p>\n<p>was   allegedly   found   to   be   indulging   in   illicit   sale   of   Indian<\/p>\n<p>Made Foreign Liquor  when she was intercepted by the Excise<\/p>\n<p>officials on 9\/2\/08.   She was apprehended at the scene; but the<\/p>\n<p>formal   arrest   could   not   be   effected   as   there   was   no   woman<\/p>\n<p>official   in   the   Excise   party   which   detected   the   offence.     1.5<\/p>\n<p>litres of IMFL was found available with the petitioner and she<\/p>\n<p>was   allegedly   found   engaging   herself   in   the   actual   culpable<\/p>\n<p>illicit sale of IMFL.\n<\/p>\n<p id=\"p_1\">      2.       The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the   petitioner   is   absolutely   innocent.       Even   if   the   entire<\/p>\n<p>allegations   were   accepted,   possession   of   1.5   litres   of   IMFL<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">  B.A. No. 1070 of   2008              -: 2 :-<\/span><\/p>\n<p>which   was   found   in   the   possession   of   the   petitioner   cannot   be<\/p>\n<p>held   to   be  objectionable.     In  these   circumstances,    anticipatory<\/p>\n<p>bail may be granted to her, it is prayed.\n<\/p>\n<p id=\"p_2\">      3.    The learned Public Prosecutor opposes the application.\n<\/p>\n<p id=\"p_3\">The learned Public  Prosecutor submits that the available inputs<\/p>\n<p>clearly   show   that   the   petitioner   was   indulging   in   the   illegal<\/p>\n<p>activity   of   illicit   sale   of   IMFL.     The   quantity   which   was   found<\/p>\n<p>available  in  the  possession  of the petitioner  is irrelevant  as the<\/p>\n<p>allegation   is   that   the   petitioner   was   found   engaging   herself   in<\/p>\n<p>the illicit sale of liquor.\n<\/p>\n<p id=\"p_4\">      4.   The   Case   Diary   has   been   placed   before   me   for   my<\/p>\n<p>perusal.     I   have   perused   the   same.       I   have   gone   through   the<\/p>\n<p>statements   of   witnesses   recorded.     There   are   indications   to<\/p>\n<p>suggest that the petitioner is habitually indulging in such activity<\/p>\n<p>of   illicit   sale   of   liquor.       The   petitioner   has   no   criminal<\/p>\n<p>antecedents;   in   the   sense   that   the   petitioner   has   not   been<\/p>\n<p>arrayed as accused at any earlier point of time.\n<\/p>\n<p id=\"p_5\">      5.    The learned Public Prosecutor opposes the application.\n<\/p>\n<p id=\"p_6\">The   learned   Public   Prosecutor   submits   that   no   circumstances<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">  B.A. No. 1070 of   2008              -: 3 :-<\/span><\/p>\n<p>exist   justifying   or   warranting   the   invocation   of   the   discretion<\/p>\n<p>under Sec.438 of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_7\">      6.   All the relevant inputs have been considered by me.     I<\/p>\n<p>am not satisfied that, in any view of the matter, this is a fit case<\/p>\n<p>where the discretion  under Sec.438 of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. can or ought<\/p>\n<p>to be invoked in favour of the petitioner.   This is an eminently fit<\/p>\n<p>case where the petitioner must resort to the ordinary and normal<\/p>\n<p>course   of   appearing   before   the  Investigating   Officer  or   the<\/p>\n<p>learned Magistrate having jurisdiction and then seek regular bail<\/p>\n<p>in the normal and usual course.\n<\/p>\n<p id=\"p_8\">      7.  The fact that  anticipatory bail had been granted by this<\/p>\n<p>Court   to   another   accused   in   another   case   as   borne   out   by<\/p>\n<p>Annexure-B   order     is   not   a   valid   or   a   proper   reason   to   invoke<\/p>\n<p>such discretion in favour of the petitioner in this case. The facts<\/p>\n<p>and circumstances appear to be different when considered in the<\/p>\n<p>light of the statements in the Case Diary.\n<\/p>\n<p id=\"p_9\">      8.    In the result, this bail application is dismissed; but with<\/p>\n<p>the   observation   that   if   the   petitioner   surrenders   before   the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">  B.A. No. 1070 of   2008        -: 4 :-<\/span><\/p>\n<p>Investigating Officer  or the learned Magistrate and seeks bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the   case,   the   learned   Magistrate   must   proceed   to   pass<\/p>\n<p>appropriate orders on merits and expeditiously.\n<\/p>\n<p id=\"p_10\">                                                             Sd\/-\n<\/p>\n<p id=\"p_11\">                                                (R.
