Siri Jagan, J.\n                 =-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=-=\n                       W.P(C) No. 16094 of 2010\n                 =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                  Dated this, the 4th day of June, 2010.\n\n                              J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner&#8217;s earth remover (JCB) has been seized by the<\/p>\n<p>revenue officials.     According to the petitioner, the same has been<\/p>\n<p>seized without any reason. The petitioner has therefore filed this writ<\/p>\n<p>petition seeking the following relief:\n<\/p>\n<p id=\"p_1\">\n<blockquote id=\"blockquote_1\"><p>      &#8220;Issue a writ of mandamus or any other appropriate writ, direction<br \/>\n      or order, directing the respondents 1, 2 &amp; 4 to release the JCB<br \/>\n      bearing No. KL-5\/L. 1303 owned by the petitioner in the interest<br \/>\n      of justice.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">\n<p id=\"p_3\">      2. The learned Government Pleader, on instructions, submits<\/p>\n<p>that the JCB has been seized on allegations of violation of the<\/p>\n<p>provisions of the Kerala Conservation of Paddy Land and Wet Land<\/p>\n<p>Act, 2008 and proceedings are pending before the District Collector.<\/p>\n<p id=\"p_4\">      3. I have considered the rival contentions in detail.<\/p>\n<p id=\"p_5\">      4. In view of the fact that proceedings under the Act are in<\/p>\n<p>progress, I am not inclined to interfere with the proceedings.<\/p>\n<p>However, naturally, the District Collector would take some time to<\/p>\n<p>pass final orders in the matter, after affording an opportunity of being<\/p>\n<p>heard to the petitioner. In the meanwhile, the JCB is being kept in the<\/p>\n<p>open subject to the vagaries of nature. In the case of proceedings<\/p>\n<p>under the Kerala Protection of River Banks and Regulation of Removal<\/p>\n<p>of Sand Act, 2001, this Court             has in     <a href=\"\/doc\/318558\/\" id=\"a_1\">District Collector,<\/p>\n<p>Malappuram v. Abdul Kasim<\/a>, 2010 (1) KLT S.N. 31 (Case No. 38)<\/p>\n<p>laid down the principles regarding interim custody of the vehicle.<\/p>\n<p>I am satisfied that in this case also, the same course of action can be<\/p>\n<p>taken.    The petitioner has already submitted Ext. P3 application for<\/p>\n<p>interim custody.      In the above circumstances, the writ petition is<\/p>\n<p>disposed of as follows:\n<\/p>\n<p id=\"p_6\"><span class=\"hidden_text\" id=\"span_1\">W.P.C. No. 16094\/2010.          -: 2 :-<\/span><\/p>\n<p id=\"p_7\">      The petitioner shall appear before the District Collector on<\/p>\n<p>11-6-2010.     On that day, the District Collector shall hear the<\/p>\n<p>petitioner on the question of interim custody and pass appropriate<\/p>\n<p>orders thereon in accordance with the principles laid down in the<\/p>\n<p>above said decision. Orders shall be passed within another week.<\/p>\n<p id=\"p_8\">                                    Sd\/- S.
