HEMA, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 6627 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 24th day of November,2008\n\n                                  O R D E R\n<\/pre>\n<p id=\"p_1\">       Petition for anticipatory bail.\n<\/p>\n<p id=\"p_1\">       2. The alleged offences are under sections 342, 506(2),<\/p>\n<p>377, 323, 324 read with <a href=\"\/doc\/37788\/\" id=\"a_1\">section 34<\/a> IPC.                           According to<\/p>\n<p>prosecution, de facto complainant and his friend were travelling<\/p>\n<p>in a car. When they stopped the car for urination, the accused<\/p>\n<p>came there and first accused showed a weapon and compelled<\/p>\n<p>de facto complainant to have sex with him. When he refused, he<\/p>\n<p>was assaulted. Thereafter, accused 1 and 2 committed unnatural<\/p>\n<p>offence with de facto complainant. The other person was also<\/p>\n<p>assaulted by all the accused.\n<\/p>\n<p id=\"p_2\">       3. Learned counsel for petitioners submitted that                   the<\/p>\n<p>incident did not occur, as alleged. Petitioners are accused 1 and<\/p>\n<p id=\"p_3\">2. The 1st accused came to close the gate in his compound, while<\/p>\n<p>he found some persons outside the gate being engaged in homo<\/p>\n<p>sexual activities. The 1st accused caught hold of one of them. But<\/p>\n<p>a group of people came there from the mosque at that time and,<\/p>\n<p>without knowing the actual facts started attacking petitioners.<\/p>\n<p>They also pelted stones of the house of the 1st accused.<\/p>\n<p>Petitioners are absolutely innocent of the allegations made, it is<\/p>\n<p>submitted.\n<\/p>\n<p id=\"p_4\">BA 6627\/08                          -2-\n<\/p>\n<p id=\"p_5\">       4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that this is a clear case where accused 1 and 3 had<\/p>\n<p>committed unnatural offence on de facto complainant and he and<\/p>\n<p>his friend were also assaulted by them. The 3rd accused also<\/p>\n<p>threatened de facto complainant and his friend.<\/p>\n<p id=\"p_6\">       5. On hearing both sides, considering the nature of<\/p>\n<p>allegations made, I find that it is not a fit case to grant<\/p>\n<p>anticipatory bail. The crime was registered as early as on 26-9-<\/p>\n<p>2008 and petitioners are not co-operate with the investigation.<\/p>\n<p id=\"p_7\">             Petitioners are directed to surrender before<\/p>\n<p>       the Investigating Officer without any delay and co-<\/p>\n<p>       operate    with   the     investigation.
