Akhilesh Gupta\n\nName of the Public Authority:         O\/o the Official Liquidator\n\nFacts<\/pre>\n<p id=\"p_1\">: i<\/p>\n<p id=\"p_1\">1.     The appellant has submitted three separate appeals in respect of his<br \/>\ndifferent RTI applications on an identical issue of accessing certain information<br \/>\npertaining to Companies in liquidation. All the appeals are examined together.<br \/>\nThe appeals were heard on 20\/7\/2010. While the respondents appeared for<br \/>\nhearing on the scheduled time, the appellant reported for hearing after the<br \/>\nrespondents had left the Commission.\n<\/p>\n<p id=\"p_2\">2.       In the course of hearing, the details of information asked for and the<br \/>\nappellant&#8217;s grievances regarding access to information were discussed. The<br \/>\nrespondents stated that as per the direction of this Commission wide decision<br \/>\nnotice No.4688\/IC(A)\/2009 dated 11\/11\/2009 the appellant was allowed<br \/>\ninspection of the relevant records and the desired documents were furnished on<br \/>\nthe basis of available records. The CPIO stated that the information asked for by<br \/>\nthe appellant relate to companies in liquidation and the information pertains to<br \/>\nthe activities of the companies which committed irregularities leading to the<br \/>\ninitiation of liquidation process.\n<\/p>\n<p id=\"p_3\">3.      He also stated that in view of the large number of cases over 6000 relating<br \/>\nto liquidation of companies and inadequate supporting staff, the records have not<br \/>\nbeen arranged as per the expectations of the appellant. The documents asked<br \/>\nfor by the appellant largely relate to the identified companies which have not<br \/>\nsubmitted the documents to the respondent and therefore the information asked<br \/>\nfor by the appellant are not available with the Office of the respondent. And,<br \/>\ntherefore, the same could not be furnished.\n<\/p>\n<p id=\"p_4\">                 i<br \/>\n                     &#8220;If you don&#8217;t ask, you don&#8217;t get.&#8221; &#8211; Mahatma Gandhi<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                             1<\/span>\n<\/p>\n<p id=\"p_5\"> 4.       The appellant alleged that it was not possible for him to lay his hand on<br \/>\nthe required documents mainly because the records as maintained with the<br \/>\nrespondent are mixed up. The records are not properly indexed and arranged to<br \/>\nfacilitate easy access to the information.\n<\/p>\n<p id=\"p_6\">5.     The CPIO also stated that the information asked for relate to certain<br \/>\ndisputed matters and the Court is duly seized of the issues raised by the<br \/>\nappellant. There is, therefore, no justification for resorting to forum hunting, in<br \/>\nthe garb of seeking information, to put undue pressure on the respondent for<br \/>\nseeking redressal of grievances regarding liquidation of the companies in<br \/>\nquestion.\n<\/p>\n<p id=\"p_7\">Decision:\n<\/p>\n<p id=\"p_8\">6.     The CPIO has assured to make sincere attempts to properly classify and<br \/>\narrange the records and files so as to facilitate the process for accessing<br \/>\ninformation held by the respondent. Through his different RTI applications, the<br \/>\nappellant has not specified as per section 2(f) of the Act, as to which information<br \/>\nhas been refused to him. He seems to have sought for expression of opinion in<br \/>\nrespect of the on-going Court proceedings in respect of liquidation of companies.<br \/>\nAs the appellant has already inspected the relevant records as per the<br \/>\nCommission&#8217;s direction under decision notice no.4688\/IC(A)\/2009 dated<br \/>\n11\/11\/2009 and that the CPIO has agreed to allow access to further information<br \/>\nin the matter, if required, there is no justification for raising issues before this<br \/>\nCommission. More so because the information pertain to companies, which are<br \/>\nfacing liquidation due to irregularities committed by them.\n<\/p>\n<p id=\"p_9\">7.      Since the matter is already before the Court, it may not be proper for us to<br \/>\ninterfere in the matter.\n<\/p>\n<p id=\"p_10\">8.     As there is no denial of information u\/s 8(1) of the Act, and that the<br \/>\nappellant has already been allowed unrestricted inspection of records, the<br \/>\nappeals are considered unnecessary and all the appeals are thus disposed of.\n<\/p>\n<p id=\"p_11\">                                                                            Sd\/-\n<\/p>\n<p id=\"p_12\">                                                                      (Prof. M.M.
