RATHOD, MR GK RATHOD for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/07\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the judgment and award passed by the Industrial Tribunal,<br \/>\nNadiad in Reference (ITN) No.489\/1998 dated 26.06.2001, whereby, the<br \/>\nreference of the respondent was allowed and the petitioner has been<br \/>\ndirected to treat the respondent as a Clerk and to give him the<br \/>\npay-scale of Clerk and other related benefits from 07.07.1995 and the<br \/>\nperiod between the date of appointment to 06.07.1995 was directed to<br \/>\nbe treated as notional.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\nfacts in brief are that the respondent was discharging the duties of<br \/>\na Clerk at the Borsad Depot of the petitioner-Corporation. In<br \/>\npursuance of the death of his father, who was serving as a Conductor<br \/>\nwith the petitioner-Corporation, the respondent applied for<br \/>\ncompassionate appointment on the post of Clerk. After following due<br \/>\nprocedure of recruitment, the competent authority of the<br \/>\npetitioner-Corporation issued the order dated 31.07.1976 to the<br \/>\nrespondent informing that the respondent has been placed at Sr. No.1<br \/>\nof the merit list of candidates to be appointed as Clerk. However,<br \/>\nsubsequently, the respondent was issued another order informing that<br \/>\nhe has been appointed on the post of Helper.\n<\/p>\n<p id=\"p_2\">3.\tBeing<br \/>\naggrieved by the aforesaid action, the respondent raised a dispute,<br \/>\nwhich, ultimately, culminated into a reference before the Labour<br \/>\nCourt. The Labour Court, after considering the evidence on record,<br \/>\nallowed the same. Hence, this petition.\n<\/p>\n<p id=\"p_3\">4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. After appreciating the evidence on record, more<br \/>\nparticularly, the documentary evidence which were produced vide<br \/>\nEx.17, the Court below found that the respondent was discharging the<br \/>\nduties of a Clerk at the relevant time. The case of the petitioner<br \/>\nthat the respondent was working as a Helper and not as a Clerk did<br \/>\nnot weigh with the Court below on account of the fact that no<br \/>\ndocumentary evidence was produced by the petitioner to show that the<br \/>\nrespondent was working as a Helper at the relevant time. In fact, it<br \/>\nappears that the respondent was being exploited inasmuch as he was<br \/>\ndoing the work of a Clerk but, was paid the salary of a Helper.\n<\/p>\n<p id=\"p_4\">5.\tThe<br \/>\nfact that the respondent had cleared the exams for being appointed as<br \/>\na Clerk is not in dispute. However, on flimsy grounds, his<br \/>\nappointment has been with-held. Looking to the facts and<br \/>\ncircumstances of the case and the discussion herein above, the<br \/>\npetitioner-Corporation was completely unjustified in denying the<br \/>\nbenefit of the post of Clerk to the respondent. I am in complete<br \/>\nagreement with the reasonings given by and the findings arrived at by<br \/>\nthe Court below in the impugned award and hence, find no reasons to<br \/>\ninterfere with the same.\n<\/p>\n<p id=\"p_5\">6.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed.
