Sidhu, Deputy Advocate General, Punjab.\n<\/p>\n<p id=\"p_1\">Rajesh Bindal J.\n<\/p>\n<p id=\"p_2\">             Indian Oil Corporation Limited is in appeal before this court<br \/>\nagainst the award of the learned court below passed under <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section 18<\/a> of the<br \/>\nLand    Acquisition Act, 1894 (for short, &#8216;the Act&#8217;) seeking reduction of<br \/>\ncompensation awarded to the landowners for the acquired land.\n<\/p>\n<p id=\"p_3\">             Briefly, the facts are that land measuring 421 kanals and 4<br \/>\nmarlas, situated in the revenue estate of village Suchi Pind was acquired<br \/>\nvide notification dated 2.1.1985 issued under <a href=\"\/doc\/43654\/\" id=\"a_1\">Section 4<\/a> of the Act for<br \/>\nsetting up of LPG Bottling Plant by Indian Oil Corporation. Similarly, vide<br \/>\nsame notification, land measuring 72 kanals and 6 marlas was acquired for<br \/>\nthe same purpose forming part of revenue estate of Villages Chak Hussaina<br \/>\nand Lamba Pind, Tehsil &amp; District Jalandhar. The Land Acquisition<br \/>\nCollector assessed the market value of the acquired land at Rs. 92,515\/- per<br \/>\nacre for Chahi even land; Rs. 74,000\/- per acre for Chahi uneven land and<br \/>\nRs. 23,120\/- per acre for Gair Mumkin kind of land. Aggrieved against the<br \/>\nsame, the land owners filed objections which were referred to the learned<br \/>\ncourt below, who keeping in view the material placed on record by the<br \/>\nparties, determined fair value @ Rs. 1,10,000\/- per acre for Chahi even and<br \/>\nGair Mumkin kind of land and Rs. 88,000\/- per acre for Chahi uneven kind<br \/>\nof land in both the villages.\n<\/p>\n<p id=\"p_4\">             Learned counsel for the State very fairly submitted that the<br \/>\nissue raised in the present appeal is squarely covered by the judgment of<br \/>\nthis Court in RFA No. 2700 of 1998- Surjan Singh and others vs State of<br \/>\n             RFA No. 1654 of 1999                               (2)<\/p>\n<p>Punjab and others decided on 20.4.2009, whereby the compensation<br \/>\npayable for acquisition of land vide same notification has been further<br \/>\nenhanced.\n<\/p>\n<p id=\"p_5\">            Since this court has further enhanced the compensation payable<br \/>\nto the landowners in Surjan Singh&#8217;s case (supra), the present appeal filed by<br \/>\nthe Indian Oil Corporation for reduction does not survive.
