Heard learned counsel for the petitioner and learned<\/p>\n<p>                   counsel for the respondents.\n<\/p>\n<p>                                  2. This writ petition has been filed by the petitioner for the<\/p>\n<p>                   following reliefs:-\n<\/p>\n<blockquote><p>                             a)      Direction to the respondents to dispose of the<br \/>\n                                     tender matter to carry mails Hazipur to<br \/>\n                                     Vaisali within a week pending since<br \/>\n                                     21.09.2004 in violation to Hon&#8217;ble Court<br \/>\n                                     order dated 14.07.2004 to dispose of the<br \/>\n                                     tender matter within two weeks from the<br \/>\n                                     date of order.\n<\/p><\/blockquote>\n<blockquote><p>                             b)      Contempt against the defaulters for not<br \/>\n                                     complying the order of Hon&#8217;ble Court dated<br \/>\n                                     14.07.2004.\n<\/p><\/blockquote>\n<blockquote><p>                             c)      Deduction of payments made to the carrying<br \/>\n                                     mail contractor Mr. Vijay Nair from the<br \/>\n                                     Salary of Chief Post Master, Bihar Circle<br \/>\n                                     Patna, Assistant Director Mails and<br \/>\n                                     Superintendent of Post Officers, Hazipur,<br \/>\n                                     who did not comply the order of Hon&#8217;ble<br \/>\n                                     Court to dispose of the tender matter within<br \/>\n                                     two months and continued to the get the<br \/>\n                                     mail carried through Mr. Vijay Nair for the<br \/>\n                                     last 13 months @ 850\/- per month, when the<br \/>\n                                     other tenders were of lower rate for one to<br \/>\n                                     two thousand monthly.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                       2<\/span><\/p>\n<p>              3. From the facts and circumstances of this case and from<\/p>\n<p>the argument of learned counsel for the parties, it transpires that<\/p>\n<p>originally the allotment of tender was made in favour of the petitioner<\/p>\n<p>for conveyance of mails by small three wheeler vehicles between<\/p>\n<p>Hajipur to Vaishali with up and down journey throughout the year on a<\/p>\n<p>monthly remuneration for three years.\n<\/p>\n<p>              4. The said allotment in favour of petitioner was<\/p>\n<p>challenged by one Mahim Narain Singh vide C.W.J.C. No. 3531 of<\/p>\n<p>2002, which was disposed of by a Bench of this Court on 14.07.2004<\/p>\n<p>(Annexure-1) with a direction that the Chief Post Master General, Patna<\/p>\n<p>shall invite fresh tender in which the petitioner and the said objector<\/p>\n<p>may also participate and their cases shall be considered along with<\/p>\n<p>other tenders without being prejudiced by any action of the authority or<\/p>\n<p>any order passed by this Court in the present case, which must be done<\/p>\n<p>within two months.\n<\/p>\n<p>              5. The grievance of the petitioner is that although two<\/p>\n<p>months time was granted by the said order but the petitioner was never<\/p>\n<p>informed what had happened with regard to said tender and hence the<\/p>\n<p>said order of this Court has been violated.\n<\/p>\n<p>              6. There is nothing to show what had happened thereafter.<\/p>\n<p>Neither the petitioner has brought on record any step taken by the<\/p>\n<p>authorities in that regard nor he had filed any petition before this Court<\/p>\n<p>for initiating a proceeding of contempt against the respondents<\/p>\n<p>authorities for violating the said order dated 14.07.2004 passed in<\/p>\n<p>C.W.J.C. No. 3531 of 2002.\n<\/p>\n<p>              7. Furthermore, it is quite apparent that the allotment was<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>        only for three years and several three years have lapsed since 2004 and<\/p>\n<p>        no interim order had also been passed in this writ petition.<\/p>\n<p>                      8. Accordingly, this Court finds that the writ petition has<\/p>\n<p>        become infructuous and is accordingly disposed of.<\/p>\n<p>                                            (S.N.
