JUSTICE SUNIL HALI, JUDGE.       \nDate: 01.01.2010 \n:J U D G M E N T :\n<\/pre>\n<p id=\"p_1\">This Criminal Revision has been filed against order dated<br \/>\n17.10.2006 passed by learned Additional Sessions Judge,<br \/>\nRamban, whereby the respondents have been directed to be<br \/>\ntried under Sections 323\/325\/326\/341\/34 RPC, holding that no<br \/>\noffence under Section 307 RPC is made out against them. The<br \/>\nChallan, accordingly, has been directed to be transferred to the<br \/>\nCourt of Munsiff, Judicial Magistrate Ist Class, Ramban, for<br \/>\ndisposal of the case under law.\n<\/p>\n<p id=\"p_1\">Mr. Sethi, learned Senior counsel, appearing for the<br \/>\npetitioner submits that the petitioner, who is an employee of the<br \/>\nForest Department, while on his way to attend his official duty<br \/>\n<span class=\"hidden_text\" id=\"span_1\">2<\/span><br \/>\non 11th of July, 2006, was attacked by the respondents with iron<br \/>\nrods and lathies. This was with a criminal intention to kill the<br \/>\npetitioner as there was some old enmity between the parties<br \/>\nwith regard to a piece of land. It is stated that on account of the<br \/>\nsaid attack the petitioner sustained multiple injuries and<br \/>\nremained hospitalized for about three weeks and underwent a<br \/>\nsurgery also. In this regard, reliance has been placed on the<br \/>\nmedical certificate issued by the Registrar, Surgical Unit-6,<br \/>\nSMHS Hospital Srinagar, copy whereof has been placed on<br \/>\nrecord.\n<\/p>\n<p id=\"p_2\">It is further stated that Challan against the respondents<br \/>\nwas filed before the Court of learned Additional Sessions Judge<br \/>\nRamban, under Sections 307\/323\/325\/345 RPC but the learned<br \/>\nCourt, without appreciating the facts and the nature of injuries,<br \/>\nas reflected in the medical certificate issued by the authority<br \/>\nconcerned, has committed a legal error in discharging the<br \/>\nrespondents for offence under Section 307 RPC by order<br \/>\nimpugned. It is stated that while framing the charge, the learned<br \/>\ntrial Court should not have only relied upon the opinion of the<br \/>\ndoctor regarding sufficiency of the injuries to cause death but<br \/>\nshould have also taken into consideration the evidence and<br \/>\ncircumstances which only suggested that the intention of the<br \/>\nrespondents was to kill the petitioner.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">3<\/span><\/p>\n<p id=\"p_3\">I have heard the learned counsel for the parties.<br \/>\nIt is not in dispute that while framing charge if there is<br \/>\nreasonable suspicion that the accused has committed the<br \/>\noffence, than he is required to be put to trial. However, the<br \/>\ncourts will not act as Post Office. It is required to peruse the<br \/>\nrecord and come to a prima facie opinion that there are<br \/>\nsufficient grounds for framing the charge against the accused.<br \/>\nThe case of the petitioner is that the trial Court has discharged<br \/>\nthe accused under Section 307 RPC solely on the basis of the<br \/>\nreport of the doctor who has examined the petitionercomplainant<br \/>\nand has not taken into consideration the<br \/>\ncircumstantial evidence which suggested that intention of the<br \/>\nrespondents was to kill the complainant. There is no dispute<br \/>\nthat the statements of the eye witnesses cannot be over looked<br \/>\nby relying exclusively on the report of the expert evidence.<br \/>\nHowever, the nature of the injuries which are inflicted on the<br \/>\nbody of the complainant can only be confirmed by the medical<br \/>\nevidence. The nature of the injuries will reveal the weapon of<br \/>\noffence used which can only be gathered from the injuries<br \/>\nwhich have been inflicted on the complainant.<br \/>\nIn the present case the trial Court has, after examining<br \/>\nthe report of the doctor, discharged the accused persons for<br \/>\noffence under Sections 307 RPC and charged them under<br \/>\n<span class=\"hidden_text\" id=\"span_2\">4<\/span><br \/>\nSections 323\/325\/326\/341\/34 RPC. According to the report of<br \/>\nthe doctor, injuries no. 1 to 5 are simple in nature whereas<br \/>\ninjury no. 6 is grievous injury.\n<\/p>\n<p id=\"p_4\">I, therefore, do not find any reason to interfere with the<br \/>\nwell reasoned order of the trial Court.\n<\/p>\n<p id=\"p_5\">The revision petition has no force.
