Chundawat, for the petitioner<\/p>\n<p>None present for respondents<\/p>\n<p>       Though the petitioner has claimed for assigning<\/p>\n<p>seniority to him in the cadre of Lower Division Clerks<\/p>\n<p>with   effect    from   20th    April,         1978,   however,      during<\/p>\n<p>course    of    arguments       he     confined        his     claim      for<\/p>\n<p>reckoning his seniority with effect from 20th April,<\/p>\n<p>1980, the day on which he was selected on regular<\/p>\n<p>basis for appointment as Lower Division Clerk.<\/p>\n<p id=\"p_4\">       The factual matrix necessary for adjudication of<\/p>\n<p>instant    petition     for     writ      is    that    the    petitioner<br \/>\n                                    SBCWP No.1782\/96 &#8211; Kanti Lal Ojha v. State &amp; ors<br \/>\n                                                       Date of Order: 16.02.2009<br \/>\n                                                                             2 of 6<\/p>\n<p>entered in the service of the Agriculture Marketing<\/p>\n<p>Committee,      Krishi         Upaj     Mandi        Samiti,    Rani       on   20th<\/p>\n<p>April, 1978, on daily rate basis. The respondent Mandi<\/p>\n<p>Samiti    allowed        regular      pay      scale     to    the    petitioner<\/p>\n<p>with effect from 02nd August, 1978, however, the same<\/p>\n<p>was withdrawn subsequent to 31st March, 1979.<\/p>\n<p id=\"p_5\">       The    respondent         Rajasthan           Agriculture       Marketing<\/p>\n<p>Board,       Jaipur      initiated       process         of    selection        for<\/p>\n<p>appointment         to   the     posts    of     Lower      Division       Clerks\/<\/p>\n<p>Auction       Clerks\/Auctioneers               in     different        Marketing<\/p>\n<p>Committees          in   the      State         of    Rajasthan           and   the<\/p>\n<p>petitioner,         while    working       on    daily       rate    basis      with<\/p>\n<p>Krishi       Upaj    Mandi       Samiti,       Rani;     faced       process      of<\/p>\n<p>selection, result of which was declared subsequently.<\/p>\n<p>Under an order dated 24th October, 1980, the Director<\/p>\n<p>(Agriculture Marketing), Rajasthan, Jaipur instructed<\/p>\n<p>the Secretary, Krishi Upaj Mandi Samiti, Rani to issue<\/p>\n<p>necessary       order       of    appointment          in     favour       of   the<\/p>\n<p>petitioner      and      two     other    persons,          namely    &#8211;    Messers<\/p>\n<p>Madan    Singh       Purohit      and     Prem        Prakash       Pareek.     The<\/p>\n<p>Director (Agriculture Marketing), in the order dated<\/p>\n<p>24th October, 1980, in quite unambiguous terms stated<\/p>\n<p>that     selections         of    the    petitioner           and     other     two<\/p>\n<p>persons referred in the order concerned was as per<\/p>\n<p>provisions of clause (b) of sub-rule (6) of rule 64-I<\/p>\n<p>of      the     Rajasthan          Agriculture              Produce        Markets<\/p>\n<p>(Marketing Committee Employees&#8217; Service) Rules, 1975.\n<\/p>\n<p id=\"p_6\">                                        SBCWP No.1782\/96 &#8211; Kanti Lal Ojha v. State &amp; ors<br \/>\n                                                           Date of Order: 16.02.2009<br \/>\n                                                                                 3 of 6<\/p>\n<p>       Though           petitioner           was       continuing         with        the<\/p>\n<p>respondents             on     daily       rate        basis,      no     order        of<\/p>\n<p>appointment in terms of order dated 24th of October,<\/p>\n<p>1980 was issued for a pretty long time, that is up to<\/p>\n<p>the    month       of        November,       1981.      The     petitioner          then<\/p>\n<p>submitted      a        formal       joining       report     on   01st   December,<\/p>\n<p>1981. A seniority list subsequent thereto was issued<\/p>\n<p>on     19th    June,           1984     by     the         Assistant       Director,<\/p>\n<p>Agriculture         Marketing          Department,            Jodhpur;        treating<\/p>\n<p>the petitioner a regular employee with effect from 01st<\/p>\n<p>December,          1981.       Being       aggrieved          by   the        same,     a<\/p>\n<p>petition for writ was filed by the petitioner and that<\/p>\n<p>came    to    be        decided       on     25th      october,     1994       with     a<\/p>\n<p>direction          to        respondents          to    consider        and     decide<\/p>\n<p>representation, if any submitted by the petitioner,<\/p>\n<p>claiming      seniority.             The     representation         submitted          by<br \/>\nthe petitioner came to be disposed of by the Director<\/p>\n<p>(Agriculture Marketing), Rajasthan on 15th May, 1995.<\/p>\n<p>Being aggrieved by the same, this petition for writ is<\/p>\n<p>preferred.\n<\/p>\n<p id=\"p_7\">       It     is    contended           by     learned        counsel         for     the<\/p>\n<p>petitioner that the petitioner, as a matter of fact,<\/p>\n<p>is in continuous employment of the respondents since<\/p>\n<p>20th April, 1978 and while in service, he was regularly<\/p>\n<p>appointed       with          effect       from     24th    October,      1980        and<\/p>\n<p>therefore,         there        is    no     valid      reason     for     assigning<\/p>\n<p>seniority to him in the cadre of Lower Division Clerks<\/p>\n<p>with effect from 01st December, 1981.\n<\/p>\n<p id=\"p_8\">                                 SBCWP No.1782\/96 &#8211; Kanti Lal Ojha v. State &amp; ors<br \/>\n                                                    Date of Order: 16.02.2009<br \/>\n                                                                          4 of 6<\/p>\n<p>      In reply to the writ petition, stand taken by the<\/p>\n<p>respondents is that though selection of the petitioner<\/p>\n<p>was made for appointment as Lower Division Clerk on<\/p>\n<p>24th October, 1980 but the order of appointment was<\/p>\n<p>made on 01st December, 1981 and as such, his seniority<\/p>\n<p>has   been   rightly      reckoned         under   the    seniority      list<\/p>\n<p>dated 19th June, 1984.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">      Heard learned counsel for the petitioner.<\/p>\n<p>      From perusal of the averments contended in the<\/p>\n<p>writ petition and also reply to the writ petition, it<\/p>\n<p>is    apparent     that       the        petitioner      is    continuously<\/p>\n<p>working with the respondents as Lower Division Clerk<\/p>\n<p>since 20th April, 1978. Regular pay scale, at the first<\/p>\n<p>instance,    was      awarded       to    him   with    effect    from     02nd<br \/>\nAugust, 1978 but that was withdrawn with effect from<\/p>\n<p>31st March, 1979. Be that as it may, while working as<\/p>\n<p>Lower Division Clerk on daily rate basis, petitioner<\/p>\n<p>faced a process of selection and stood selected for<\/p>\n<p>appointment as Lower Division Clerk on 24th October,<\/p>\n<p>1980.   True     it    is,    that        the   order     of   appointment<\/p>\n<p>consequent to selection made on 24th October, 1980 was<\/p>\n<p>issued in the month of November, 1981 and petitioner<\/p>\n<p>formally     joined      as     Lower       Division      Clerk     on     01st<\/p>\n<p>December, 1981; but fresh joining of petitioner was<\/p>\n<p>nothing but a formality as he was already continuing<\/p>\n<p>in the service of respondents. State &amp; ors<br \/>\n                                                         Date of Order: 16.02.2009<br \/>\n                                                                               5 of 6<\/p>\n<p>selected as Lower Division Clerk under order dated 24th<\/p>\n<p>October, 1980, there was no reason for detaining the<\/p>\n<p>order of appointment for a period of more than one<\/p>\n<p>year. As a matter of fact, on the date of selection,<\/p>\n<p>petitioner was already working with the respondents as<\/p>\n<p>Lower Division Clerk and therefore, his joining on the<\/p>\n<p>post    concerned        should       have     been     treated     on     regular<\/p>\n<p>basis    on      that    day     itself      i.e.       24th   October,       1980.<\/p>\n<p>Issuance of order of appointment after selection of<\/p>\n<p>petitioner        was    only    a     ministerial         act   and       for   any<\/p>\n<p>delay in completing ministerial act, the petitioner<\/p>\n<p>could    have     not     been    deprived         of    seniority         for   the<\/p>\n<p>period      he   was     working        with    respondents         in     regular<\/p>\n<p>capacity.\n<\/p>\n<p id=\"p_11\">       In view of whatever stated above, petitioner is<\/p>\n<p>certainly entitled to get his seniority reckoned with<\/p>\n<p>effect from 24th October, 1980, the day on which he was<\/p>\n<p>selected as Lower Division Clerk while working on the<\/p>\n<p>same post.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">       Accordingly, the petition for writ is allowed. The<\/p>\n<p>order dated 15th May, 1995 denying seniority to the<\/p>\n<p>petitioner        with    effect        from     24th     October,       1980     is<\/p>\n<p>declared illegal. Seniority list dated 19th June, 1984<\/p>\n<p>is   also     declared        illegal      to    the     extent     it     reckons<\/p>\n<p>seniority        of     the    petitioner        with      effect      from      01st<\/p>\n<p>December,        1981.    Respondents           are     directed      to    reckon<\/p>\n<p>seniority of the petitioner as Lower Division Clerk<br \/>\n                         SBCWP No.1782\/96 &#8211; Kanti Lal Ojha v.
