CJ. &amp; P.B HAVADASAN, J.\n                 - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                       WRIT APPEAL No.2873 of 2007\n                     - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                    Dated this the 9th day of February, 2009.\n\n                                       JUDGMENT\n<\/pre>\n<p id=\"p_1\">KOSHY, Ag.CJ,<\/p>\n<p>            The writ petitioner along with 54 others approached the<\/p>\n<p>Labour Court by filing a petition under <a href=\"\/doc\/483633\/\" id=\"a_1\">Section 33C(2)<\/a> of the Industrial<\/p>\n<p>Disputes Act seeking monetary benefits contending that the first<\/p>\n<p>respondent establishment, in which they were employed, was closed<\/p>\n<p>down and their services were terminated violating the provisions of<\/p>\n<p>Section 25 N, 25 O etc. The respondent management contended that<\/p>\n<p>during the pendency of the above claim petition, the disputes were settled.<\/p>\n<p>The Labour Court found that whether there was an illegal closure and<\/p>\n<p>whether Section 25 O is attracted etc., can be decided only by<\/p>\n<p>adjudication raised in an industrial dispute and not under Section 33 C(2)<\/p>\n<p>petition.\n<\/p>\n<p id=\"p_1\">            2. There was a conciliation and settlement which was signed<\/p>\n<p>by the Management, Union and the Labour Officer regarding the issue<\/p>\n<p>(marked as Exts.P17 and R1 before the Labour Court) and it is contended<\/p>\n<p>that the petitioners already received the amount as per the settlement.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WA. 2873\/2007                         2<\/span><\/p>\n<p>Management produced the         receipts to show that the petitioners had<\/p>\n<p>received the amount (Ext.R2 marked before the Labour Court). In the<\/p>\n<p>above circumstances, the Labour Court rejected the claim petition. The<\/p>\n<p>learned Single Judge endorsed the above view.<\/p>\n<p id=\"p_2\">             3.  Proceedings under <a href=\"\/doc\/759209\/\" id=\"a_1\">Section 33C<\/a> (2) is in the nature of<\/p>\n<p>execution proceedings. The rights have to be adjudicated by award in an<\/p>\n<p>industrial dispute or by settlements or by service conditions. If adjudicated,<\/p>\n<p>pre-existing rights are not given, the workman can file application under<\/p>\n<p><a href=\"\/doc\/759209\/\" id=\"a_2\">Section 33C<\/a> (2) to get the amounts computed by the Labour Court and<\/p>\n<p>realise the same. Since the right to get the amount cannot be adjudicated in<\/p>\n<p>a claim petition and the petitioner herein had received the amount in<\/p>\n<p>pursuance of the settlement, we are of the view that no interference is called<\/p>\n<p>for with the impugned judgment.\n<\/p>\n<p id=\"p_3\">             The Writ Appeal is dismissed.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                                       J.B.
