Chaurasia,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for petitioner, learned Standing<br \/>\nCounsel, Sri Q. M. Haq, learned counsel for opposite party<br \/>\nno.2 and perused the record.\n<\/p>\n<p id=\"p_1\">This writ petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of<br \/>\nIndia has been filed with the prayer that a writ, order or<br \/>\ndirection in the nature of Certiorari may be issued quashing<br \/>\nthe impugned judgment and order dated 23.03.2009 passed<br \/>\nby opposite party no.1 in Civil Revision No. 21 of 2007,<br \/>\ncontained as Annexure No.1 to the writ petition.<br \/>\nLearned counsel for petitioner has submitted that the<br \/>\napplication under Order 9, Rule 7 C.P.C. was moved on<br \/>\nbehalf of defendants for setting aside the exparte order dated<br \/>\n27.04.1991 and after hearing both the parties, said application<br \/>\nwas allowed vide order dated 30.11.2006 and the exparte<br \/>\norder against the defendant no.2 was set aside, but, it was<br \/>\ndirected that the proceedings against the defendant no.4 shall<br \/>\ncontinue exparte. Feeling aggrieved by the said order dated<br \/>\n30.11.2006 passed by learned Civil Judge, Biswa, Sitapur,<br \/>\nplaintiff Jai Pal Singh filed the Civil Revision No. 21 of 2007<br \/>\nin the Court of District Judge, which was ultimately disposed<br \/>\nof by Additional District Judge, Court No. 9, Sitapur vide<br \/>\norder dated 23.03.2009 and the revision was allowed and the<br \/>\nimpugned order dated 30.11.2006 was set aside. His<br \/>\ncontention is that the revisional Court has committed<br \/>\nillegality in exercise of its jurisdiction by setting aside the<br \/>\norder dated 30.11.2006 and hence, the impugned order<br \/>\ndeserves to be quashed.\n<\/p>\n<p id=\"p_2\">Learned counsel for opposite party no.2 has submitted that<br \/>\nthe order passed by the revisional Court is perfectly valid and<br \/>\ncalls for no interference.\n<\/p>\n<p id=\"p_3\">From the perusal of impugned order dated 30.11.2006, it<br \/>\n transpires that the learned trial Court has set aside the order<br \/>\ndated 27.04.1991 for proceeding exparte against the<br \/>\ndefendant no.2 on the ground that the order against her was<br \/>\npassed due to clerical mistake. Learned revisional Court has<br \/>\nset aside the impugned order dated 30.11.2006 on the ground<br \/>\nthat the said order has been written by the Presiding Officer<br \/>\nin his own hand-writing and, hence, the question of clerical<br \/>\nerror in the said order does not arise, but, the revisional Court<br \/>\nhas not directed the trial Court to dispose of the application<br \/>\nno. 61-C afresh ignoring its finding that the order was passed<br \/>\ndue to clerical error. Under the circumstances, it seems<br \/>\nexpedient in the interest of justice that the defendant&#8217;s<br \/>\napplication under Order 9, Rule 7 C.P.C. May be disposed of<br \/>\nby learned trial Court afresh in accordance with law.<br \/>\nThere was no need for the petitioner to challenge the order<br \/>\ndated 30.11.2006 passed by learned Civil Judge, Biswa,<br \/>\nSitapur as it was passed in his favour, but, since the order<br \/>\nagainst the defendant no.2 to proceed exparte was set aside on<br \/>\nthe ground of clerical error in the judicial order written by the<br \/>\nPresiding Officer in his own hand-writing, the order dated<br \/>\n30.11.2006 also deserves to be quashed.\n<\/p>\n<p id=\"p_4\">A writ of Certiorari is issued quashing the impugned<br \/>\njudgment and order dated 23.03.2009 passed by opposite<br \/>\nparty no.1 and the order dated 30.11.2006 passed by learned<br \/>\nCivil Judge, Biswa, Sitapur, contained as Annexure Nos. 7 &amp;<br \/>\n5 to the writ petition. The defendant&#8217;s application under Order<br \/>\n9, Rule 7 C.P.C., paper no. 61-C is remanded to the learned<br \/>\ntrial Court for disposal afresh in accordance with law, after<br \/>\nproviding reasonable opportunity of hearing to both the<br \/>\nparties, preferably within a period of two months from the<br \/>\ndate a certified copy of the order of this Court is filed in the<br \/>\nsaid Court.\n<\/p>\n<p id=\"p_5\">With these observations\/directions, the writ petition stands<br \/>\ndisposed of finally.\n<\/p>\n<p id=\"p_6\">Order Date :- 30.7.2010<br \/>\npsd\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Smt.
