{"id":27117,"date":"2009-10-30T00:00:00","date_gmt":"2009-10-29T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/rajni-and-another-vs-state-of-punjab-and-others-on-30-october-2009"},"modified":"2017-11-08T09:09:55","modified_gmt":"2017-11-08T03:39:55","slug":"rajni-and-another-vs-state-of-punjab-and-others-on-30-october-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/rajni-and-another-vs-state-of-punjab-and-others-on-30-october-2009","title":{"rendered":"Rajni And Another vs State Of Punjab And Others on 30 October, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Rajni And Another vs State Of Punjab And Others on 30 October, 2009<\/div>\n<pre>In the High Court for the States of Punjab and Haryana at Chandigarh.\n\n\n                CRM 55270 of 2009&amp;\n                CRM-M 30459 of 2009 (O&amp;M)\n                Decided on 30.10.2009.\n\n\n\n    Rajni and another                             -- Petitioners\n\n\n\n                        vs.\n\n    State of Punjab and others                    --Respondents.\n\n\n\n    CORAM: HON'BLE MR.JUSTICE RAKESH KUMAR JAIN\n\n\n    Present:    Mr. J.S.Dadwal,Advocate,for the petitioners\n    .\n<\/pre>\n<p>    Rakesh Kumar Jain, J: (Oral)<\/p>\n<p>                CRM 55270 of 2009<\/p>\n<p>                Allowed as prayed.\n<\/p>\n<p>                CRM-M 30459 of 2009<\/p>\n<p>                This is a petition under Section 482 of Code of Criminal<\/p>\n<p>    Procedure, 1973 (for short, &#8216;Cr.P.C.&#8217;) vide which the petitioners have<\/p>\n<p>    sought a direction from this Court to respondent Nos. 1 to 3 to protect<\/p>\n<p>    their lives and liberty which is alleged to have been threatened at the<\/p>\n<p>    hands of respondent Nos. 4 to 6 as they have got married against their<\/p>\n<p>    wishes.\n<\/p>\n<p>                It is averred in the petition that petitioner No.1 (Rajni) is<\/p>\n<p>    22 years old having been born on 19.07.1987 as per Identity Card<\/p>\n<p>    (Annexure P-6) whereas petitioner No.2 (Jaskaran Singh) is 26 years<\/p>\n<p>    old having been born on 11.8.1983 as per Middle Standard<\/p>\n<p>    Examination Certificate (Annexure P-2). It is alleged that they have<br \/>\n<span class=\"hidden_text\"> CRM-M 30459 of 2009                                      -2-<\/span><\/p>\n<p>solemnized their marriage on 25.10.2009 at Arya Samaj Mandir, Sector<\/p>\n<p>56, Palsora, Chandigarh, as per Marriage Certificate (Annexure P-4).<\/p>\n<p>Photographs of marriage are also appended as Annexure P-3. It is<\/p>\n<p>also alleged that they have moved an application (Annexure P-5) to<\/p>\n<p>S.S.P, Nawahshahr for the purpose of protection, but no action was<\/p>\n<p>taken.\n<\/p>\n<p>             Learned counsel for the petitioners submits that as the<\/p>\n<p>petitioners are from different castes and have married against the<\/p>\n<p>wishes of parents of petitioner No.1, therefore, they are apprehending<\/p>\n<p>danger to their lives and liberty. Learned counsel has cited Lata Singh<\/p>\n<p>Vs. State of U.P. and another (2006) 5 SCC 475, in which it is held<\/p>\n<p>that &#8221; Once a person becomes a major, he or she can marry whosoever<\/p>\n<p>he\/she likes. If the parents of the boy or girl do not approve of such<\/p>\n<p>inter-caste or inter-religious marriage, the maximum they can do is<\/p>\n<p>that they can cut off social relations with the son or the daughter, but<\/p>\n<p>they cannot give threats or commit or instigate acts of violence and<\/p>\n<p>cannot harass the person who undergoes such inter-caste or inter-<\/p>\n<p>religious marriage. We,therefore, direct that the administration\/police<\/p>\n<p>authorities throughout the country will see to it that if any boy or girl<\/p>\n<p>who is a major undergoes inter-caste or inter-religious marriage with<\/p>\n<p>a woman or man who is a major, the couple is not harassed by any<\/p>\n<p>one nor subjected to threats or acts of violence, and anyone who gives<\/p>\n<p>such threats or harasses or commits acts of violence either himself or<\/p>\n<p>at his instigation, is taken to task by instituting criminal proceedings<\/p>\n<p>by the police against such persons and further stern action is taken<\/p>\n<p>against such persons as provided by law&#8221;,<br \/>\n<span class=\"hidden_text\"> CRM-M 30459 of 2009                                       -3-<\/span><\/p>\n<p>             After hearing the learned counsel for the petitioners and<\/p>\n<p>considering the law laid down by the Apex Court, I allow this petition<\/p>\n<p>and direct respondent Nos. 1 to 3, in particular respondent No.2, to<\/p>\n<p>look into the representation (Annexure P-5) dated 26.10.2009, which is<\/p>\n<p>alleged to have been given by the petitioners to him for providing them<\/p>\n<p>adequate security to protect their lives and liberty at the hands of<\/p>\n<p>respondent Nos. 4 to 6 and in case any truth is found in their<\/p>\n<p>representation, police protection be provided to the petitioners.<\/p>\n<p>             With these directions, the petition stands disposed of.<\/p>\n<pre>30.10.2009                                       (Rakesh Kumar Jain)\nRR                                                         Judge\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Rajni And Another vs State Of Punjab And Others on 30 October, 2009 In the High Court for the States of Punjab and Haryana at Chandigarh.
