KRISHNAN, J.\n                  ...........................................\n                    C.R.P.NO.2980 OF 2000\n                 .............................................\n           Dated this the 5th day of January, 2011.\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">      This revision      is preferred against the order of the<\/p>\n<p>Subordinate Judge&#8217;s Court, Thodupuzha in E.A.No.92\/1997<\/p>\n<p>in E.P.No.195\/1989 in LAR.No.77\/1982. By an order the<\/p>\n<p>executing   court has stated that &#8220;the counsel has already<\/p>\n<p>calculated for a balance of Rs.88,159.13 with interest on<\/p>\n<p>25.11.1999.   Hence the petition is dismissed&#8221;. It was an<\/p>\n<p>application which was filed for determination of the amount<\/p>\n<p>by the Government.                The questions that             arise  for<\/p>\n<p>determination in the revision are (1) whether the claimant is<\/p>\n<p>entitled to get interest on solatium and (2) whether                    the<\/p>\n<p>amount claimed is correct or not.\n<\/p>\n<p id=\"p_1\">       2. At the outset       I may like to             say that both these<\/p>\n<p>questions are interlinked. The entitlement for interest on<\/p>\n<p>solatium has been laid down in <a href=\"\/doc\/1177203\/\" id=\"a_1\">Sunder v. Union of India<\/a><\/p>\n<p>reported in (2001 (3) KLT 489). In para 28 the Hon&#8217;ble<\/p>\n<p>Supreme Court held that &#8220;hence the person entitled to the<\/p>\n<p>compensation awarded is also entitled to get interest on the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                             : 2 :<\/span><br \/>\nC.R.P.NO.2980 OF 2000<\/p>\n<p>aggregate amount including solatium&#8221;.       Subsequently the<\/p>\n<p>matter again came up for consideration before the Hon&#8217;ble<\/p>\n<p>Supreme    Court of     India in the decision    reported in<\/p>\n<p><a href=\"\/doc\/1736128\/\" id=\"a_1\">Gurpreet Singh v. Union of India<\/a> (2006 (8) SCC 457) and<\/p>\n<p>the Supreme Court has held as follows:<\/p>\n<p id=\"p_2\">            &#8220;15. Order 21      Rule  1   provides   the<br \/>\n       modes of paying money under a decree. It<br \/>\n       stipulates that all monies payable under a<br \/>\n       decree shall be paid: (a) by deposit into the<br \/>\n       Court whose duty it is to execute the decree ,<br \/>\n       or (b) out of Court, to the decree-holder in<br \/>\n       the manner provided, or (c) otherwise, as the<br \/>\n       Court which made the decree directs. Sub-<br \/>\n       rule (2) provides that where a payment is<br \/>\n       made by deposit into the Court or as directed<br \/>\n       in the decree, the judgment-debtor shall give<br \/>\n       notice thereof    to the decree-holder    either<br \/>\n       through    the Court or directly to him by<br \/>\n       registered post acknowledgment due. On any<br \/>\n       amount paid by way of deposit into the Court<br \/>\n       or as directed under the decree, interest, if<br \/>\n       any, shall cease to run from the date of the<br \/>\n       service of the notice referred to in sub-rule<br \/>\n       (2).   Thus,   Order    21   Rule 1   after   its<br \/>\n       amendment        in    the year 1976        also<br \/>\n       contemplates      the deposit of the decree<br \/>\n       amount into Court and       the giving of notice<br \/>\n       thereof   to the decree-holder     and provides<br \/>\n       further for cessation of interest from the date<br \/>\n       of notice to the decree-holder of such deposit&#8221;.<\/p>\n<p id=\"p_3\">    3. A reading of the above said paragraph would revel<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                             : 3 :<\/span><br \/>\nC.R.P.NO.2980 OF 2000<\/p>\n<p>that in a case where solatium has been refused by the court<\/p>\n<p>and it has become final, the claimant will not be entitled to<\/p>\n<p>get any interest on solatium. Secondly when orders of the<\/p>\n<p>court are silent about the granting of solatium, it is<\/p>\n<p>permissible for the executing court to grant solatium, but it<\/p>\n<p>was held that in such cases it can be granted only from the<\/p>\n<p>date   of the  judgment    in  Sunder Singh case i.e., on<\/p>\n<p>19.9.2001.     So in a case where the court has granted<\/p>\n<p>interest on solatium by its award, the entitlement is as<\/p>\n<p>ordered and it is not restricted from the date of 19.9.2001.<\/p>\n<p>So this is a matter the court has to look into for the reason<\/p>\n<p>that this Court is not having a copy of the award regarding<\/p>\n<p>grant of interest on solatium on the original side. When it is<\/p>\n<p>worked out and if it is found that there is entitlement,<\/p>\n<p>necessarily the calculation done by the applicant has to be<\/p>\n<p>considered and    found whether the calculation is correct.<\/p>\n<p>So depends upon calculation regarding        the interest on<\/p>\n<p>solatium one can arrive at a correct amount that is due. It<\/p>\n<p>is only on that basis the   Government has challenged the<\/p>\n<p>correctness of the amount. So in the light of the principles<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                               : 4 :<\/span><br \/>\nC.R.P.NO.2980 OF 2000<\/p>\n<p>laid down in Sunder and Gurpreet cases         the executing<\/p>\n<p>court is directed to consider interest on solatium and then<\/p>\n<p>permit the parties to file statement and find out correctness<\/p>\n<p>of the amount and direct the Government if any amount is<\/p>\n<p>further due, deposit it within a stipulated time. Parties are<\/p>\n<p>directed to appear before the executing court on 16.2.2001.<\/p>\n<p id=\"p_4\">     Disposed of accordingly.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                    M.N.
