NO. 2717 OF 2004\n\n\n             ============================\n\n                 Dated this the 11th day of January 2007\n\n\n                                    O R D E R\n<\/pre>\n<p id=\"p_1\">       The petitioner, who is the 1st accused in C.C. No. 1002\/2004<\/p>\n<p>in   the   court   of   Judicial   First   Class   Magistrate,   Thodupuzha,   has<\/p>\n<p>sought for setting aside the order of the court below rejecting his<\/p>\n<p>prayer   for   granting   exemption   from   personal   appearance   vide<\/p>\n<p>application filed under <a href=\"\/doc\/1009979\/\" id=\"a_1\">section 317<\/a> Cr.P.C.   It is the case of the<\/p>\n<p>petitioner that he is employed in the Middle East and he is unable<\/p>\n<p>to   be   present   in   the   the   court   right   now   and   if   he   leaves   his<\/p>\n<p>workspot   he   would   be   rendered   unemployed.     The   rest   of   the<\/p>\n<p>accused   were   acquitted.     The   charge   is   under   sections   498   A,<\/p>\n<p>420,   380,   109,   499   r\/w   34   <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>.     It   is   submitted   that   he   had<\/p>\n<p>surrendered   before   the   court   below   on   21.07.2004   and   was<\/p>\n<p>enlarged on bail. He was also present on the subsequent posting<\/p>\n<p>date.  But thereafter he had to join duty and hence could not be<\/p>\n<p>present.   It was in the above circumstances that he has filed an<\/p>\n<p>CRL. M.C. NO. 2717 OF 2004<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                           :2 :<\/span><\/p>\n<p>application   for   exemption   from   personal   appearance.     It   is<\/p>\n<p>submitted that he shall appear whenever specifically ordered.  He<\/p>\n<p>wants to plead not guilty through counsel.<\/p>\n<p id=\"p_1\">       2.     The   court   below   has   dismissed   the   application   on   the<\/p>\n<p>ground that the case involved is with respect to a serious offence<\/p>\n<p>and   hence   his   attitude   of   leaving   country   without   getting<\/p>\n<p>permission   from   the   court   was   improper.     The   court   has   noted<\/p>\n<p>the  decision  of   Superme  Court   in  <a href=\"\/doc\/1607096\/\" id=\"a_2\">Bhaskar  Industries   Ltd.,  v.<\/p>\n<p>B<\/a><br \/>\n   hiwani Denim &amp; Apparels Ltd.,  (2<br \/>\n                                                      001 (3) KLT 307 (SC))  as<\/p>\n<p>well   as   the   decision   of   this   Court   in  <a href=\"\/doc\/826707\/\" id=\"a_3\">Noorjahan   v.   Moideen<\/a><\/p>\n<p>(2000 (2) KLT 756),  but was not inclined to follow the same.   I<\/p>\n<p>find that the decision of Supreme Court as well as of this Court,<\/p>\n<p>the   above   cited,   is   clearly   to   the   effect   that   even   in   a   warrant<\/p>\n<p>case   exemption   can   be   granted   provided   that   the<\/p>\n<p>petitioner\/accused undertakes to the satisfaction of the court that<\/p>\n<p>he   would   not   dispute   his   identity   and   that   the   counsel   on   his<\/p>\n<p>behalf would be present in court and that he has no objection in<\/p>\n<p>taking   evidence   in   his   absence.     The   petitioner   has   filed   an<\/p>\n<p>application undertaking as above.  The offence under section 498<\/p>\n<p>A is the offence involved in Noorjahan&#8217;s case (op. cit) as well.<\/p>\n<p>CRL. M.C. NO. 2717 OF 2004<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                        :3 :<\/span><\/p>\n<p id=\"p_2\">      3.     In   the   circumstances,   the   order   of   the   court   below   is<\/p>\n<p>herewith   set   aside.     The   court   below   is   directed   to   permit   the<\/p>\n<p>counsel to represent the petitioner and plead guilty on his behalf<\/p>\n<p>and further proceed with the trial.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      The Crl. M.C. is allowed accordingly.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                            K.R.
