(J)\n\nCITATION:\n 1996 AIR  675\t\t  1996 SCC  (7) 394\n JT 1995 (8)   348\t  1995 SCALE  (6)480\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     The  notification\t under\tSection\t  4  of\t  the\tLand<br \/>\nAcquisition Act,  1894 [for  short, &#8220;the Act&#8221;] was furnished<br \/>\non January  22, 1981.  Notices were given under Section 9 of<br \/>\nthe Act.  The Collector\t after conducting an enquiry made an<br \/>\naward on April 19, 1984 and allegedly took possession of the<br \/>\nland on\t the even date. The respondents assert that they are<br \/>\nin possession.\tThe respondents\t filed the  writ petition on<br \/>\nMay 13,\t 1985 challenging  the notification  under Section 4<br \/>\n[1] of the Act on the ground that dispensing with an enquiry<br \/>\nunder Section  5-A exercising  power under Section 17 [4] of<br \/>\nthe Act was bad in law as there was no urgency and the award<br \/>\nwas, on\t the face  of the case, valid in law. The High Court<br \/>\nby order  dated May  27,  1985\tallowed\t the  writ  petition<br \/>\nfollowing <a href=\"\/doc\/1242810\/\">Dharam Singh vs. State of Haryana<\/a> [C.W.P. No. 2891<br \/>\nof 1984\t decided on 9th November, 1984]. Thus this appeal by<br \/>\nspecial leave.\n<\/p>\n<p>     It is  contended by  the appellant that after the award<br \/>\nhad been  made, the  respondents received  compensation\t and<br \/>\nalso sought reference under Section 18. The Land Acquisition<br \/>\nOfficer was  competent to  make the  award within  two years<br \/>\nunder Section  11-A of the Act after the Amendment Act 68 of<br \/>\n1984. The  award came  to be made within that period. So the<br \/>\nproceedings under  Section 4 and 6 shall not stand lapsed by<br \/>\noperation of Section 11-A of the Act.\n<\/p>\n<p>     It is  contended for the respondents that enquiry under<br \/>\nSetion 5-A  is a valuable right and a minimum right by which<br \/>\nthe owner is entitled to show that the land is not fit to be<br \/>\nused for  public purpose. It would be open to show that some<br \/>\nother land  would be more suitable for public purpose, viz.,<br \/>\nland  for  market  committee.  Exercising  the\tpower  under<br \/>\nSection 17  [4] dispensing  with the enquiry conducted under<br \/>\nSection 5-A  is clearly\t illegal. Though  there was delay on<br \/>\nthe part of the respondents in challenging the notification,<br \/>\ndelay does  not mitigate  to take away the valuable right of<br \/>\napproaching the\t High Court.  The order of the High Court in<br \/>\nDharam Singh&#8217;s\tcase [supra]  was not challenged. It is open<br \/>\nto the appellants to canvass the correctness of the award on<br \/>\nthat premise, though the award had become final.\n<\/p>\n<p>     The question  for consideration  is  whether  the\tHigh<br \/>\nCourt was  justified in\t interfering with  the\taward  dated<br \/>\nApril 19,1984  made by\tthe Collector  and the\tnotification<br \/>\nunder Section  4 [1]. It is seen that the notification under<br \/>\nSection 4  [1] and  the declaration were not challenged till<br \/>\nMay 13,\t 1985 while  the award\tcame to be made on April 13,<br \/>\n1984. The  respondents in  fact received  the  amount  under<br \/>\nprotest but  that fact\twas not brought to the notice of the<br \/>\nHigh Court.  It is also not in dispute that at that point of<br \/>\ntime an\t application for reference under Section 18 was made<br \/>\nwithin the limitation provided therein. It would appear that<br \/>\nafter the  writ petition  was  allowed\tthe  appliation\t was<br \/>\nwithdrawn. After  the award was made, the Court would not be<br \/>\njustified to  quash the\t notifcation under Section 4 [1] and<br \/>\ndeclaration under  Section 6 for dispending with the enquiry<br \/>\nunder Setion 5-A.\n<\/p>\n<p>     In these  circumstances, we  think that the appropriate<br \/>\ncourse would  be to sustain the notification under Section 4<br \/>\n[1] and\t the declaration  under Section 6 and the award made<br \/>\nunder Section  11. It  would be\t open to  the respondents to<br \/>\nmake an application under Section 18 within 30 days from to-<br \/>\nday to\tthe Collector  for  reference  to  Civil  Court\t for<br \/>\ndetermining the compensation.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed and the judgment of<br \/>\nthe High  Court under  appeal is  set aside.
