school, registered for allotment of a civic ame~n–ityi.sii’te,,in<\/p>\n
the respondent — Bangalore Develop_m.e_n.t_v<\/p>\n
under the Bangalore Development:._Aitt.hor:i4ty’—-.:[AliE’atnien’t<\/p>\n
of Civic Amenity Sites)..\u00bbi’i?,iiles0,V”._i989. <\/p>\n
allotting a site, found it to l0\u00a7e.l’;oc_eupie\u00e9liinaiilthorisediy
\nby a certain ShE1nthiI%iV%1]L{‘et;k_’%la[?\u00a5V .l33k:\u00a7uc’attional and Welfare<\/p>\n

 The petitioner was compelled to<\/p>\n

Sector~Vi was allotted to the petitioner a.s an ali:e’r\u00a71_ate<\/p>\n
allotment. by letter dated 20.09.2001 _<\/p>\n
followed by execution of a C.A. site lease’:agreement”= 2<\/p>\n
dated 7.5.2002 Annexure–“C” azjid  <\/p>\n
Possession Certificate dated-.._V2′?.(lC~.,2OO2 <\/p>\n
where under the petitioner   of the
\nsite on lease for a   . ‘<\/p>\n
3. It is the al1egationfoi’V’th:e  that by letter
\ndated  to M\/s. Rao
\n is said to have perinitted
\nconstructiorz  \/ camp for the purpose of<\/p>\n
co\u00bbnjs’tru.ct.ion”‘ofdconirnercial complex. According to the<\/p>\n
 petitiolne1’,.:”–..pursuant to that letter M\/ s. Rao<\/p>\n
 shut to use the CA Site No.4 allotted to the<\/p>\n
petitio’\u00a7ier’uzhereby the petitioner was unable to put up<\/p>\n
  ‘L;on_stru.(:tion of a building. It is further asserted that by<\/p>\n
 dated 12.11.2002 Annexurew”I?”‘ {though no<\/p>\n

\nup   dumped construction
\nmaterials  and having vacated the<\/p>\n
preniises  are-ceI1tly’lby which time the petitioner<\/p>\n
‘l V’  obtalinied  xsar1ctio1i’of a building plan, has taken steps<\/p>\n
  tddig in the site. By yet another letter dated<\/p>\n
 }\\nnexurew”J”, the petitioner reiterated the<\/p>\n
 stateinerits made earlier informing the EDA about the<\/p>\n
 the site by M\/s. Rao Constructions. The<\/p>\n
 Wrespondent — BDA having considered the ex’plar1a_tion<\/p>\n
offered, held that the construction of the commercial<\/p>\n
Complex was Complete and the complex was ope:’n\u00abe_ol.vin<\/p>\n
the year 2004 and despite passage   <\/p>\n
therefrorn. the petitioner failed t.o~p1_1t up.eo4fIst.riiC\u20ac,i_on  <\/p>\n
a building, being in breacli”gof:__t”he :’t–er:ns <\/p>\n
conditions of allotment,   <\/p>\n

 for labour shed and camp, to complete the<\/p>\n
