No.20919 of 2011\n                               Prabhat Ranjan\n                                    Versus\n                              The State Of Bihar\n                                   -----------\n<\/pre>\n<p id=\"p_1\">02\/-   19\/07\/2011                  Heard learned counsel for the petitioner and learned<\/p>\n<p>                     Additional Public Prosecutor for the State.\n<\/p>\n<p id=\"p_1\">                                   Petitioner is named accused in this complaint case being<\/p>\n<p>                     husband of the complainant with allegations of demand of dowry,<\/p>\n<p>                     torture etc. It appears there was an attempt for reconciliation, but<\/p>\n<p>                     ultimately failed.   One Maintenance Case No. 42 of 2011 under<\/p>\n<p>                     <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> of the Code of Criminal Procedure is also pending<\/p>\n<p>                     between the parties before Principal Judge, Family Court, Samastipur.<\/p>\n<p>                     However, as submitted, petitioner still intends to resume and continue<\/p>\n<p>                     the matrimonial relationship with the complainant and in order to put<\/p>\n<p>                     force in his intention a sum of Rs. 500\/- (five hundred) is also offered<\/p>\n<p>                     to be paid to the complainant by way of interim maintenance, subject<\/p>\n<p>                     to any order on the point by the competent authority.<\/p>\n<p id=\"p_2\">                                   Considering the facts and circumstances of the case, on<\/p>\n<p>                     the event of filing an application before the Principal Judge, Family<\/p>\n<p>                     Court, Samastipur under <a href=\"\/doc\/322349\/\" id=\"a_1\">Section 9<\/a> of the Hindu Marriage Act with<\/p>\n<p>                     clear intention as stated above, in the event of his arrest\/surrender<\/p>\n<p>                     before the court below within four weeks, let the petitioner, namely,<\/p>\n<p>                     Prabhat Ranjan, be enlarged on bail on furnishing bail bond of Rs.<\/p>\n<p>                     10,000\/- (ten thousand only) with two sureties of the like amount each<\/p>\n<p>                     to the satisfaction of Sub-Divisional Judicial Magistrate, Dalsingsarai,<\/p>\n<p>                     Samastipur, in connection with Complaint Case No. 62 of 2010,<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>            subject to condition laid down under <a href=\"\/doc\/590166\/\" id=\"a_2\">Section 438<\/a> (2)<a href=\"\/doc\/445276\/\" id=\"a_3\"> of the Criminal<\/p>\n<p>            Procedure Code<\/a> with additional condition to remain physically present<\/p>\n<p>            before both the courts below on each and every date at least for two<\/p>\n<p>            years or till disposal of the case, whichever is earlier, in case of failure<\/p>\n<p>            on two consecutive dates, without giving any reasonable explanation<\/p>\n<p>            or even on single default in payment, the liberty granted shall be<\/p>\n<p>            deemed to be cancelled.\n<\/p>\n<p id=\"p_3\">\n<pre id=\"pre_1\">Praveen\/-                              ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Prabhat Ranjan vs The State Of Bihar on 19 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
