PUBLIC PROSECUTOR for Respondent(s) : 1, \nRULE\nSERVED BY DS for Respondent(s) :\n2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 06\/05\/2011\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">By<br \/>\n\tway of present application, applicant has prayed to modify the<br \/>\n\tCondition Nos.3 an 4 of the order dated 10th April, 2008<br \/>\n\tpassed by the learned Additional Sessions Judge, Fast Track Court<br \/>\n\tNo.3, Ahmedabad (Rural), Mirzapur, in Criminal Miscellaneous<br \/>\n\tApplication No.37 of 2008.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tMr.Shalin Mehta, learned counsel for Ms.Vidhi Bhatt, learned counsel<br \/>\n\tfor the applicant, Mr.H.L. Jani, learned<br \/>\n\tAdditional Public Prosecutor for respondent<br \/>\n\tNo.1 and respondent<br \/>\n\tNo.2, i.e. Mr.Ashwinbhai Jayantilal Patel, Party-in-Person.\n<\/p>\n<p id=\"p_2\">Mr.Mehta<br \/>\n\thas contended that the applicant is a member of Ahmedabad District<br \/>\n\tPanchayat. The applicant is a businessman and a responsible citizen.<br \/>\n\tHe has contended that wife of the applicant is suffering from cancer<br \/>\n\t(carcinoma) of esophagus since August, 2010. He has also contended<br \/>\n\tthat for the purpose of treatment of his wife, he has to visit<br \/>\n\tAhmedabad many times. He has also contended that on humanitarian<br \/>\n\tground also. He has further contended that if the condition Nos.3<br \/>\n\tand 4 of the order dated 10th April, 2008 may be deleted,<br \/>\n\tno question regarding breach of law and peace can be arise. He,<br \/>\n\ttherefore, prayed that present application may kindly be allowed by<br \/>\n\tdeleting the condition Nos.3 and 4 of the order dated 10th<br \/>\n\tApril, 2008.\n<\/p>\n<p id=\"p_3\">As<br \/>\n\tagainst this, Mr.Jani, learned<br \/>\n\tAdditional Public Prosecutor, has read the medical<br \/>\n\tcertificates produced on record and contended that at the hearing of<br \/>\n\tthe first application, by which the condition was modified, the said<br \/>\n\tpapers were available with the applicant and due to that, that<br \/>\n\tcondition was modified by this Court. He has opposed the present<br \/>\n\tapplication.\n<\/p>\n<p id=\"p_4\">Heard<br \/>\n\trespondent<br \/>\n\tNo.2-Mr.Ashwinbhai Jayantilal Patel, Party-in-Person. He has opposed<br \/>\n\tthe present application and contended that if the conditions are<br \/>\n\tmodified, then there are chances that again the applicant threatened<br \/>\n\thim and question of safety and security is required to be protected.\n<\/p>\n<p id=\"p_5\">Heard<br \/>\n\tall the parties and perused the papers produced before me. It<br \/>\n\tappears that the  respondent<br \/>\n\tNo.2 has opposed the present application only because of fear.<br \/>\n\tMr.Mehta has assured that the applicant will maintain law and order.<br \/>\n\tIt also appears from the perusal of the papers that wife of the<br \/>\n\tapplicant is suffering from cancer. It also appears from the papers<br \/>\n\tthat the present respondent<br \/>\n\tNo.2 has challenged the orders dated 30th November, 2010<br \/>\n\tand 10th December, 2010 passed by this Court before the<br \/>\n\tApex Court by way of Special Leave Petitions (Criminal); however,<br \/>\n\tthe Apex Court has dismissed the said Special Leave Petitions.<br \/>\n\tLooking to the facts of the case and averments made in the<br \/>\n\tapplication, I am of the opinion that on humanitarian ground,<br \/>\n\tpresent application is required to be allowed.\n<\/p>\n<p id=\"p_6\">Hence,<br \/>\n\tin view of above, present application is allowed. The Condition<br \/>\n\tNos.3 and 4 of the order dated 10th April, 2008 passed by<br \/>\n\tthe learned Additional Sessions Judge, Fast Track Court No.3,<br \/>\n\tAhmedabad (Rural), Mirzapur, in Criminal Miscellaneous Application<br \/>\n\tNo.37 of 2008 as well as condition imposed upon the applicant, viz.<br \/>\n\t&#8220;the applicant shall not enter into Kanbha and Kunjad<br \/>\n\tvillage till further orders&#8221; vide<br \/>\n\torder dated 10th<br \/>\n\tDecember, 2010 passed by this Court in Criminal Miscellaneous<br \/>\n\tApplication No.15066 of 2010 are hereby deleted.
