S.J. MUKHOPADHAYA)<\/p>\n<p>\t\tThe<br \/>\nmarried daughters of the original petitioner were substituted as<br \/>\nheirs. One Jashbhai Chaturbhai  Patel-original land owner expired on<br \/>\n30th April, 1975, the son who was heir, challenged the proceedings<br \/>\nunder Urban Land (Ceiling and <a href=\"\/doc\/1489134\/\" id=\"a_1\">Regulation) Act<\/a>, 1976 in relation to<br \/>\ndifferent lands. Learned Single Judge by the impugned order dated<br \/>\n12th December, 2008, taking into consideration that the land was<br \/>\ndeclared surplus, without giving proper opportunity to married<br \/>\ndaughters, in view of some documents, the sisters have relinquished<br \/>\ntheir respective shares, observed that it was all the more incumbent<br \/>\non the competent authority to call upon sisters in light of the<br \/>\nprovisions of <a href=\"\/doc\/601175\/\" id=\"a_1\">Section 8(3)<\/a> of the Act read with Rule 5 of the Rules<br \/>\nto explain and confirm whether indeed any such<br \/>\nrelinquishment had taken place. It was noticed that the competent<br \/>\nauthority  himself having referred to these set of documents cannot<br \/>\nalso be heard to state that he was not aware as to the number of<br \/>\ninterested persons.  While holding  that the Tribunal misread itself<br \/>\nin law by not only dismissing the appeal on the ground of limitation<br \/>\nbut also on merits and thereby the order dated 17.1.1997 passed by<br \/>\nthe Tribunal was set aside. The order of the competent authority<br \/>\ndated 21.5.1986 was also set aside restoring the file before the<br \/>\ncompeting  authority for taking a fresh decision in accordance with<br \/>\nlaw, after taking into consideration what was observed by the learned<br \/>\nSingle Judge by the impugned judgment. The competent authority was<br \/>\ndirected to proceed from  the state of <a href=\"\/doc\/601175\/\" id=\"a_2\">Section 8(3)<\/a> of the Act<br \/>\nproceedings by calling upon all the persons interested after issuing<br \/>\na statutory notice as prescribed in law.\n<\/p>\n<p id=\"p_1\">2.\t\tThe<br \/>\nAppeal has been preferred against the last portion of the order dated<br \/>\n12th December, 2008 by which remand has been made to the competent<br \/>\nauthority for a fresh decision in accordance with law from the state<br \/>\nof <a href=\"\/doc\/601175\/\" id=\"a_3\">Section 8(3)<\/a> of the Act.\n<\/p>\n<p id=\"p_2\">3.\t\tLearned<br \/>\ncounsel for the appellant would contend that the Urban Land (Ceiling<br \/>\nand <a href=\"\/doc\/1489134\/\" id=\"a_4\">Regulation) Act<\/a>, 1976 has been repealed by the Urban Land<br \/>\n(Ceiling and Regulation) Repeal Act,1999  on 1st March, 1999 and thus<br \/>\nthe order of remand from the stage of <a href=\"\/doc\/601175\/\" id=\"a_5\">Section 8(3)<\/a> is futile. The<br \/>\nauthority has no jurisdiction to decide the matter.\n<\/p>\n<p id=\"p_3\">4.\t\tLearned<br \/>\nAssistant Government Pleader on behalf of the State while accepts the<br \/>\naforesaid position, per contra, submits that even if that last<br \/>\nportion is set aside, the appellants cannot derive any advantage of<br \/>\nthe same. The possession of the land was taken over by panchnama<br \/>\ndated 9th February, 1988. He placed reliance on Division Bench<br \/>\nunreported judgment of this Court dated 20th April, 2010 passed in<br \/>\nMuliben Bachubhai Bharwad vs. State of Gujarat in LPA No.2167 of<br \/>\n2009 and the judgment dated  3rd May, 2010 in case of  New Shivshakti<br \/>\nVijay Saw Mills vs. State of Gujarat. In the said cases, the<br \/>\nDivision Bench held that &#8220;Thus, for the purpose of applicability<br \/>\nof the <a href=\"\/doc\/1547625\/\" id=\"a_6\">Repeal Act<\/a>, crucial question is if the Government by taking<br \/>\nover possession of the vacant land before the <a href=\"\/doc\/1547625\/\" id=\"a_7\">Repeal Act<\/a> but the<br \/>\ndeclarant re-enters the land, such unauthorised possession on the<br \/>\ndate of introduction of the <a href=\"\/doc\/1547625\/\" id=\"a_8\">Repeal Act<\/a> cannot be the basis to hold<br \/>\nthat the ULC proceedings have lapsed.&#8221;\n<\/p>\n<p id=\"p_4\">\t\tPer<br \/>\ncontra, the aforesaid submission was confronted by the learned<br \/>\ncounsel for the appellants and submitted that the appellants are<br \/>\nstill in possession of the land.\n<\/p>\n<p id=\"p_5\">5.\t\tHaving<br \/>\nheard learned counsel appearing on behalf of the parties, while we<br \/>\nare not deliberating on the issue whether the appellants can derive<br \/>\nany advantage of the Urban Land (Ceiling and Regulation) Repeal<br \/>\nAct,1999  or not, as it is agreed upon and under the law, the Act<br \/>\nhaving been repeated, it was not open to the learned Single Judge to<br \/>\nremit the matter for a fresh decision to the competent authority on<br \/>\nthe question from the stage of <a href=\"\/doc\/1547625\/\" id=\"a_9\">Section 8(3)<\/a> of the Act. We<br \/>\naccordingly set aside the part of the order dated 12th December, 2008<br \/>\nso far as it relates  to remand of the case to the competent<br \/>\nauthority from the stage of <a href=\"\/doc\/1547625\/\" id=\"a_10\">Section 8(3)<\/a> of the Act. Special Civil<br \/>\nApplication No. 6255 of 1997 is remitted to the learned Single Judge<br \/>\nto decide the issue whether the appellant can derive advantage of the<br \/>\n<a href=\"\/doc\/1547625\/\" id=\"a_11\">Repeal Act<\/a>. Rest of the questions are left open. The Appeal and Civil<br \/>\nApplication both stand disposed of.
