Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/11\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n          CRL.M.C.No. 2713 &amp; 2724       OF\n                         2009\n            ===========================\n\n    Dated this the 30th day of November,2009\n\n                        ORDER\n<\/pre>\n<p id=\"p_1\">    Stage Carriage bus KL-7\/AC-3768 involved in Crime<\/p>\n<p>314\/2009 of Kumali Police Station was seized by the<\/p>\n<p>police on the allegation that an offence under <a href=\"\/doc\/1270101\/\" id=\"a_1\">section<\/p>\n<p>279<\/a> of Indian Penal Code is made out.  The vehicle was<\/p>\n<p>produced before the Magistrate and as directed, kept in<\/p>\n<p>the police station.  Petitioner filed CMP No.2500\/2009<\/p>\n<p>and second respondent filed CMP 2499\/2009 for interim<\/p>\n<p>custody of the vehicle under <a href=\"\/doc\/768169\/\" id=\"a_1\">section 451<\/a> of Code of<\/p>\n<p>Criminal Procedure.  Petitioner claimed right based on<\/p>\n<p>Annexure A1 agreement for sale contending that by the<\/p>\n<p>said agreement, second respondent the registered owner<\/p>\n<p>agreed to sell the vehicle for a total consideration of<\/p>\n<p>Rs.10 lakhs and Rs. 3 lakhs was paid as advance and<\/p>\n<p>therefore he is entitled to get interim custody of the<\/p>\n<p>vehicle.  Second respondent being the registered owner<\/p>\n<p>claimed  interim  custody.     By  Annexure  A5   order<\/p>\n<p>Crl.M.C.2724\/2009  application  filed  by  the   second<\/p>\n<p>respondent was allowed and by Annexure A4 order in<\/p>\n<p>Crl.M.C.2713\/2009, the petition filed by the petitioner<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.2713 &amp; 2724\/2009          2<\/span><\/p>\n<p>was   dismissed.        Crl.M.C.2713\/2009  was  filed  to  quash<\/p>\n<p>Annexure A4 order by which his application for interim<\/p>\n<p>custody was dismissed.          Crl.M.C.2724\/2009   is filed to<\/p>\n<p>quash Annexure        A5  order  by  which  interim  custody  was<\/p>\n<p>granted to the second respondent.\n<\/p>\n<p id=\"p_1\">      2.     Petitioner would contend that eventhough second<\/p>\n<p>respondent      is   the  registered   owner  when  he  executed<\/p>\n<p>Annexure A1 agreement, learned Magistrate should not have<\/p>\n<p>granted    interim     custody  of  the  vehicle  to  the  second<\/p>\n<p>respondent in view of the sale to the petitioner and<\/p>\n<p>therefore the order is to be quashed.\n<\/p>\n<p id=\"p_2\">      3. Learned counsel appearing for the second respondent<\/p>\n<p>pointed    out    that   Annexure   A1  agreement  is  a  forged<\/p>\n<p>agreement and it was not executed by the second respondent<\/p>\n<p>and on coming to know about the forgery, a complaint was<\/p>\n<p>filed before the Judicial First Class Magistrate, Peerumedu<\/p>\n<p>and it was sent for investigation under <a href=\"\/doc\/99487\/\" id=\"a_2\">section 156(3)<\/a> of<\/p>\n<p>the Code of Criminal Procedure and Crime 314\/2009 of Kumali<\/p>\n<p>Police Station is registered for the offence under <a href=\"\/doc\/1897847\/\" id=\"a_3\">section<\/p>\n<p>120B<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_4\">468<\/a>      and    <a href=\"\/doc\/1466184\/\" id=\"a_5\">471<\/a>  of  Indian  Penal  Code  and  in  such<\/p>\n<p>circumstances, petitioner is not entitled to get interim<\/p>\n<p>custody of the vehicle.          It is argued that as second<\/p>\n<p>respondent is the registered owner of the vehicle, learned<\/p>\n<p>Magistrate      rightly granted interim custody of the vehicle<\/p>\n<p>to him and there is no reason to interfere with the order.<\/p>\n<p id=\"p_3\">      4.   Annexure A5 order passed by the learned Magistrate<\/p>\n<p>establish     that    it  was  the  second  respondent  who  has<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.2713 &amp; 2724\/2009          3<\/span><\/p>\n<p>produced the entire vehicular documents including the R.C<\/p>\n<p>book    and  the    insurance  certificate  before  the  learned<\/p>\n<p>Magistrate.      Second respondent is admittedly the registered<\/p>\n<p>owner of the vehicle.        Though petitioner is claiming that<\/p>\n<p>second respondent executed an agreement for sale           after<\/p>\n<p>receiving Rs.10 lakhs and the vehicle was transferred to<\/p>\n<p>him, when second respondent disputes the agreement and<\/p>\n<p>contend that the agreement was not executed by him and it<\/p>\n<p>is a forged document, petitioner is not entitled to get<\/p>\n<p>interim custody of the vehicle on the strength of the<\/p>\n<p>document.      I find no reason to interfere with the order<\/p>\n<p>passed    by    the    learned Magistrate  under   Annexure  A5,<\/p>\n<p>granting interim custody to the second respondent who is<\/p>\n<p>the registered owner.       If petitioner is having any right by<\/p>\n<p>virtue of the alleged agreement executed by the second<\/p>\n<p>respondent, he is at liberty to approach the civil court<\/p>\n<p>seeking a decree based on the agreement.
