No. 26 of 2009 on<\/p>\n<p>the file of the J.F.C.M., Kothamangalam for offences punishable<\/p>\n<p>under <a href=\"\/doc\/1011035\/\" id=\"a_1\">Sections 323<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_1\">324<\/a> and <a href=\"\/doc\/1599401\/\" id=\"a_2\">341<\/a> of I.P.C. seeks to quash Annexure<\/p>\n<p>5 and all further proceedings in the above C.C.<\/p>\n<p id=\"p_1\">      2. It is too early for this Court exercising jurisdiction under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a> Cr.P.C to meticulously scan the voluminous prosecution<\/p>\n<p>records and hold that the prosecution of the petitioners is groundless<\/p>\n<p>and the same is liable to be quashed. The appropriate remedy of the<\/p>\n<p>petitioners is to plead for a discharge before the Court below.<\/p>\n<p id=\"p_2\">      3. Having regard to the facts and circumstances of the case, I<\/p>\n<p>am inclined to permit the petitioners to plead for a discharge               in<\/p>\n<p>absentia.      Accordingly if the petitioners file an application for<\/p>\n<p>discharge before the court below through their counsel, that court<\/p>\n<p>shall not insist on the personal appearance of the petitioners for the<\/p>\n<p>disposal of the discharge petition.\n<\/p>\n<p id=\"p_3\">      This Crl.M.C is disposed of reserving the above right of the<\/p>\n<p>petitioners.\n<\/p>\n<p id=\"p_4\">      Dated this the 24th day of May, 2010.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                                             V.
