Justice R.BASANT\n\n Dated :24\/10\/2007\n\n O R D E R\n                               R.BASANT, J\n                        ------------------------------------\n                         B.A.No.6420 of 2007\n                       -------------------------------------\n              Dated this the 24th day of October, 2007\n\n                                    ORDER\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail. Petitioners are accused 2 and 3<\/p>\n<p>in a crime which was initially registered for offences punishable, inter<\/p>\n<p>alia, under Sections 324 and 307 r\/w 149 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. The alleged incident<\/p>\n<p>had taken place on 4.9.05. The crime was registered only on 8.9.05.<\/p>\n<p>The crux of the allegations is that there was a dispute between two<\/p>\n<p>sets of workmen employed in construction work. The victim belongs to<\/p>\n<p>the group of workers who were brought from Bengal. On account of<\/p>\n<p>the alleged negligence of the alleged victims those working beneath<\/p>\n<p>had suffered injuries and consequent to that, later, there was a dispute<\/p>\n<p>and quarrel. In the course of such quarrel, the victims were allegedly<\/p>\n<p>beaten with dangerous weapons like iron rods etc. by a group of<\/p>\n<p>workmen.    4 persons are specifically named in the F.I statement<\/p>\n<p>lodged before the police after 4 days of occurrence. One of the victims<\/p>\n<p>had suffered injuries to kidney and ultimately one kidney of his had to<\/p>\n<p>be removed also. The petitioners are not shown initially in the array<\/p>\n<p>of accused. 4 persons though named in the F.I.R, 2 of them have<\/p>\n<p>been deleted from the array. In their place, the petitioners have been<\/p>\n<p>brought on the array. Though initially allegations under <a href=\"\/doc\/1439698\/\" id=\"a_1\">Section 149<\/a><\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.6420 of 2007                  2<\/span><\/p>\n<p><a href=\"\/doc\/1569253\/\" id=\"a_2\">I.P.C<\/a> and other allied offences were raised, now allegation is raised<\/p>\n<p>only under <a href=\"\/doc\/1439698\/\" id=\"a_3\">Sections 324<\/a> and <a href=\"\/doc\/1439698\/\" id=\"a_4\">307<\/a> r\/w 34 <a href=\"\/doc\/1569253\/\" id=\"a_5\">I.P.C<\/a>.\n<\/p>\n<p id=\"p_1\">      2.    The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners are absolutely innocent.     They have been unnecessarily<\/p>\n<p>brought on the array of accused. Even going by the version of the<\/p>\n<p>prosecution, it can be seen that a number of other persons were<\/p>\n<p>available at the scene. Omnibus allegations were raised against all<\/p>\n<p>such persons. Ultimately the petitioners who were not named in the<\/p>\n<p>F.I.R have been dragged into the controversy. Investigation is already<\/p>\n<p>complete. The petitioners may not be compelled to endure the trauma<\/p>\n<p>of arrest and detention.     Anticipatory bail may be granted to the<\/p>\n<p>petitioners, it is prayed.\n<\/p>\n<p id=\"p_2\">      3.    The learned Public Prosecutor submits that the State does<\/p>\n<p>not at this stage want to oppose the application for anticipatory bail,<\/p>\n<p>the substantial     portion of the investigation having already been<\/p>\n<p>completed.\n<\/p>\n<p id=\"p_3\">      4.    I have perused the case diary. Considering the nature of<\/p>\n<p>the contention, I am satisfied that the petitioners can be granted<\/p>\n<p>anticipatory bail subject to appropriate terms and conditions.<\/p>\n<p id=\"p_4\">      5.    In the result, the Bail Application is, allowed. The following<\/p>\n<p>directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_6\">Section 438<\/a> Cr.P.C.<\/p>\n<p id=\"p_5\">      i)    The petitioners shall appear before the learned Magistrate<\/p>\n<p>at 11 a.m on 31.10.07. They shall be enlarged on regular bail on their<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.6420 of 2007                 3<\/span><\/p>\n<p>executing a bond for Rs.25,000\/- (Rupees Twenty Five thousand only)<\/p>\n<p>each with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate;\n<\/p>\n<p id=\"p_6\">      ii)   The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and 3<\/p>\n<p>p.m on 01.11.07 and 02.11.07 and thereafter between 10 a.m and 12<\/p>\n<p>noon on all Mondays and Fridays for a period of one month.<\/p>\n<p>Subsequently the petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer as and when directed by<\/p>\n<p>the Investigating Officer in writing to do so;\n<\/p>\n<p id=\"p_7\">      iii)  If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioners and deal with them      in accordance with law as if those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<p id=\"p_8\">      iv)   If the petitioners were arrested prior to their surrender on<\/p>\n<p>31.10.07 as directed in clause (1) above, they shall be released from<\/p>\n<p>custody on their executing a bond for Rs.25,000\/- (Rupees Twenty<\/p>\n<p>Five thousand only) each without any sureties undertaking to appear<\/p>\n<p>before the learned Magistrate on 31.10.07.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                                  (R.BASANT, JUDGE)<br \/>\nrtr\/-\n<\/p>\n<p id=\"p_11\"><span class=\"hidden_text\" id=\"span_2\">B.A.No.6420 of 2007    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Jayan.C. vs Sub Inspector Of Police on 24 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 6420 of 2007() 1.
