   The respondent herein filed claim petition before<\/p>\n
 “the Workmen’s Compensation Commissioner, seeking<\/p>\n

compensation under the Workmen’s Compensation Act<\/a>. It is<\/p>\n
the contention of the respondent claimant befoyrelithe<\/p>\n
Workmen’s Compensation Commissioner that wlii1e\u00ab\u00abhe..__*:Was’ <\/p>\n
discharging his duties as a ‘chipper’ under the  <\/p>\n
of respondents 1 and 2, R.M.C. Pipezgpfellion   he <\/p>\n
sustained severe injuries which .led to” .(_:o’nsequ_entdisability. <\/p>\n

sustained 100% disability and loss of earning capacityas he<\/p>\n

appellant. it  appearing for the appellant
\nsubmitted’ that the appellant insurance<\/p>\n
Company had i_ss’ued the Worlnnan Compensation Policy and<\/p>\n
  iiablez to reimburse the owners regarding the<\/p>\n
 ._coi_np’ens’a,tion\u00ab._ ‘awarded in View of the Workman<\/p>\n
Co’inpensati’o\u00a7.1’ll:Policy issued, is not disputed. However, the<\/p>\n
W,learned_ Aicounsel submitted that, the quantum of<\/p>\n
“‘liVt_L0.r1Fip’ensation awarded by the Workmen’s Compensation<\/p>\n
  Commissioner is highly excessive as even according to the<\/p>\n
\\;:~wi><\/p>\n
evidence of the Medical Officer from Bowring Hospital, who<\/p>\n
has been examined before the Workrnen’s Comper.1sa.ti0..n<\/p>\n
Commissioner, the disability of the affected  _<\/p>\n
to the whole body is 10% and there  ir\ufb01ateriaiii\u00e9 <\/p>\n
whatsoever to take the disability  1C?_0’\u00a7’t\/pl  if<\/p>\n
Workmen’s Compensation Commissioner and t1:1e’VVorkm_\u00a7\u00a7:n’s _ ” ;<\/p>\n
Compensation Commissioner has not takeninto “account the<\/p>\n
provisions of the Wori;_ri’iyen’sA_ ,Cor;1_p\u00bbensation Act under<\/p>\n
Section 4<\/a> {1} (C) (:1) and Partfil jtgind the \ufb01nding
\nof the  that the
\nclaimant    and loss of earning
\ncapacity; CCCC if  and the sarne is not

 reimbursed by the employer. Learned<\/p>\n
connsel a}.soi’sufbmitted that according to the evidence of the<\/p>\n
 “owner, ” workman was given light work after the injury<\/p>\n
   treatment and discharge from the Hospital.<\/p>\n

5. After careful consideration of the contentions of the
\nlearned counsel for the appellant, the questions of
\narise for determination in this appeal are:<\/p>\n
I] Whether the quantummof  <

\ndisability as 100%, is "p_e'n.gerse;"~ <\/p>\n
unsustainable in law ?\n<\/p>\n
H] What order ”\n<\/p>\n
Consideringfthpe .,c’onte_ntic_>.ns of ‘the learned counsel<\/p>\n
appearing__Vfor~ 7Va_ppellantt”vta1id_:iscreltinizing the material on _<\/p>\n
recordftl ansu}ef.”;ii_e”‘Vpoint-1\\l_o;1.’ in the affirmative and point
\nNo. as per. the final ‘or’der;.for the following reasons.<\/p>\n
4; Queestion’=l\\_los.l’ [I] and [II] are Considered together since<\/p>\n
ti1ey\\are”‘interconnected and to avoid repetition.<\/p>\n
V   that the claimant sustained injury arising<\/p>\n
0ut”‘andV___in  course of employment on 155″ July 2003, is<\/p>\n
 disptited. The liability of the Insurance Company to<\/p>\n
  the award passed against the owner is also not<\/p>\n
he   disputed as the policy covers the compensation payable<\/p>\n

under the Workn1en’s Compensation Act<\/a>. The material on
\nrecord would show that the claimant injured was treated in<\/p>\n
the Hosmat Hospital. However, no doctor from the said<\/p>\n
Hospital who gave treatment to the claimant has.l_l’bee.n<\/p>\n
examined. However, Dr. H.S. Manjunath who is.\u00abvvorki\ufb01g__as._c _<\/p>\n
Orthopedic Surgeon in Bovvring Hospital hasbeen: if <\/p>\n
and according to the evidence of thel’\u00bbsaicl”dc’ctor,l there’<\/p>\n
union of the fracture and according to there d.isabl;litv  ;<\/p>\n
of 30% to the affected limb, and  is tendernessvjover the
\nleft ankle, one scar over  left a:.nlt1e..and~cplanter flexion of<\/p>\n
the left ankle isgreduced tdisability of the<\/p>\n

treated after, he sustained injury during the course of<\/p>\n
 l’i.employ1o:V1e’i1t and he has clearly admitted that he has not<\/p>\n
“‘l:referr’e-d to the Wound Certificate issued by the Hosmat<\/p>\n
  Hospital and he has only examined the claimant for the<\/p>\n

purpose of assessing the disability on the date he has<\/p>\n
appeared before him and as per the complaint and the injuiy<\/p>\n
which the claimant was complaining. The reason. assigfned..<\/p>\n

taken into  proeisions of Section 4<\/a> (1) C) (ii)

for the purposese of s’u.h’#’clause (ii), that is non schedule<\/p>\n

relation tolinjuries specified in the Schedule I and the<\/p>\n

and thereafter pass fresh orders in accordance with lav.’r}r\u00bbc<\/p>\n
